  1. My wife was in the US with student VISA since  March 2016. Then we got married in 2017 and went back to China for wedding in Feb 2018 and not knowing that once left the US her student visa auto expires. Upon return, my wife was put into detention center for no VISA in Feb. 2018.

     

    Question: 

    1) Does she need a police certification from the US?  I read from the NVC site below that US police certificates is not needed, so my wife doesn't need to get US police certification?

    2) My wife got a police certification back in January 2018, the interview is likely be in April or March. would the January certification suffice?

    I submitted for a K3 for my wife as well, I was naive at the time and thought it was viable (hadn't spent enough time on VJ yet). USCIS closed the i129f/K3 almost a full month before they approved the i130/CR1 petition, which shows that they don't even give a rip about the K3's anymore, even if they do get to it before the other. In the end it's so much better though, so much less hassle and money with the CR1/IR1.

     

    Any attorney who suggests a K3 is immensely incompetent and he/she is not staying abreast of the latest trends (they're more than 8 years behind). I would strongly consider a different attorney (or, if your case isn't special, you can go it alone and save the money.. many of us have done it).

    Thanks for sharing your case, it is good to know i129 doesn’t work. 

    My wife had a visa issue, leaving country without EAD. where after return, she was put in a detention center for a week. so I got panic and found an attorney. In retrospect, the attorney asked for money right away, and then became non responsive and at time rude/unprofessional to emails requests. Now she doesn’t respond anymore. So ya.. been a fun ride.

  3. Thanks for Everyone’s response and help, wish I had found this site sooner. just called the NVC last night and i130 has been received last month. Apparently, I been focus on i129 so much that I did not check i130, you guys reminded me to do so.

     

    With i130 in NVC, it should take 1 months until case is created? Hopefully, the government shutdown would not impact the progress, Fingers crossed

    I assume the attorney has briefed you on all the documents you need for the next stage and you are all set? USCIS sets the speed of the I-130 approval, the NVC is very much in your hands. Those with their documents all ready to go before the petition even reaches the NVC can get through it in a matter of weeks.

    the attorney is very passive on the communication piece, I am not happiest client for sure.I am taking things into my own hands

  5. I filled a I-130 in Dec 2017,  and i129F (K3)  in  March 2018 after immigration attorney advised so. The application is now being sent to NVC for processing. After looking at the timeline posted on this site, I see a big difference between K1 and CR1 process time at NVC and embassy, K1 2-3 month total, while CR1 is 5-6 months.  Does anyone know how does NVC process K3? is K3 treated more like CR1 or K1 process time wise?
