  1. Hi,

    I recently went through a Direct Consular Filing in the UK for an i130 visa for my wife.

    The i-130 has been aproved and I'm writing this email from our new home in the USA :thumbs:

    I'm a little confused on a couple of issues and would appreciate any help. Thanks.

    - My wife has been sent a Social Security card through the post. Is this the "Green Card" I hear mentioned everywhere ?

    - I have read about a 'Permanent Resident Card' (click me !).

    Is this something she needs to apply for or will she be sent it ?

    - What next ? Is there anything we need to be aware of doing next or can we just get on with living in the USA ?

    - We would like to bring my wife's parents to the USA but will she need to first become a US citizen before she can sponsor them or can I sponsor them ?

    I am a US citizen (dad was American)

    - My wife and I had been married for 10 years before applying for the i-130 visa so I assume she does not have a conditional residence status.

    as far as I can tell conditional residence is applied if you were married 2 years or less when applying for the Visa

    I know these topics are a bit random but I wrote tham down as they came to me. Thanks for your help.

    I have been living and working in the UK for the past 30 years. I was born in Germany (American Dad and German Mum) so hold both a US and German passport. At the age of 9 I moved to the UK and have live/worked here ever since.

    My wife and I have decided to give working and living in the USA a go so we have started a visa application for her (i-130) via DCF.

    As a US citizen I am sponsoring my wife for her visa application and part of this sponsorhip process requires me to supply my last 3 years of Federal income tax returns. I have now found out that by virtue of me being a US citizen I am supposed to file a yearly tax return with the IRS, even though I am resident in the UK and have never lived or worked in the US. Ooops !

    I need to engage a Tax advisor (CPA) who can help me file 3 years of backdated US Tax returns.

    I have found several companies on the web but does anyone know one they can recommend ?

  3. I've been living in the UK since the age of 9 (now 37) so it never occured to me to fill out a Federal tax return.

    The reason I'm looking at the tax return issue is that my wife and I are looking to emigrate to the USA and I'm part way through applying for an immigrant visa (i-130). We have had the i-130 approved and she has passed her medical so now we are trying to fill out the affidavit of support form (i-864). The last part of the form asks information on my last three years of Federal Income Tax returns. Ooops ... I have never submitted one. I will speak to a CPA as I may have to back date returns to prove my income (I'm pretty certain they won't accept my UK tax returns as proof).

    I hold a US passport (my dad is American) and was a German one (mum is German and I was born there).

    I lived in Germany up until the age of 9 and then moved to the UK and have lived/worked there ever since.

    Am i correct in saying that I am a US citizen due to my dad being American ?

    Should I have been filing Federal income tax returns ?

    Is there any chance I am liable for US tax ? (even though I live here, work here and my home is here)

  5. Thanks for the links ... I'm looking into right now.

    I'm a bit scared that I am somehow liable for US taxes. I have never lived or worked in the US and have paid all my taxes in the UK. I hope that I don't somehow get taxed twice !!!!

    I spoke with the IRS and they said it depends if I am a US citizen. Good question. My dad was American but I was born in Germany. I have a US passport and a SSN ( I briefly worked at a burger place in Texas during my summer holidays when I was 17) so does that make me a citizen ?

    Confused to say the least :-(

    I need help with my i-864 and hope someone here can help !

    Background:

    My Dad is American and mother German so I have dual citizenship (American and German passports)

    I was born in Germany and lived ther most of my childhood up until the age of 9 (briefly lived in Seattle when I was 2).

    At the age of 9 I moved to the United Kingdom and have lived there ever since.

    I got married in 2005 to my british wife and we have decided that we would love to live and work in the USA.

    We have already submitted our i-130 petition and had that approved and she has had her medical (no problem).

    The final stage is for me to submit the DS-230, DS-2001 and i-864.

    Questions:

    I am the sponsor (of my wife) and am filling out the i-864 form. Part 6 deals with my income and tax returns.

    I have only ever worked in the UK and have never filed a Fedreal income Tax return. I have now learned that although I live in the UK I should have been filing a tax return evey year :blink:

    1) I do not have 3 years of IRS tax returns to show my income. I don't have any at all. Can I use my UK tax returns ? Do I need a sponsor in the USA ?

    2) Do I need to quickly backfill 3 years of returns and wait for them to be approved before I can proceed ?

    3) I will be taking approx $250,000 with me, does that help ?
