  1. thank you for replies and sorry for duplicated posts. i am really confused even though some of you answer the question please forgive me for asking again..

    here on this page: https://www.avvo.com/legal-answers/receiving-work-authorization-or-i-551-stamp-after--2417904.html

lawyers say my status will be terminated if I751 gets denied. I also hear people say ONLY A JUDGE can terminate my status and even after i751 gets denied, until a judge terminates my status I WILL STILL BE ABLE TO WORK AND TRAVEL.

Which one is correct? i appreciate your help.

  2. hi and thank you in advance for help. i am separated but didn't file for divorce yet. marriage is real, im not afraid to prove but i want to know what are my options

my spouse says he can go to interview(in Dallas, TX) with me but if we go together and say that we will get divorce, will i get denied? I don't want to lie( we are separated and planning for divorce) but i am not sure if i should go to interview alone or with my spouse.

a lawyer told me if i go alone, i will be denied. another one said if i can prove marriage was real, i may be approved. i am really confused and exhausted.

please let me know if you have answers. thank you

  3. hi and thank you for answering my post. I'm really confused because i hear different answers so i wanted to ask you this question. if you can answer, thank you in advance.

i just want to know this: i am separated from my wife. my i751 is pending and i will get an interview soon. if i go alone, i was told that i would get denied.

Will i have to stop working? my green card and extension letter expired already. i was told that my status will be terminated when i751 gets denied. i know that i can go to judge and fix it but i am afraid between the denial and judge, i will lose my job. is this true?

why people say i won't be authorized to work if i751 gets denied but other people say only a judge can terminate the status. even lawyers say different things. thank you again.

You will get an RFE for the divorce decree and will hand it in once the divorce is final.

When did you file the I-751? Wait times are looong from what I read so you might very well be able to get the divorce finalized by the time your interview comes around. Until then you have your extension letter as proof of valid LPR status.

I'd just recommend to actively withdraw your N-400 now, to show good moral and not come into the situation that it looks like you're playing the system :)

i filed i751 over 20 months ago. my extension letter expired already.

You could go to interview and switch to a divorce waiver. You should really file for divorce now so you can get the divorce decree. They will give you an RFE and thats 90 days to provide it. And otherwise you can file a new I-751 with a divorce waiver. Also please see above with your N-400 as you can't continue with that one.

thank you for answer. what if i can't divorce in 90 days?

during this time, will i be able to work? i am ok with giving up on n400 for now.

    Why would it be denied?

i am separated from my spouse. I am waiting for an interview.

I am planning to file a divorce but didn't file yet and currently separated.

Lawyer said that it will be denied if i go to interview alone because i have pending joint I751. i am just worried that i will lose my job. i'm not afraid to prove that marriage was real.

  7. Hi, I have a pending I751 and n400 applications. I separated from my spouse. I live in Dallas,TX. A lawyer told me that my case will be denied and I will have to file for waiver.

We didn't file for divorce yet. If my I751 gets denied, will I have to stop working? If I have to stop working, should i stop work when I receive the letter?

I read online that says my permanent resident status will be terminated if I751 gets denied.

Any help will be appreciated thank you.

1 - If i pass the exam and everything goes well during interview, approximately how long it takes for me to take oath and then finally apply for passport?

Depends on your local office. I've seen it generally range from 1 to 12 weeks.

2 - my I-751 (removing conditions) is still pending. I have no news for it. What should happen next for it?

Your i-751 has to be resolved/approved first. Some offices will approve it within a day of the interview, others take more time. The extra i751 processing time is an addition to the range quoted above.

3 - Is it recommended to travel abroad before or after my interview (I have expired green card and ALMOST expiring extension letter)

No problem traveling on your extension letter. If your extension letter expires, go to your local office for an i551 stamp in your passport

4 - My spouse doesn't have to show up at interview, correct?

Wrong. Your spouse needs to be there because the interview is likely a combo i751 and n400 interview and she needs to answer questions related to i751 if they have any.

5 - What supporting documents should I bring? Is it enough to bring what i submitted with N400 application? or should i bring anything else?

If you didn't submit your IRS transcript for 2018 tax return with your N400, take that.

thank you for answer. I'm in Dallas, TX.

Do I have to do anything to get my I751 approved before interview? What if it doesn't get approved until interview?

My n400 interview letter doesn't say anything about my spouse to be there. MY i751 has no update (such as interview) How can I know that my spouse has to go with me? Letter doesn't say anything about it. If I go alone, will I be denied?

  9. Hi everyone, my I-751 (removing conditions) is still pending. I have no news about it for a long time. Website still says "Fingerprints taken"

It has been over 15 months. My extension letter is expiring in 3 months.

