  1. Not totally sure where to post this (feel free to move to the appropriate forum) but I am trying to find some information on a few things and I figure maybe you guys would know!

    - What does a baby born to an American/Canadian couple living in the States have to have in order to cross the border into Canada? I'm assuming an American passport. If so then how does one go about applying for one for a baby, and about how long does it take, and how much does it cost?

    - What should happen if the baby is born on Canadian soil? (Haha no, we're not planning on that, but just curious... since I suppose it could happen!) Would he/she be a dual citizen? What paperwork would have to be done? How would we get the baby back into the U.S.?

    Thanks!

  2. When we send in our marriage certificate, is it fine to send a black& white (or color) photocopy of the certified document, or do we need to send in the actual certified copy we received from the state?

My understanding is that it is okay, but we also preferred to send an original, just in case. It only cost $10 and we got two copies - one for ourselves and one for the I-485. We sent photocopies of everything else though (passport, visa, I-94, birth certificate...)

  3. Today I got my permanent resident card which is valid for 2 years. But I never had to go to an interview (just fingerprints and pictures were taken some months ago). Can I travel with this card outside the US and reenter again?!?

    Thanks

YES!!! You can use it for travel and work. We were also approved without an interview. And yes it is your green card!!! Now you can take a break for a little under 2 years!! :) Then you will have to remove conditions...

  4. my original forms showing we had medicals in the uk are over 1 year old and im gonna need to get myself and children new medicals yes?? and i need to send in the form to say i have had them with my AOS when i send it in?

    would this be right??

ive gone and got myself all confused!!!!

and it has to be dont (the medical) by a uscus civil surgeon?

Since they are all over a year old, yes, you'll have to get them done again by a Civil Surgeon qualified by USCIS. Check out the top sticky topic on this board; it gives a lot of info about medicals.

The civil surgeon should give you sealed envelopes with the medicals, and yes, you'll have to send them with your AOS applications.

    Hope this helps :)

  5. before we sent our AOS package we called to USCIS and asked if I need to get my medical as I came with K-1, and they have a copy of my medical already... but they told me that medical exam is usually valid for 3 months only and i need to get a new one and send it with AOS package... we paid $250 and got a new sealed enevelope ... :( So hopefully we will not get RFE... :)

What they told you isn't true. The medical is valid for one year if you apply for AOS within one year of having completed your medical. Not sure where they got the "usually only good for 3 months" figure from... maybe you spoke with a newbie.

If you sent a whole new medical anyway it is unlikely you will get an RFE unless they find something amiss with your medical somehow (which would either only happen if it wasn't filled out properly by your doctor, or if you had a health problem that they want to question), or if they find something else missing in your case. So don't worry! You won't get an RFE for getting a whole new medical done and sending it with your case!!

  6. Congratulations!!

Don't forget to schedule a visit with the SSA to have your SS card replaced with one that does not have the "Work with DHS Authorization only" restriction on it.

Thanks for the reminder... I need to get my last name fixed on the card, too, because when I first got it they would only give it to me in my maiden name for some reason!!!

We were actually going to go today but I was too tired to want to wait around at the social security office... lol :)

    Thanks everyone!

  7. Well, first you find out who your representative is, by going here: http://www.house.gov/. You need to know your ZIP 5+4. (look it up here: http://zip4.usps.com/zip4/welcome.jsp)

Once you know the name, it also gives you the congress person's site. From here, the choice is yours. I simply wrote him an e-mail explaining the full situation, with arguments etc and ask for his help in solving the issue.

The letter was "signed" by my husband, the USC.

In about 2 -3 days we got the answer in an e-mail, where the name and contact details of the immigration person in the congressman's office. We then called and talked directly. No visit to the office was necessary, since she was able to help up by phone.

I also hope that at least one person who got and answered a RFE can answer me whether they sent back the original or the copy of the notice of action...

