Hello everyone!
Hope I can get an answer to my query.
My wife is about to apply for her US Certificate of Naturalisation through marriage to me, an American Citizen. My questions below are in regards to our 13 year old son, (who's her biological child, my stepson).
1. Once she obtains her Certificate of naturalisation, is he automatically a US Citizen? can she apply for our son's US passport right after?
2. Or should we apply for his Certificate of citizenship N-600, followed by his passport after she recieves her naturalisation cert?
Thanks in advance!

Hi All
See below the timeline for my wife and a couple of important factors I found out regarding the i-864.
Jan 28, 2019: mailed i-130 along with required photocopied documents to USCIS london office.
Feb 4,2019: received email notice of receipt Feb 1st.
Feb 5,2019: applied for ACRO, received ACRO 10 days after.
April 21,2019: received letter petition case being sent to USCIS london NVC.
April 26,2019: received letter petition has been approved for IV processing along with link to complete DS-260 online.
April 26,2019: booked medical and visa interview appointment after DS-260 completion online.
April 29,2019: completed medical and paid fee.
May 5,2019: attend IV interview submit required documents along with i-864 form and most recent tax return transcript filed as an expat overseas (please note: tax return statements are not required ONLY your most recent transcript, to be on the safe side also bring along the previous 2 years transcripts as well. To obtain these register on IRS.gov site and download in pdf format. if your income meets the required threshold you don't need a co-sponsor to prove domicile in the states your most recent tax return transcript is enough proof and that you intend re-establish residency in the states upon your spouse IV approval.
May 13,2019: received Passport with visa and IV packet

Hi TXfamilyUK
I've submitted the I-130s for my wife and stepson received notice of receipt ( stupid of me did not know at the time of submission you should submit separate I-130s, luckily I did after being informed here by one of the member thank☺️!) from what you mentioned you could use your in-laws as a co sponsor because of the property they own, that would be more than suffice. also it wouldn't hurt if your wife was here for the interview. will definitely keep you up to date on our progress!

I just spoke to my wife to be certain if his parental rights was terminated and unfortunately it wasn't.. Is there any way around this or she must to get a court order that it's terminated for my stepson to accompany us?
-
So that's a definite my spouse must show evidence of a court order that his parental rights is terminated for my stepson to accompany us to the states?

His biological father has never been in his life and is no where to be found.. I'm the only dad he knows since he was 2 years old
-
Great, is the DCF process time in london the same as my wife petition? because he's just 11 years old.
-
No I didn't submit a separate i-130 stepson because I thought he could accompany my wife on hers, if not do need to submit a separate one?

Thanks for the answer Paul and Mary...
NikLR, I filed the I-130 for my wife and stepson, with my spouse being the principal beneficiary

Hi all
Please disregard my previous post on March 14th, as I mentioned in prior post i'm a lil clueless😅 about the whole immigration process. you guys have really helped me to have a better insight how it all works and I got to say thanks, I appreciate it a lot!
I'm about to be the I-864 preparer for the co-sponsor of my petition for my spouse and stepson, I have a couple questions hopefully you all can help me out again☺️. my co-sponsor filed his last 3 years tax returns jointly with his spouse, can i complete the I-864 on his behalf without including any information about his spouse? because his income alone meets the required I-864 threshold for filing as a sponsor.
also in part 6 number 24a-24c, should I populate these boxes with the total gross combined income as stated on the 1040 tax returns of both or only his income?

Hi all
I will be using a joint sponsor in the USA who's income is above the required threshold for my spouse and stepson who's 11 years old along with my last 3 years filed tax returns. The I-864s along with 3 years tax return transcripts should I make 4 sets of copies or just 2?
Option A: ( 2 sets of copies) 1 of myself and 1 of co-sponsor for my spouse, (2 sets of copies) 1 of myself and 1 of my co-sponsor for my stepson?
or Option B (2 sets of copies) 1 of myself and 1 of my co-sponsor for my spouse and stepson?

Hi, all
I was wondering since I have over $20,000 in my US bank account to show US domicile if that would be sufficient along with my 3 year tax returns transcripts for my spouse and stepson?

Hi again all!
I've filed my past 3 years tax returns to qualify for submitting the I-864 as the petitioner and also I will be using a co-sponsor in the US. my question is, for my co-sponsor is it suffice to submit only their last tax return filed or the past 3 years?
-
ok, thanks a whole lot guys for the help😀 really appreciate it
-
Sorry for my constant questions I'm new to the whole immigration process lol, will I need a joint sponsor if I can't submit evidence of income continuation once I move?
-
Hi Boiler, thanks for response.
what evidence I'll need to submit as well for proof of this? that I'm actively seeking a job or job offers? because my present employers I won't be working for them once I move back o the states
-
Great Geowrian! thanks for your help. I will get on that straight away, file my tax returns for the past 3 years. my annual salary in the UK is $49000 before taxes would that be suffice?

Hi
I presently reside in the UK with my wife and 2 kids, age 11 my stepson and age 7 my daughter who's a dual citizen UK/US passports. I recently about a couple of days ago submitted the spouse petition I-130 at the London office. my questions are, once the application is approved. option 1, should I submit as a sponsor I-864 with my P45/P60 as tax returns along with proof showing domicile in US by having a valid NY state drivers license, health insurance benefit card and documents, utility bills in my name at my mom's address we'll be staying until we are achieve employment and lease a place of our own, voter's registration in NY, plus letters from my mother and the property lease holder my brother showing willingness to provide room and board for us? or option 2, file my tax returns in US for the years I've been overseas and use proof to sponsor my wife and my stepson? or option 3, use a joint sponsor (a family member or friend) along with either option 1 or 2? 😀😀
Spouse about to petition for US citizenship
in US Citizenship General Discussion
Posted
Hi everyone,
My British spouse is about to petition for her US Citizenship within the next coming days. my questions are our about 14 y.o. son (not my biological child).
When she submit the N-400 along with the required documents and once she becomes a naturalized US citizen, can we apply for his US passport straight away without submitting the application N-600?
or it's mandatory and we must file the N-600 along with her N-400 for our son to obtain a US passport?
Also, can the petition process be completed online via the USCIS website by creating an account or it has to be done by post to the lockbox facility address provided?
Any advise would be appreciated!
