  1. Does anyone have experience of when the citizen applying for their spouse to get their green card dies during the process? what happens at that point? We have an older friend that was married for years to a citizen and was going through the process to get his green card. Their first application the I-130 was approved. Before they could start on the waiver I-601A, she passed away, she was ill. All  we know now is that the I-130 application automatically changes to a widowers application. He has been having a hard time finding a lawyer in Texas, where he lives, to help guide him and give him true and accurate information. One lawyer told him all he needed to do was file the I-485 to adjust status because now is wife is deceased he does not need to do the I601A waiver. The lawyer filed that a few years ago, but they are asking for some stuff he cannot provide because he did not enter legally. Now he has gone to another Lawyer he I feel is dragging him around. it took him a year to check on this mans case before telling him that he needs to file  the waiver I601A. But couldn't answer any questions this man had. He wanted to know how he could file this waiver when his wife is no longer here. how does he show proof of hard ship? 

     

    anyone have experience in this?

    From my experience, that will not change until your application is approved. that's what they are waiting on, the approval. Once the approval is put in the system, this status will change to "at NVC"

    when you sent your email, did you attach documents or what it just an email saying you have surgery on whatever date and need to be back in the states for that? Just trying to understand more about the expedite process and how the approve or deny them. From what I understand you request it through email right?

    This is our timeline so far:

    I-130 received 6-14-2017

    I-130 approved 1-3-2018

    I-130 sent to Dept. of State 1-4-2018

     

    AOS fee paid 2-8-2018

    IV app fee paid 2-8-2018

    DS-260 app sent 2-8-2018

     

    I-601A waiver received 3-13-2018

    Fingerprints fee received 3-13-2018

    NVC sent checklist letter confirming they have all required documentation 6-12-2018

    I-601A waiver approved 10-15-2018

     

    1-10-2018 NVC confirms they have all documents, just waiting for the consulate to give interview date.

     

    I am not sure where we stand at the moment other than NVC confirmed they have everything just waiting for an interview to be scheduled. But not sure how long that takes, how much more waiting we have on our future lol

  6. Hi all,

     

    new to this website. I just came across this website while trying to google info about this whole process. My husband and I got the approval notice for our I-601A waiver and that our case was sent to NVC to get an interview date at the consulate in Mexico. Tomorrow, 1.15.2019 will reach 3 months since the waiver was approved. How much longer do we need to wait to get our interview date in Juarez?
