  1. I need some help in figuring out the continuous residence requirement for a PR card holder. Now my mom is Permanent Resident for 3 years and plans to apply for her citizenship. She didnt knew about the 6 month continous residence requirement and in the past 3 years has been out of the country once for 8 months. Now I know about the http://www.visajourney.com/forums/index.php?showtopic=89841 thread where it mentions about tax return, car loans being shown as a proof of residence. She dosent have these documents. My dad/mom has a joint bank account in the US. They stay with me so they dont have a mortgage/rental documents. What other documents can be shown for the continous residency for absenses more than 6 months but less than a year ?

    Any help is appreciated.

  2. just an update. I went to the durham uscis office to hand deliver the I693. I was taken to the same hall where we had our AOS interview. After waiting for sometime, a lady took us in and opened the sealed medical envelope. She asked us a couple of questions and said that she was approving the conditional Green Card and we should expect it in 3 to 4 weeks in mail. After all it was wise to hand deliver the medical report :) saved us a good 2 weeks in mail.

  3. My wife also didnt have a TB skin test during the medical for K3 visa. I didnt get RFE for I485 but during the AOS interview the adjudicating officer said that we would need a new I693 submitted; for uscis to approve the Green Card. The vaccination supplement (I693A) was okay so we didnt retake any vaccinations but we had to retake all the blood tests and TB skin test (costs us $225 here in NC).

    I recently came across this post..... I am wondering if anyone can shed some light on it.

    Another reason for a medical RFE.... you are required to have a TB skin test, not just the X-RAY test done in other countries. We got an RFE because of this, so make sure to send the results of a skin TB test if you have not done so already.

    My husband never had a tb test or blood test at his medical examination. We are ready to adjust staus, and are going to have Dr. Arnold in texas to complete the vaccination supplement.

    Should he go and have a tb test and blood work done? Or will the vaccinations that he received at his medical be enough?

  4. My husband got here in October of last year and we married. I applied at the end of January for HOH (head of household), and several weeks later he got his ssn. So i then amended my taxes and am now waiting for them to come back. You need to file for an extention, and then when he gets his ssn file your taxes then. Good Luck!

    Yea thats what we did. I filed for an extension (6 months) for federal and state return. We will wait for SSN and file as married jointly after that. Also in the publication http://www.irs.gov/pub/irs-pdf/p519.pdf it mentions that even though my spouse dosent pass the resident alien test (green card and residency), she can choose to be a resident for tax purposes. We have to attach a statement to that effect with the tax return.

    Also I am not sure how this will effect the stimulus payment we receive. I know that without SSN both spouses dont receive the payment, but am not sure if we receive the rebate; if one spouse is non-resident for the tax year.

  5. Hello, I have a query on my filing status for 2007 Tax return.

    Now last week I went to local IRS office and the agent told us that as my spouse is eligible to get a SSN I cannot apply for her ITIN ? Is this true ?

    I have read on the forums that I can file "Married filing jointly" with a W7 form (ITIN) for my spouse (on a K3 visa - already applied for aos).

    One another query is whether I can file the tax return with joint status with my spouse not being in USA for 2007 ( she arrived in Jan 2008 - we got married in 2007). According to this publication shes a non-resident alien -- http://www.irs.gov/pub/irs-pdf/p519.pdf

    Would appreciate any help.

  6. Hello, My spouse appeared for K3 Visa interview and got the visa stamped on the passport. She inquired about the medical report copy and they said that it will be included in the sealed envelope and asked her not to open it until asked at the POE. Now does the medical report get returned to us at the POE ? I was asking as we have to go through AOS here in states and require a medical report for that application also. Anybody have any ideas please reply ?

  7. Just wanted to let you guys know that my spouse got the K3 visa yesterday at Mumbai consulate :). It was pretty straighforward. She was just asked a couple of questions about me and our relationship like

    - who is petitioning you ?

    - what does your spouse do for a living ?

    - where did you go for honeymoon ?

    - what do you like in your spouse ?

    Thats it.. Interview lasted just a couple of minutes. They didnt look at any pictures/dates/other supporting documents. Wanted to thank visa journey and all of you guys.. It has been a great help..

