Different reasons. things are not working out for me here, the only reason I came here it was to be with the person I was in loved with, obviously it didn't go as I expected it, I decided to stay anyway because I was to scared to go back home and I felt like I had a life here, I got a nice job, car, aplace to stay but my EAD expired and I lost pretty much everything.

    I got a new EAD and I started working to get everything back, I got a job in the "Happiest place on earth" and I met someone very special, he is form a different country and he's going there to finish his masters and I decided to go there with him and give it a shot. I have nothing left here and i think it is well worth it.

  2. I'm happy we have this new forum now!!! yay!!! Question: A very special friend of mine is here on an H-2b visa, he is working in Panama City, FL. and the conditions of the place where he is staying are not the best, 4 people in one room sleeping in bunk beds, there is no transportaion from and to work, the nearest store is 50 miles away, he doesn't have a car to go and do groceries, among other problems.

    My question here is he wants to come to Orlando asap and change employers before he ends his contract with the other company and his visa expires, I know for sure this is possible. I just don't know how to do it. Any ideas??? Thanks a lot for your help!!!

  3. My case was touched on the 21st. I wonder what that means. I hope it's an approval. but at this point, an RFE would even be welcome. I just need to know that my file is not floating somewhere in limbo.

    Lostnnj, do you know how to log in to CRIS to check your case? I just found out that I have been checking my status at the wrong place! i have been going to the USCISdotgov website instead of going to CRIS!

    WHAT?? I always check mine at USCIS.gov....... So i've been wasting my time??? what is the difference??? thanks

  4. Yes, I would think expression a strong desire to go home while a VAWA petition is being decided would not be in the applicant's best interests.
    i file i360 back in november 08 and VSC sent me RFE good moral character in december i got my prima facie in january for 180 days , idid alot of search about vawa and read some tips

    her and thier its sems its take along time to approve (up to 14 mounth) and it possible they sent me another prima facie extnded but i relly in rush and i have to go home and im tired of watting i did try to expedite due to my divorice and custdy issu i sent aletter back in february and i havent got any thing from them i was just wendring any body have any idea about process time for vawa or any thing i could do i want to write alrtter to the congresman but my lawyer told me its not going to helpe , imean its not faer after you wait for i130 to approved , crazy wife withdrew the i130 and have to wait anther year for i360 :angry: any body out thier have the expirens befor

    Hi,I`m so sorry about what you going through.my thoughts to you is to be as patient as you can,because if you rush the USCIS,you might have a bad luck and not even get it.I want to go home too so bad but i`m so patient.so take it easy

    Be Patient, I've been waiting for 14 months and 3 weeks, my case is still pending, I'm out of the processing time and it's still pending, you have to be patient, VAWA take a while before u get a decision, writing to your congressman at this point does not make sense since you are within processing time, that won't help. Just be patient, there's people that waited 4 years to be approved. Hang in there, your VAWA journey will one day end.

    True that Guyana,if you become impatient you making things worse.I`m as patient as possible and sometimes its annoying.

    That's very true, it is hard but you need to be patient when dealing with immigration. One more day without news from USCIS is one more day that you get to stay in this country. Hang in there. We are all going through the same.

Thank you hanah and carla-justin for your responds, in this case I should immediately file I-485 also, I asked my lawyer to file it but she asked for $700 in order to file it, I think I can file it by myself. Would you guys also tell me which service center should I file it to and how can I apply for a fee waiver?

    As far as I know Vermont is the center dealing with this type of cases, and about the fee waiver, i really don't know. My attorney sent a letter explaining why I couldn't afford it and he made me save all my receipts from gas stations, groceries, medical and other expenses, rent, phone, etc... Good Luck and don't wait too long to do it, start saving everysingle receipt!!! and keep doint it for a while, you never know!!

  6. Sorry to read of this woman's situation.

    The husband is trying to manipulate her by saying don't come back. It is easier for him if she is 5000+ miles away.

    I would suggest she goes where she has a place to stay and opportunity to make money. I think she could get a police escort to retrieve her belongings from their home, but others know more about that.

    Finally, I don't think she needs an attorney - if she has you to investigate the specific questions.