    1. I filed N400 and they scheduled the interview for November. What should I expect for my green card?
    2. Will anything happen before N400 interview?
    3. Is it likely that I will receive ROE or interview with my spouse for the pending I-751?

    Thank you in advance.

  10. Hi everyone, my interview is scheduled for november but I'm curious about these things. If anyone can help, i would appreciate.

  11. Hi all, i am previously recommended to get stamp on my passport so i can leave US and come back with expired green card and extension letter.( my gc is expired and extension letter will expire soon)

i live in texas and  when i tried to make appointment online, it says "This office is not accepting walk-in requests or scheduling InfoPass appointments."

how can i get this stamp on my passport?

    thank you.

  12. Hi all, my GC is expired and I751 is still pending. It was filed over 16 months ago.

My 18 month extension letter is expiring soon. I still haven't heard anything after biometrics.

I have to travel abroad in next 2 months for business(i have to travel otherwise i will lose my job). What should i do if i can't return in 3 months?

If I get stamp in passport before i travel, will it let me enter us if green card and extension letter BOTH expires?

    thank you

  13. Hi everyone, i was recently told that(from lawyers on avvo) I made a mistake by moving to different state in my case. This confused me.

I filed ROC in NY 15 months ago. Then I and my spouse moved to TX 12 months ago.(3 months after we filed I-751)

We updated USCIS etc and I applied for N400 in my current state.

    Did I make any mistakes?

Will it have a bad impact on anything, Because I moved to a different state AFTER filing I751?

    Thank you.

  14. Hi everyone, My US citizen spouse and I entered into good faith marriage but its falling apart. We are currently live together in Dallas,TX and getting marriage therapy but things are not looking good and getting ready to file for divorce.

My I751 is taking too long(15+ Months) so I have an expired green card and extension letter for 18 months. Extension letter expires soon and case status still says "Fingerprint Review Was Completed"

I already submitted form N-400 for naturalization and finished biometrics.

If I get an interview for I751, should I go? if I go alone, what would happen?
If I go alone, will my case be denied? If it doesn't get denied, will it be complicated and painful?

What are the chances of getting permanent green card at this point? I'm ok with applying for N400 later in the future but i want to know what are my chances for getting permanent GC?

Does anyone have any similar experience? I'm also wondering if my case seems painful.

    Thank you in advance.

  15. Hi everyone, I have a question about employment section on the form.

I worked full-time as self-employed during OPT in Dallas,TX (after graduating from school and receiving work authorization) without forming an LLC (I was a sole-proprietor, contractor) and become LPR in 2013. Back then, I was always approved for this work and kept everything reported to my school and worked with an EAD card(Work authorization). Now I'm applying for naturalization. During that year, I only worked for one LLC company. I received 1099 (as tax form) from that LLC and filed and paid my taxes.  For that specific year and company, in the employment section, Should i enter the company's name that I worked for or "self employed" on form N400?

  16. Hi everyone, I apologize if these questions are asked or too much to answer and I posted some of them here but I think It would be helpful to let other people see and I want to make sure that I have no mistakes in my form so I am asking them here in one post.

Thank you in advance for answering. Much appreciated since I do not work with a lawyer because of the costs.

1 - I am submitting N400 online. I was told that I can save and continue until I complete everything. Do I pay the fee online with credit card?

2 - If I finish the online form, how can I let a lawyer(if I can find a cheap one) double check it? Do I have to share my login or is there a system for them to be able to see my application?

3 - I live in Atlanta but I'm moving to Florida. How long does it usually take to apply for a passport?

4 - In what format I should upload files when filing online?

5 - If anything is missing or wrong, would I get a notification to complete or would it be denied?

6 - I had 2-3 speeding tickets in last 3 years. Do I have to upload receipts to show I paid them? Or is there any other documentation other than email receipts (since I paid online) that I need to upload?

7 - I am in a legit marriage and I am not sure if we have to proof anything with our marriage in this form. Do we need to submit photos or anything like that to prove that marriage is not fake?

8 - Is traveling outside of US while N400 and I751 are both pending recommended?

9 - I am not working with lawyer because they are expensive and my case shouldn't be complicated. What happens if I make a mistake in the form and my N400 gets denied?

10 - I do not know the exact move in/out dates for some addresses I lived in 2015 and 2016. Can I guess the day and month? I really have no easy way of knowing exact day of the month I moved in with my roommates. It was during collage and some places were temporary but I always reported address changes to USCIS.

11 - After submitting the form N400, Can I complete bio-metrics and interview in another country? (I would have to be in Germany because of medical problems)

Thank you again for any help.
