  1. My wife had her medical in Bangkok Thailand at the main hospital

    They gave her lots of shots :angry:

    Anyway,

    We completed her I-485 and sent it in with everything but a vaccination supplement.

    we went through biometrics and now we have our interview.

    There was never an RFE for the vaccination supplement.

    Question.

    Does she need a vaccination supplement, or is it possible she had all her shots in Thailand?

    If she needs the supplement, we wont have it before her appointment, is this a big problem or do we just need to send it in later.

  2. I get what you say however,

    The instruction are in past tense

    "If your response to Question 16 is ©(9) and you filed your I-485 application with the USCIS Chicago Lockbox Facility, file your Form I-765 with the following address (if you filed your Form I-485 with a USCIS Service Center, see instructions below):"

    The instructions for the I-765 are pretty clear.

    Why would I assume that there is a hirearcy in these forms, that the I-485 instruction take precedence over all other forms instructions?

    You would think with the new fees and promises of streamlined operations that USCIS could fix this on their end.

    Im pretty sure the Service Centers all send mail to each other.

  3. I mailed a package containing our I-131, I-765, and I-485 to Nebraska early this month.

    We just received the whole package back with a letter saying we need to mail to Chicago.

    Now I see on the I-485 instructions that I should mail to Chicago,

    However,

    The I-765 tells me that if I am filling a I-765 with a I-485 I need to mail to the Nebraska Cervice center.

    From the I-765 instructions

    "If you are filing Form I-765 concurrently with Form I-485,

    mail to:

    USCIS

    Nebraska Service Center

    P.O. Box 87485

    Lincoln, NE 68501-7485"

    Anyone else have a whole packet sent back for following the instructions as spelled out in the forms.

    The following policy applies to employment authorization by class of admission:

    1. Aliens Work Authorized Without Specific DHS Authorization

    The following sections list nonimmigrants, by alien class of admission codes, who are authorized to work in the U.S. without specific authorization from DHS. The person’s I-94 will not have the DHS employment authorization stamp and the alien will generally not have an EAD.

    The above is taken from the SSA website and is linked to from our (visajourney) website.

    From what I can tell a K1 which falls under the class referenced is authorized to work in the US and will not have a stamp or need an EAD document.

    furthermore there is no reference to the expiration of the work authorization.

    Can someone clear this up?

  5. So I took my Financee to the Social Security office to get her card.

    The lady said she was authorized for work

    She came to the US on a K1

    Her card shows up a week later and has her name on it, her SS# and a statement that says

    “VALID FOR WORK ONLY WITH DHS AUTHORIZATION.”

    I go to the Social Security website to check up on her card and find.

    "The second type of card shows your name and number and notes, “VALID FOR WORK ONLY WITH DHS AUTHORIZATION.” We issue this type of card to people lawfully admitted to the United States on a temporary basis who have DHS authorization to work.

    Jump ahead to now and she wants to work, has interviewed etc.

    The lady in HR has not seen a Social Security card like my financee's and is asking for a EAD or Greencard.

    I thought the Social Security card is her authorization to work?

    Am I missing something?

  6. We also paid 3600 thb for Rin's children this week. When Rin had her interview in April it was 3800. The US Embassy fixes an exchange rate and uses it for several months. Whenever the currency moves, they readjust (although never to the actual level since it is more like 34 thb per usd now).

    The children had their K4 interview today. Got to the Embassy at 7 am for their appointment, turned in their paperwork then waited for three and a half hours. The interviewer (a younger American lady) only asked one question (she asked Rin if the children were her natural-born children - although the birth certificates clearly indicated it). They were approved and we can pickup their visas on Thursday. So all is set for them to return to the US with us on the 12th!

    Congrats.

    Aor and I go at 7:00am Wednesday morning.

  7. Question about the $100.00 for the Post Office.

    In Bangkok for our interview on Wednesday and just returned from the Post Office.

    The Post Office asked for 3600BHT.

    Our paperwork seems to indicate that we should pay $100.00USD.

    We paid the 3600BHT.

    What gives?

    If we are supposed to pay in Baht like we did for the medical than it should be spelled out in Packet 3.

    If the local Post Office is supposed to accept my new crisp 100.00 dollar bill than shame on them.......

    It has been a while since I posted but I needed to get back on the board.

    Aor and I have our interview at the embassy on Oct 3rd.

    I will be flying in for this appointment and leaving 10 days later.

    Aor is planning on staying in Thailand for a month or so to wrap up her afairs and visit with her family etc.

    If there happens to be anyone else in town with an interview around the 3rd who wants to have a cup of coffe let me know.

  9. I just delt with this myself.

    I am paying current child support plus 20% on arrearages or past due child support

    My past due was quite large and a hold was placed on my passport renewal.

    As I understand the law anyone owing more than $2500.00 in past due child support has his or her social sent to Dept of Family Services.

    Dept of State runs a check against the list and will not issue or re-new if your social is on the list.

    The intention of the law was to serve as a collection remedy for those who do not pay child support.

    The idea being if your not paying child support and want a passport you need to make "suitable" arrangements with your county child support enforcement agency.

    The problem is that anytime your past due goes over $2500.00 your social gets sent to Dept of Health Human Services AUTOMATICALLY and your county child support enforcement agency must release it at the county and state level before it is released at the federal level.