Sorry to hear you got this RFE. It's frustrating. $60 is not too bad, although I still think it would be better not to have to do the medical again at all when you're not supposed to have to... but anyway, that is definitely much better than another $200-300!!!

We sent the blue copy of the RFE notice that they say to send with the RFE with what we sent as our RFE.

I think that the little blurb about a copy of the sheet is if you write to them inquiring about the case, and not for the actual RFE. I would not send a (photo)copy of the notice with your actual RFE. Send the original blue notice.

Also, something else I wish we would have done - made sure that it was clear on the envelope that this was a response to an RFE. Since we sent medical papers in, we ended up not using the envelope they gave us because it was too small - but the envelope has the big bold red letters and also say "ATTN: Response to RFE" or something like that. We totally forgot about that so we figured maybe my papers got mixed in with all the other mail and was not seen as a priority. I'm not sure if not doing that is what delayed our case for a few weeks, but it did made me think they might take the mail a little more seriously (had we done that.)

Thanks, Melyssa, I wrote RFE with big letters and underlined it... I hope I will see pretty soon the approval. You be glad it's finally over for you! All the best, Bianca.

    :) We are! ;)

Hope you get your approval soon...

  8. when they say "a copy of your passport", do they really mean a copy of every inch of your passport? I only sent the interesting bits from my passport - bio page, visa page + the stamp on the oposing page, I-94 page - not every single page in the passport. I did the same for the K1 and they didn't mind.

i can't imagine they really want to see every page, even blank ones.

All we sent for the photocopies of my passport were:

    - Main page of passport with my passport number, picture, etc.

    - Visa

    - I-94, front and back

Can't remember how many copies... but there were a few because there were the 3 forms. (For EAD, AP and AOS)

If I had two passports I would probably send copies of the main pages of both, and maybe attach a short note explaining why.

I would not bother copying every single page... I agree, I don't think they care to see every single page. ;)

  9. And another (minor) concern is: the sealed envelope given by the doctor will not fit in the envelope sent by uscis as a return envelope. I am planning on using a big envelope, and include inside the envelope provided by them... to see that I did not loose it :D

Oops - I missed your last paragraph!!

We used a big envelope as well and I don't think they will be too concerned about you losing or not using the envelope they provided. lol. :) I sort of wish we just glued/taped their envelope to the outside of our big one, if we hadn't completely forgotten about it when we went to the post office. ;) We thought we forgot it at home but as soon as we got back in the car after our little trip to the post office, there it was on the floor in the back! hehe

  13. Hi to everyone...

    I need some help...

We are working in my AOS's forms and I'm confused about what name I should submit in the forms... I want change my first name (because is too long) and used my husband's last name...

I called to USCIS and they said I should submit all AOS forms with my new name, but... the answer include my new first name too?? I'm not sure about my first name...

    Somebody in same situation??

    Any advice??

Should I submit AOS forms with my new first and last name?

    Or

Just change my last name and keep my old first name and submit AOS form in this way and after get my GC change my first name?

    Thanks!!!

    Lu

I don't think you can change your first name with AOS. That would probably cause confusion for USCIS (which would not be good for you!) but if you want to take your husband's last name for yours instead of your maiden name, then you should file: your first name + your new last name. Your marriage certificate will prove the name change.

  14. I just called Dr Arnold. The lady wanted me to send copy of documents. On form DS 3025, i only have 2 vaccination MMR and TD. and Varicell was dont by after gettign visa as per doctor suggestion. So i have 3 vaccination record( MMR, TD and Varicell) on vaccination card? So can i send copy of the vaccination card which have all 3 vaccinations?

And on the supp. form i should include my name as in card or should i inlude married name?

I also have Hepatits B, vaccination documents which i have done beofre my K1, the doctors said it is not necessay at time of K1, so i didnt submit by that time. Should i send to Dr Arnold now??

I'm not sure about the answers to this, maybe you should post in the main AOS forum so more people will check it...
