  1. Thanks Hank,

      we are already done with the CFO yesterday, thank God and he is bound to leave on sat. He was also worrying that we should be paying for our green card fee before he leaves even if the atty. said that we can do it once he is here, i guess he wants to make sure nothing will stop him now. Lol. God has been good-

    2017- Approved for waiver and filed extension

    Nov 3, 2018- Interview at Manila Consulate  [denied visa due to Fraud & Misrepresentation]

    May 2019 - Applied for 601 with Expedited Waiver Processing

    June 2019- Approved for Expedited Process 

    August 1,2019- 601 Waiver Approved 

    Sept 2019 - Additional Documents via 221G

                          Medical/ Cenomar/ NBI

    Nov 15, 2019- 2nd interview- Visa Approved

    Dec 2,2019- Visa was issued 

    Dec 5, 2019 - Passport was delivered 

    Dec 12,2019- Exit Counseling CfO

    Dec 14, 2019 - Leaving for NYC! 🙏🏻 

       Thank You Lord- He has indeed done great things- without Him all of this is nothing.

     i just wanted to ask anyone who had an experience or info on departing from the Philippines with an IR1 visa. Does the US immigration ask for your Marriage Registration at the airport upon departure? We did not register , as per many complications on applying and also we were advised that we did not need to do so after our visa and counseling approvals. But the lady whom my husband spoke to at the exit counseling told him that they look for that. Just wanted to know if its true.thank you

  3. Hi Hank,

     No , none of them were all reported-  i was just doing the report for this CFO’s counseling sake.. lol and then they told me to attach all these other docs of the divorce registration along with my application for this current marriage registration. 

     I just actually read another post of someone having the same dilemna- and it worked by just having all the other docs at hand and he got his- hopefully my hubby will have the same. 

     Its been a long journey for this ordeal on our part- but God has been good. I will update as soon were done - im a bit relieved now. Thanks so much.

     I have a question for this CFO procedure requirement, not sure if this is the right forum, my husband is about to make an appointment soon, but we have not registered our marriage in the Philippines bec we were married here in NY and the embassy did not ask for it during the whole processing of his paperworks. He already got approved of his visa last wk and now waiting for delivery. I went to the embassy here to do so, but now they are asking me to annotate the divorce I had from my previous marriage 10 yrs ago - first in the Philippines (my first husband is also filipino but we were also married & divorced here) before i can complete my registration. I was dreading this procedure because of the cost, time and all that extra steps in the Philippine court system—- and take note we were’nt even registered back home on that marriage —- anyways. The only thing that shows the marriage part will be on my certificate which they are requiring to have the number of marriages on the bottom. I am kinda lost here—- and of course my American lawyer doesnt know anything beyond this as well—- any suggestions? Or info would be greatly appreciated- i just want my hubby back soon.

  5. Yes we got our waiver approved after being approved for an expedited processing- it took them 2 months after our request. Then soon after 7 days got our 212g letter asking for additional documents - with the passport- new medical and nbi clearance. Now it has been almost a month after submitting all documents- we are still waiting for our visa passport to return by mail. Hopefully, soon we will be able to receive it.

    This means she could've applied for a 601A waiver for he overstay here in the US, even if it was approved when she went home to do her interview the consulate still found her guilty of misrepresentation on her time of arrival to the US prior her overstay -meaning she needs another 601 waiver to cover that as well. Then they can process her visa after.

    So we to add an update, we already worked on our 601 waiver this year January, finished the report for our hardship in February- submitted to lawyer in March, finished the whole paperwork in May. Took awhile, due to some necessary documents needed to give proof of requesting expedited processing upon submission. I got letters from my son's school who has Autism and is being greatly affected by his fathers absence, and also a medical documentation from my Psychiatrist of my Severe Depression and Anxiety due to the circumstances we have been in for the past few months. This week my lawyer sent the paperwork through USPS, and I'm awaiting for their receipt of delivery-probably won't happen till next week, because of Memorial Holidays. I am requesting for an expedited processing due to our medical necessities, and praying for a miracle. You only get 15 days to be noticed and approved. Our faith will see us through. 

  8. I am a US citizen and my husband had a C1D Visa since we were married 6 yrs ago. We have started our visa journey , in 2014 and was approved from the I 130 petition to the 601A waiver since then. We received our interview date last year, after a month of waiting, and went back home Sept. 2018 - for his interview at the Manila Consulate on October 3, 2018. He was denied right after the interview, stating that he was inadmissible due to fraud/ or by willful misrepresentation. We thought our waiver would've covered the cause of the situation , but sadly did not. He came in the US, with a valid transit visa, only to find out that there were no ship in Florida for them to aboard at. And so with life being hard back home, and the debt he had to pay the agency back- he decided to overstay and work. Now I came back here in New York with my daughter, very emotionally stressed and financially burdened with what was left for me to overcome without him. My lawyer in California, had contacted the Manila consulate and Washington to reconsider the case, stating that we have something to fight for, esp. we were all citizens -and I also have a first born son who is Autistic and needs a consistent person in his life. The last resort now that was done- was submitting an inquiry through LegalNet, which they have already sent receipt of email and replied that they are looking into the case closely. At the same time, we are already working on our 601 waiver - that the consulate had advised him to get - in order to get another consideration for interview, etc. (Which we are dreading because of the time to process esp. during this year) I just want to ask kindly, if anybody had any experience or knowledge with this kind of case that we have and any hopeful insight will be appreciated. Thank you