    True. I had the police to come and help me to get my stuff out the house I shared with my husband, and I got a police report about this incident that was used later on as evidence for immigration. Police officers witnessed I was taking nothing but my clothes, that way he could not acuse me later on of stealing

    FYI I sent my I-765 back on November and it was never touched, no updates, nothing. I called the service center and no one knew anything and I was passed the date they were supposed to be working on.

    Suddently one day I got home after having a crappy day at work, and there it was my EAC wating at the mailbox for me. So don't worry they are not very efficient on updating the system. I know it is frustrating, because you have no contron over this kind of things. I won't even ask you to relax or to don't think of it, just remember you are not the only one and we are hundreds if not thousands of people going through the same.... and if something goes wrong we still be here, to find a way to fix it. :D

    Is it me and only me? When I first started with visa journey, which wasnt such a long time ago, I would start a new topic w/ a question and I would get a billion of answers right away! and I'm not lying. I would post something new and in less than a minute i would get atleast 5 answers. Lately I post a question and I barely get a response. Maybe just one and sometimes just plain none. Is this normal? Am I being ignored or is the system not letting other people see my questions? Is anyone else going through this? (I know this may be a dumb post but couldn’t help making it lol)

    Back in Feb 2007, the VJ Board of Directors created and populated a "VJ Welcoming Commitee" (VWC) who's responsibility it was to troll around looking for questions posted by New Members. The reason for this was so that New Members would feel welcome, supported, relevant, and in some cases important because they posted a question that so many people responded to. Not surprisingly, it worked. The benefit to this for VJ was people kept returning to VJ over and over again, long after their immediate need (VISA support) had passed. This allowed VJ to accumulate more Internet Posting Points (IPP) which could be translated into cold, hard, cash through the WWW Helper Incentive Plan and Interchange Policy (WHIPIT) and helped support the VWC.

    With the economic downturn in the US, it has simply become too cost inefficient for this to continue. The income realized through WHIPIT no longer covered the expenses incurred by the welcoming comittee. As a result, in Aug 2008 the VJ BOD voted to suspend the VWC over time by having them no longer respond to members from particular countries, based on Geographic density of population. Nicaragua, as the least densely populated country in Central America (ref: http://en.wikipedia.org/wiki/Nicaragua) was first with a scheduled drop date of Jan 1 2009.

    If you started noticing that people weren't responding to your posts after Jan 1, I suspect this is the reason why. They simply couldn't afford to any longer.

    If the abused alien is married to a US citizen, then concurrent filing of an I-360 and I-485 is permitted. I suspect that he chose to refile because your pending I-485 was denied. It shouldn't cause any further delays, in fact, I suspect it might speed up the process.

    That being said, your attorney is working for you. If you have any questions or concerns, this is what you have an attorney for. Ask him/her to explain each step he takes for you, so you can know where you are in the process.

    I got a prima facia for both of them and 2 different case numbers. :unsure:

    A prima facie is not an approval, it simply indicates that you appear eligible for relief. From your timeline it seems that the first I-485 (marriage-based) was denied, so once an approval would be made on the I-360 you would then have the opportunity to submit forms to adjust status at that point.

    I agree, my attorney send the first i-360 by itself back on March and then he submitted a brand new i-360,i-485,i-765 on August.

    I have no idea of why he sent a new one and how is that going to affect the process.

    I don`t know about I-360 but if you send in 2 I-130s it will result in deniel of both. I suggest you to double check that.

    Hope it works fine for ya. That information about I-130 was given to me by USCIS representatives (I think I asked 3 of them the same question) and they happen to be wrong sometimes. I didn`t want to scare you or anything. It is just with USCIS it is better to triple check sometimes not to get into difficult situation.

    I know, it's better to make sure.

    I called USCIS today and they told me that the second application will cancel the first one, then I ask if I could cancel the last one so I don't have to wait 5 extra months for my application to be processed, they said I could go ahead and do it but that would cancell both and I would have to send all over again.

    My attorney won't return my calls or emails, I have no idea why he sent 2 I-360. When I signed the second one I asked why he was making me sign a second one if we sent one already a few months ago, and he said it was just to keep it in file. It wasn't until I got a NOA1 when I found out he resent it.
