  1. Hi everyone. I've been lurking for some time. I understand that if someone is in the process of AOS and leavers without advance parole then his/her petition is considered abandoned. In my case, I did leave the US and re-entered on a G4 visa. However, the submission date on USCIS of my Application to Register Permanent Residence or Adjust Status I-485 is a few days after I re-entered the country. The submission date for the EAD and AP is a few days before I left the United States but not for the I-485. There was a delay in processing the payment for the I-485 which is why there a difference in the dates. Does anyone had a case like this previously and what was the outcome? I had an RFE after the interview. I responded to the RFE (in person submission) in early Dec 2019. I haven't received an updates yet so I'm getting nervous. Thanks everyone!

    I have been living and working in the US legally for the past year on a diplomatic visa.  I will be adjusting my status based on a family based petition. The petitioner is showing carried losses in their tax returns. I, the intending immigrant, has a job and will continue to hold the same job after the adjustment of status.  Does my income count for anything for the affidavit of support income requirements?

  3. Long story short, I'm in the US and my priority date is current. This is a petition from a sibling. For the affidavit of support, my sibling will be declaring carried losses and his income will not meet the minimum poverty threshold. The petitioners income might be zero. I have sufficient cash deposits in an overseas bank account that would meet the 5x income multiple as well as a legal job in the US that I will continue to hold after the adjustment with a salary that is in excess of the poverty requirements.

     

    My questions are:

    1. Can I use my overseas cash deposits that in my bank account to cover the shortfall of the petitioner?

    2. Will my current income count towards anything in this calculation?

     

    Appreciate any insights from previous experience on this!