  8. My wife just did this couple days ago. She didn't receive the packet 4 in mail even the embassy claims that it was sent on September 7. She went to the Delhi embassy to pick up the duplicate packet 4. Your wife doesn't need to go personally to pick up the packet. The person who goes to pick it up need to know the case number and their will be no problems.

    Guys, My spouse missed the packet 4 in mail; which the mumbai consulate sent us couple of weeks back. i did send them an email to send us a duplicate packet 4 and they replied that

    "You or someone on your behalf may come to the consulate’s information counter, on any work day, Monday thru Friday, between 09:00 and 11:30 a.m., and pick up a duplicate packet IV."

    Now has anybody done this before, have someone else pick up packet 4 on their behalf. Would the above email/BMB Case number be enough for the consulate to dispatch duplicate packet 4. I did send them an email again asking what would be required by somebody picking up packet 4 on my behalf... But no replies.. My spouse wont be able to personally pick up the packet 4. Any ideas ?

    Ok Thanks. I will give the case number to the person picking up the packet 4 on my behalf. Hopefully it wont be an issue.. Also in order to email mumbai consulate include "Request for Specific Information" in the subject of the email. Then only they will reply, otherwise they will send a preformatted autoreply.. Hope this helps.

    instructions and had a question on the secondary evidence required for establishing a bonafide marriage. Now the thing is we havent had a traditional religious wedding (Indian - hindu style). We had a court marriage and had a small family function after that. We had a pretty elaborate Engagement ceremony though (marriage and engagement ceremony -- all within a span of month). The thing is and this may sound strange to some but we didnt have any auspicious dates for marriage when I visited India last Janaury and also didnt have enough time to prepare for the wedding. So we decided not to have an Indian Style wedding and went with the court marriage. Should this be a cause of worry at the K3 interview ? We have loads of other evidence (phone calls, ecards, etc...), but was worried about the requirements for wedding photos. Any tips/suggestions would be appreciated.

  12. Guys Hang in there... Once CSC lets go of the case (which takes forever) NVC is pretty quick to forward it to foreign embassy. I just checked with Mumbai embassy and they have got my case and asked me to send Packet 3.

    i haven't called nvc but tomorrow it will be 4 weeks and i will be really sad if they don't have my case yet. if they had forwarded my case within 21 days my husband could have gotten his interview in september but i don't know now. anyhow, goodluck with the rest of the journey.

    Thanks neel.. I feel for you. I hope your case makes it to the embassy soon. You guys going to Delhi embassy for K3 interview right ? Hopefully you wont have to deal with the Packet 3 ####### which seems to be delaying interview by a couple of weeks at mumbai.

  13. Hi friends!

    I am trying to open new thread for approved March filers and the time it take them to be forward to NVC. We have not yet checked if our papers are received by NVC because it is too early. I am so angry to see that the waiting begin again. It is not fair. USCIS is mocking with us :crying: :crying: :crying:

    Just called NVC and they received the case from CSC yesterday(after 3 weeks). I also got my BMB case number. The lady told me that it will be forwarded to mumbai embassy in 2 to 4 weeks :(..after which I should contact the embassy.

  15. It is considered valid for 1 year, or at least until the next Tax deadline next april, after that the consulate may request an updated return reflecting 2007 income.

    The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

    In our case this what the I-134 included.

    • I-134 signed and notarized.
    • Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS
    • Photo copy of IRS form 1040, and W2s for past 3 years
    • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.
    • Photo copies of past 6 months pay stubs up to a few weeks before the interview.

    My income was well above 125% povertyline so I did not include any asset data.

  16. Guys, I am preparing I134 -- affidavit of Support (for K3 visa) and wanted to know its validity after its been notarized. I am expecting my spouse's interview somewhere around end of October, so wanted to know if I fill out and notarize the I134 right now; will it be valid a couple of months from now ? I will be submitting the latest pay stubs/bank statements.

  17. Has anyone whos been recently approved at CSC seen their petitions transfered to NVC ? Its been almost couple of weeks for me and NVC has no record of it. They say they have to allow for 90 days from NOA2 for the petition to reach nvc :(.

    For mine it took over 3 weeks.

    yep just called them today. 603-334-0700 option 1 and then 5 to speak to a customer care rep. Tell them your petition number and they can verify whether it has reached NVC.
