  1. I am US citizen and filed I-130 for my sister and her family who currently reside in India.

    Below is the timeline -

    USCIS received I130 - 3/12/2011

    USCIS approved I130 - 01/29/2015

    I am trying to figure out what are the next steps - when would my sister and her family be able to get the immigrant visa?

    Her son is 14 years old today - is there a risk that he will turn 21 and they would still be waiting in line for the visa? What are the implications of this happening?

    You should also get a "Non Availability of Birth record" from the Municipal office/ Office of Birth registrar for the specific birth date of ur sister.Check the link Below

    ok. but how do you get it? Is this something that can happen over postal mail?

    In my experience, in small towns no one even bothers to reply to letters.

  3. Hello, I am a US citizen and am preparing I-130 paperwork to be filed for my sister.

    Here is the list of documents I have:

    1. Affidavits

    - my affidavit stating that she is my real sister etc

    - sister's affidavit about her DOB, that I am real brother etc

    - father's affidavit (stating sisters DOB, place of birth etc)

    2. Sister's passport ID page showing DOB, father and mother names

    3. My naturalization certificate proving I am citizen

    4. My birth certificate showing father name

    5. Many educational documents/certificates from Universities/colleges etc showing that we both have same father on those records.

    The problem is that my sister does not have her birth certificate. She tried but the records are so old and could not get from the local registrar office - so she has made that statement in her affidavit. And we are showing through various academic document that we have common father.

    My question is if the above documents are good for the application?

    Any comments/feedback much appreciated.

    Available. Prior to l970, the reporting of births was voluntary. ..

    In cases where birth certificates from the authorities are unavailable or contain insufficient information regarding the birth or the parents, a sworn affidavit executed by either the parents, if living, or other close relatives older than the applicant, may be submitted. It should set forth the relationship between the deponent and the applicant, how well the deponent knows the applicant, date and place of the applicant's birth, the names of both parents, and any other related facts. Such an affidavit, when a birth certificate is unavailable, should be accompanied by a document from a competent governmental authority confirming that the certificate does not exist, or no longer exists.

    So our father has affidavit stating my sister's DOB, place of birth etc.

    My sister has affidavit stating that she tried contacting local municipal registrar office and could not get the records.

  6. I am collecting supporting documents to be filed along with I-751 for my wife.

    All documents with joint name, insurances, back accounts, credit cards etc....

    however, I am wondering if the 2 affidavits from known persons are really

    needed. The problem is that we are kind of short on friends...some, who we know

    do not live in the same city etc etc....so getting affidavits is looking like a difficult

    thing to do. Are these really needed? Anyone who has sent without affidavits also?

  7. That doesn't sound too bad. My wife renewed hers last year using the Embassy in DC and it took 6 months. They did, however, mail it back to us.

    I am not sure, but perhaps you can buy your air tickets without having her passport. When we have bought tickets they didn't ask for passport numbers. Could be a risk if you don't get the passport back in time.

    Yes, I will try to buy tickets - may be will use her old passport number (her visas are on old passport, so will have to carry old passport during travel also).

    But why did it take 6 months for your wife?

    did you have the consulate registration done for your wife when she came here?

  8. Wife's Russian international passport is expiring in Dec and we need to travel overseas in Dec. So sent in the renewal application to Russian consulate in San Francisco, couple of days back.

    Called Consulate today morning and they state:

    1. There is no way to get the new passport sooner then 3 months

    (which mean we only get new passport end of Nov) - this going to screw us as need to buy tickets earlier for Dec travel.

    2. Need to visit the consulate in person to pick up the new passport. This is ridiculous. We are in San Diego and have to travel to San Francisco just to pick up the passport. (By the way in the application package they ask for the $20 postage fee for returning the documents, which we had sent).

    The above sounds absurd and consulate is saying there some new law into effect since Apr 09 which is causing the above.

    Anyone else had any similar experience?

    Any way to get around the above problems?

  9. First, getting passport renewal in Russia is a major pain in the rear, so I would not attempt that.

    Second, I was all set to send in the passport here to San Francisco consulate, got all papers ready, bought the money

    order for renewal fee etc - then on Sunday noticed on the consulate website that they had changed the requirements -

    require more photos, reduced the fee etc - so I would now have to redo some of the paperwork and am just not

    in mood to do this again.

    From most responses, seems like as long as the passport is valid and unexpired, there won't be any issue

    leaving Russia and entering US for the US permanent residents.

    After coming to US in 2007 on K1 visa, I am planning to visit family back in Russia this

    Summer (July-Aug 09). I now have my permanent resident card. But my Russian

    (international/travel) passport will expire during Dec 09.

    My question is - will there be any problem returning back to US

    during Aug 09 if the passport expires during Dec 09?

    There seem to be like 6-month passport expiry requirement when

    entering US for visitors (but may be its only valid for visitor visas).

    But is there any such requirement for permanent residents?

  12. Update: God has an interesting sense of humor. Not minutes after posting this message, Ira got through to the medical center and made an appointment.

    Of course, then an interesting thing happened. She asked about shots (with the intention of finding out what kind of medical shot history she needs), but the woman on the phone cut her off several times, and told her that for this visa (K1) she doesn't need shots, or documents proving past shots.

    Has anybody else heard of this? Is it accurate?

    Shots are not need for K1.

    Only need them for I-485 later. Got it done for my wife here - paid $200 for 2 vaccines.

    If you can get it done somewhere in Russia - it will be much cheaper. You dont have to do it at those clinics - anywhere but get a record (and english translation of that record).

  13. I don't know and I can't remember if they sent us different receipts or not. Everything is different now and it is quite possible that part of the restructuring included sending different apps to different offices for processing.

    Someone more recent can probably help you out a little more definitively.

    You did send them all at the same time though, right?

    Right - all three filed concurrently. All applications in the same package send to Chicago PO box address.

    to the USCIS Chicago PO box address. Today (about 10 days later) we got the NOA/receipt

    from USCIS MO office for ONLY I-765(EAD) - there is no mention of I-485 or I131.

    My question is if there are separate NOA/receipt letters sent by different USCIS offices who

    happen to process each of these application?

    I think they usually come seperately, through a week or two from when you received the first one

    :yes: That's right. Ours came in two at first, then we received the other one after 2 days.

    ok thanks - but are they 3 separate letters? 1 each for AOS, EAD and AP?

    Jaon Bill - in your timeline you have NOA1 for AOS/EAD being received on the same day - were they 2 separate letters or single for both AOS and EAD?

  17. How have you guys found out if/when the consulate received your petition. I am sure they have mine by now (it was sent the 16th) but I dont know how to check for sure. Did you guys call the embassy or DOS? Or did you find out by some other means?

    DOS knows this - I remember getting that information from DOS.

  18. In California, the original always stays with the county clerk and you can only get certified copy from them. The certified copy has a raised seal on it. I imagine if you just make a photocopy of that, it would be insufficient, since it would lack that raised seal.

    No - I got an original marriage certificate - we applied for it when we got married. We got married at the County Clerk's office. We applied for the marriage license and got married the same day - the marriage was solemized at the County Clerk's office by the office staff. This orginal marriage license/certificate is from the County Clerk's office with all the seals/stamps, signatures on it.

    So I had simply made a photocopy of this original and had sent it with I-485.

    I think the framed one is some sort of keepsake certificate (not really an official document)

  19. I am filling up I-130 for my sister. The required evidence includes a birth certificate for myself and my sister showing common parents. The problem is that my sister is not able to locate the birth certificate and is not in a position now to go back the office where the birth was registered. Is there any other way this evidence requirement can be met - has anyone else been in this position?