    This is one PITA.

    To further complicate things some (my) county enforcement agencies require a lare or complete payoff of the back support.

    This is not in keeping with the intention of the federal law, but this is whats happening.

    What I did was have work give me a letter that a valid passport was required for my job and then had my attorney present the letter to the Child Support Enforcement Agency.

    It took 4 weeks to clear everything up.

    My advise is work through a attorney.

    If you friend is paying current support plus xx% in past due support the attourney should be able to reach an agreement with the Child Support Agency.

    If your friend is not paying child support than shame on him.

    There is also a box on the 129f where you can explain why you have not been able to meet in person. In theory being denied a passport would not be cause to deny a 129f petition.

    My question is does the USCIS website show the current status i.e will I see NOA1?

    Or does this notice come via email?

    Is it common to see a few touches before a NOA1?

    Just courious and impatient.

    The Last Updated date changes, ours has changed 4 times.

    I assume the touch on 4/2 and 4/4 was to get our case to the adjudicator???

    So you have your NOA1 then. Unless I'm confused.... :blink:

    (How else can you know your case has been touched. )

    The USCIS will very likely show Pending as your case status.

    I have nothing thats why I posted.

    I waited for our check to clear, took the case number, plugged it into the USCIS website, registered and asked for email updates and thats it.

    I have checked a few times and see that the Last Action date has changed a few times which indicate touches correct?

    I travel and pick up snail mail every 2 weeks and was hoping that the USCIS website or emails would be a good way to track our petition.

    NOA1 is our case has been opened correct?

    It could be that our case has just been received and barcoded and is being sent to where it will be adjudicated.

    I am so relieved now that my fiance just mailed out our petition today right before the post office was closed. :)

    It took him quite a bit of time to gather all required stuff and organize the petition. And he did a great job...

    We now start counting the days........

  13. he law will affect the NOT Guilty more than the guilty. It will take time to determine if someone is in arrears in child support. Guess which group will suffer the most from this Law???? the NOT Guilty! ! ! Look at the FBI Name Checks. It adds months to the process. If there is an error in the determination that someone owes child support. Who will suffer in added time and agony and have to pay lawyers to get the error straightened out.

    It will only effect your case if you or your USC partner have arrears of child support... if you dont then it will have no effect...

    It will not take any more processing time.

    You information will be run against a local database that pulls from Dept of Human Services.

    if you have been flaged by Dept Human Service as owing child support you will not receive immigration benifits.

    The problem is how and why your name, SS#, etc ended up in the Dept of Human Services database in the first place.

  14. There is no guarantee that the process will decrease in time. Just another way to get more money out of us. It seems as though the gov't doesn't want its citizens to be with any immigrants.

    Immigration isn't something our government guarantees. It's a privilege and there's usually a high price associated with that.

    Bringing a foreign national here to live is not a "right" we are born with. The only " right" we are born with is the right to ASK to bring them.

    Security checks, interviews, paperwork and databases...etc do not come free and the cost should not be completely borne by the regular, non-petitioning tax payers. It's a service provided to US as petitioners/beneficiaries, therefore it's right that we should finance it. I hate the fees as much as anyone....the system in place sucks, and yes, it's not that cheap, but then again it's what we have and if you want your loved one here.......

    When CIS was rolled up under DHS the premis was that all depts. would share databases. and all depts. would share the cost to maintain these databases.

    it does not cost much to run the DHS check on people seeking immigration benefits.

    case in point. if you register for TSA's trusted traveler program "clear" you pay a program fee to clear of $99.95 and a vetting fee to TSA of $28.00

    Thats it $28.00 for a go or nogo. the check hits the same databases CIS uses.

    How much do you think the K1 , K3 really cost to process.

    Im no expert on what will fix CIS, I have some thoughts.

    I do know that throwing money at CIS is not the right solution.

    CIS has promissed improvements and have we seen them?

  15. Processing time will not be effected. Trust me I know.

    I just sent my passport in for renewal and it was held due to arrears in child support.

    Dept of State ran my SS number and got a hit on the Health and Human Services database and wham....no passport.

    I am having an attorney work to have my passport freed from the child support enforcemnt agency. I am paying current support plus 20% for arrears.

    Here is the big problem.

    Like denying a passport, withholding immigration is aimed at getting parents to start paying child support, current and arrears.

    What happens is that these guidelines get interpreted localy by child support enforcement agencys and passports get held untill all arrears in child support are paid or the parent ponies up some cash and files for a hearing.

    child support enforcement agencies are funded through their collection efforts, they take a cut.

    So yes, in principle if you owe child support AND ARE NOT PAYING it, you should not receive immigration benefits.

    If you are paying child support and arrears you will get caught up in this by local interpretation of federal guidelines and will be denied immigration benefits eventhough you are doing the right thing.

    Could be a good law.

    But if it follows the passport denial program, it will be a vague law that punishes those of us doing the right thing supporting our children.

    In reading through the forms I see where VJ's have gone to their local representitaves for help when USCIS sends RFE's or cases sit for a long period of time without touches.

    I have checked out the search function but cant find what I am curious about.

    When is it advised to seek help from our elected officials and most importantly how do we go about asking for help.

    My search did not turn up a "time to call the congressman / woman FAQ"
