    I agree with the previous post that you really should get yourself a lawyer to sort all of this out. There are mechanisms in place that allow UK citizens to collect child maintenance allowances from former partners living abroad -- http://www.dca.gov.uk/family/remo/faq.htm, so your husband's ex-wife can potentially pursue the case in spite of your husband's residence in the US. You would have to seek legal advice to find out if your husband could be liable for the back-pay or not.

    I also wanted to comment on some of the replies that you received, and say that I am disappointed at the small-mindedness of some of the replies in this forum. None of us understand the particulars of your situation and hence have no place judging you or your husband. It's a travesty that you came here for support and advice, and instead received a series of puerile responses from people whose opinions are rooted in personal experiences/views that have nothing to do with you.

    Just wanted to let you know that there are some sympathetic souls out there, and that you probably should just ignore unhelpful replies as they are not worthy of your time and consideration.

  2. Sorry everyone, this might be a bit of a stupid question. I just received this via email from the London consulate:

    The Petition(s) for Alien Relative (I-130) that you recently submitted to

    this

    office has been received and filed on March 15, 2007.

    Processing time for I-130 petitions: Petitions are adjudicated in the order

    in

    which they are received.

    There is no receipt number assigned to each petition; however, you can check

    on

    the below web site as to what date we are currently processing petitions.

    I'm wondering why you haven't replied to the people who have taken the time to think about and answer your questions and provide you with helpful information.

    Didn't realize it was expected-- I figured people post a reply and if they don't have a follow up question, never look at that thread again. I never even saw this particular post of yours until my husband pointed it out 10 minutes ago... He just had a massive go at me when he discovered your post however, telling me how horrible and ungrateful I am (he has taken over the VJ surfing, and spends most of his evenings dutifully responding to people's posts) and how he can't believe his user account is associated with my user account, etc etc :oops: . I'm very sorry, I didn't mean to seem ungrateful, as all the replies were very useful.

  3. Hi all,

    I have a question about the domicile and income requirements. I (USC) live in London with my husband (UKC) and we're DCF filing in London. Sent the I-130 last month. I'm moving back to the States in September to do a Phd and I'm hoping my husband can move there with me around the same time.

    Once the I-130 is approved I'll need to send the Affidavit of Support, but at this point I'll still be living in the UK. I will shortly be signing a lease on an apartment through the University and I already have documents from the University stating that I will get a yearly stipend of $24,000 (above the poverty line requirements) for the next 5 years.

    My questions:

    1) Will the lease contract (starts September 1st) be enough to cover the US domicile requirement?

    2) Will the letter from the university be enough to cover the income requirement?

    If not, then what do I have to do? Do I have to wait until I've moved back to the US to complete the Affidavit of Support or is there anything else I can do to prove I'm (going to be) domiciled in the US?

    Thanks for your help.

    P.S. Anyone know where I can find out what the vaccination requirements are for my husband? Best to get this sorted before the medical, right?

    My husband and I filed through the London USCIS recently. We've been watching the I-130 processing times (http://london.usembassy.gov/dhs/uscis/i130filing.html). Originally it seemed like things were taking about 3 months -- but since then its seemed to slow to a crawl -- now it looks like applications are taking 4 months to process and the duration only appears to be getting longer. :(

    Anyone know what's going on? Has anyone had their application approved earlier than indicated on the website? Has London suddenly lost all of its staff or is the site just not that accurate?

  6. Hi all,

    I've been living in the Uk for the past 2 1/2 years with my husband, and haven't been filing my taxes (didn't realize you had to until I started looking into bringing my husband to the states :blush: ). Hence, no tax returns. I could file the last 2 years late, but I don't even have the W-2s from the job I finished at the very beginning of the first year I didn't file (ahhhh!!!) or the P60 for my UK job for that year (brit equivalent). Because I have no US income, I was going to have my father co-sponsor anyway.

    Are tax returns necessary if you are using a co-sponsor to meet the requirement on the affidavit of support? How much trouble is this going to get me in? Help!

    I live in the UK with my husband, who is a british citizen. I am a USC and have lived here for 2 1/2 years but do not have indefinite leave to remain. The London consulate told us we can't file here since I don't have indefinite leave to remain -- does anyone know where we should file? I no longer have an address in the US, but apparently cannot file in the UK either. I used to live in California, but hope to move to Massachusetts soon with my husband. So should I file in California or Vermont? Or neither? :help:

  8. I have a question about the K-3 visa and making the EAD application. I am a USC and my husband is British. We've been living in the UK together for a couple of years and now we are looking to move to the US together so I can go to graduate school. The K-3/EAD option seems best, but we don't want to get into too much debt while he's in the US and not working. Is there any reason why we can't get the K-3 for him, have him come over to the US for a week and apply for the EAD and then he'll return to the UK and continue to work while we wait for the EAD to be processed? He would then come to the US once the EAD is approved. The non-K3 alternatives just seem too risky (ie we might be separated for a very lengthy period of time).

    Any information would be much appreciated.
