  1. Hello! I was just wondering if anyone here has a similar situation as mine. So I filed an I-751 with divorce waiver last December 2017 and I was scheduled for an interview last June 23, 2019 Los angeles office. The interview went well and no further evidence was asked from me during interview. However after the interview, the officer did not come up with the decision right away. Instead I was given a piece of white paper (Will attached a sample picture of it) stating that my case is being held for review. Have you heard a similar outcome as mine?

     

    What could be the possible reason of continuance of my case? Is it normal? And how long should I wait for them to make a final decision?

    The officer may not have had authority to adjudicate right away and needed approval from a higher tier officer after reviewing the documents and interview record. The delay is probably due to bureaucracy more than some actual problem with your application, in my personal opinion.

    To answer your question, yes you can go and wait in Australia, just be ready to deal with whatever adverse consequences that come with it. Like I pointed out, removing conditions via divorce waiver already comes with heightened scrutiny and its own can of worms.

  5. If ever I get renewed I will go ahead and will file a naturalization (if given the chance). As far as I know, a person can get multiple citizenship. 

    I am not planning to abandon my residency in USA, it is just I needed to be in Australia to meet the Australia's immigration asked me to do. You see my case here is still pending so my question is if I can maybe just wait while in Australia then just come back if they will ask me for an interview?

     

     

  6. Hello! I am divorce waiver and with pending I-751. My case has been transferred to my local office which is the processing time would be somewhere between 23 months to 45 months. I filed December 2017 and my 18 months extension will be expiring this June 2019. I am scheduling myself tomorrow for an infopass to get my status extended. I have to be in Australia and live there for a while to meet their immigration conditions as well. Immigration of Australia wants me to be in Australia for 6 mos so I can get my residency to them as well.

    My current status is my case was transferred from Nebraska to National benefit Center (expecting for an interview) last April 10th since then there is no updates. So my questions are:

    1. If I get my passport stamp that shows my status in USA would I be able to reside outside the US then just come back once I am scheduled for an interview or anything that USCIS requires me to be physically present in the US? I heard that it would critical for those who has issues for instance for those who has pending  criminal or felony case (which i dont have) to come back but for those who doesnt it would be easier.

    2. Can I update again my address again to a different US address? (I am currently in Nevada and would update my address to California so my family could receive the mail from USCIS)

    PS. I will ask a lawyer as well but would like to get your opinion to this and for those who has done this already.

    Yes I have received the notice in my mail box. No it did say anything about interview. It only just said about “standard process” and if they need something they will notify me. I did not file N400 yet. So the transfer to NBC from Nebraska is something not what I am expecting because They transferred me to Nebraska on Jan 10, 2019 where they updated my name and DOB (Believing it was a good sign base on the experience of everybody here) but here I am I got the transfer again. 😂😂😂

  8. My case was transferred from local office - Nebraska- NBC

     

    So I THINK they might send me for an interview as well. This is different from what I expected because I was expecting for an approval since they transferred me from nevada local office to Nebraska ( where they updated My DOB and name - and most people here who got this UPDATES usually receives approval notice 😪😭) and then on april 10 to NBC.

     

    I wonder how long do I have to wait if they will schedule me for an interview?

    My 18 mos extenstion is expiring on June and yes I am a WAIVER filer.

    Hello! Thank you for reaponding. I will do it tonight. I am just paranoid that they might transfer back my case again to the local office near me.

    btw, if I am going to apply for N-400 should I select the local office near me or should I apply in Nebraska since my i-751 was transferred there.

    Hello! Thank you for the encouragement. I am still waiting for their updates. It remains the same till today Since they updated my DOB and Name last March 13, 2019. I am praying and hoping for the approval soon.

     

    Do you think it will be okay if I start my application for N-400 or just wait for my approval first?

     

    btw, my case was transferred as well to Nebraska last January 17, 2019. Then followed by the DOB and Name update on March 13, 2019.

     

    gees. I hope they make decision pretty soon since it is frustating to wait everyday for their updates.

    You can also just file a divorce waiver but explain in the application that your divorce is pending and you will update them once you receive a final decree. Your waiver application will not be adjudicated until they receive the final decree. However, since the waiting period now is at least a year or so, you should be able to obtain your decree and file it with USCIS during the period and it should not cause any significant delay on the process.

    As to the letter, I did not follow any sample letter. I basically started with a paragraph expressing my intention to switch to a divorce waiver. Then I started talking about how we met, what we were doing at the time, and what happened in the marriage that leads to a divorce. I ended with a paragraph expressing what I currently do (at the time of filing) and what my goal is for the future. I also emphasized that I have been in the US for almost ten years, always in good status (F1 before marriage) and have no intention to obtain a green card by fraud.

    Thank you for the insights! I will definitely update them with my divorce, because in a long run, I think you are right, they will be asking for it when I do my citizenship. I will be truthful to them 100%.

    If I were you, I would update USCIS with the divorce decree and ask to switch to a waiver. You don't have to do that but they do REF if they know you are divorced. Even if you get the 10-year green card without interview or REF, when you apply for citizenship, they might ask why you did not inform USCIS about the divorce when your I-751 is pending.

    Hello! Thank for the help! And one more thing, my paper is a waiver to begin with although I only sent them a copy of proof that my divorce is currently in pending (California is more than 6 mos), and do I need to put an explanation letter along with it why my marriage ended? And do I just need to mail all of these in the Nebraska address they provided in my NOA

  13. Hello! I applied for I-751 with waiver even though My divorce was still pending. Last year I got my final decree of divorce do I need to send them a copy of it or just wait for them to ask for it? My latest update is my case was transferred to Nebraska. And also, I am planning to move to a different address do you think I should wait first for my immigration to be setteled before moving out or is it okay just to notify them of change of address. I am moving on 02/14. Thank you! And congrats sayo.
