  1. Hello fellow Visa Journey members. I have a question about my daughter's K2 status after she is here in America.

    I already have my Green Card and my daughter is still in Manila, Philippines waiting to get her K2 Visa.

    She will be coming here on a follow to join berfore one year.

    When she arrives here in the US, how long will her K2 status be valid. I was told two years by someone and then 30 days by another and then 90 days by someone else.

    Secondly, when adjusting status for my 10 year old daughter I was told she would need an EAD just to get a social security number.

    Any help and advice would greatly be appreciated.

    Yes, she'll need EAD to get a social security number. The visa technically dies upon entry. Her I-94 should be good for the same 90 days yours was but unless she's planning to travel abroad soon, the I-94 expiry is not critical. Under the new fee structure, EAD and Advanced Parole are included in the same fee as Adjustment of Status, so you might as well fill out those forms and send them in together.

  3. Yesterday I received Request for Initial Evidence for my I-485. It says to send in federal income tax returns, W2s, 1099s and letters from employer. The problem is that I did send all of these forms. The only thing I can think of is that I didn't have transcripts from IRS, I just sent copies from e-file system my wife used. Everything is a little complicated because her 2006 tax return was filed jointly with her ex-husband and they got divorced early in January, so the tax return is not in her current name. But I did submit her divorce decree and all other necessary paperwork, so USCIS can figure it out.

    So my question is, should I just resend these forms again because they lost them or I have to get transcripts from IRS and send those?

    And another question on my mind is, the request includes the line "You are ineligible for interim employment authorization pursuant to...", does this mean that my application for employment authorization (I-765) is also held because of this? And if it is, do they really hold it for 90 days after submitting requested evidence? Isn't there a way how to speed that up? Our financial situation depends on me starting work as soon as possible... :(

  4. Is everyone's case available online already?

    I had my biometrics appointment on 9/11 and it still says "....case not found..." on USCIS website.

    I spoke with an Immigration Officer at USCIS and was told they are behind on their data entry.

    They will try to be back on schedule with data entry by the end of October.

    Our cases should be online by then......"hopefully".

  5. well mine is over 100 its about $120 i think since i have to pay the local agent for it but its worth it (no limit on the weight and its the biggest box). the name is ATLAS shipping. my mom got it less than 2 months (45 days or so) its direct delivery and wont have to get thru post office... but as yogi have said, there's alot out there depending what state are you that is more easier to use... good luck!!!

  7. after my interview the consul smiled and said congratulations and i was given that famous pink slip and paid delbros. they never give nor said anything about 221g or whatsoever. it has been 13 working days already and we have not received the visa yet so me and my fiance called the manila embassy only to be told that it is still at the consul's desk. then we called the department of state and we got to speak to a visa specialist an she told us that it is just pending nothing more(hope she is telling the truth).

    any idea you can share with us??? does anybody here had similar case in the past and how long did it take for you to wait the visa???

    any idea is greatly appreciated. i know this website is very rich in infos and i am glad i found this.

    You should get your Visa 2 to 4 weeks after your interview...if it is in a pending state.

    It takes 2 days to print the Visa from DC...so be patient...any day now...if the Embassy had a problem with your case they would have called you by now. Don't bother the Embassy..call DC and get your updates.

  8. I am wondering how often other people checked in on thier cases? Did you e-mail the emabassy only or call washington? Its so hard to be patient. I also want to say congrats to everbody getting their visas. I know I don't post a lot, but I just want to share how happy I am for you all.

    I called Washington just about everyday. I emailed the Embassy once a week for an update.

    The system in DC is up to date. If your application is pending, means that everyone is covering their ### before they print your visa. Name checks background checks ect.

  9. Hi Phils residents,

    Just wondering, if you have a partner in the USA do they ever uses calling cards? I bought 20$ worth of cards online one time and the quality was so poor I didn't even use up the minutes. We couldn't understand each other with all the echoes.

    I'm wondering if there are better quality services out there. I searched for calling card reviews for the phils but haven't had any luck. I've been using my CP at 20 cents per min. with my international plan but now my parents want to call us when I'm there in phils and they don't have the international plan on their phone service.

    I'm taking my phone with me so I will have one in the states while in other airports. Last time I left it with them and its a nightmare using payphones.

    Just looking for good quality phone card with less echo for phils calls. Price is not the most important thing, it's quality.

  10. Hello fellow VJ members.

    My Fiancee had her interview for her K1 Visa on April 20, 2007.

    She had everything in order, all documents ect. ...but because she is from the Philippines and working in Taiwan, the CO was very cautious about approving her Visa the same day as her interview.

    The number one thing that delayed us was the CO ask why does your passport have a stamp of "NOT VALID TO TRAVEL IN IRAQ". This stamp is in all Filipino's passports as of September 2004.

    The CO refused her Visa the day of the interview and said he had to start a Background check on her and it would be concluded in one to two weeks. She went back to the Embassy in Taiwan for a second interview on May 7, 2007. This time the CO said after the interview your K1 Visa has been approved.

    She received her Visa on May 10, 2007. THANK GOD for all he has done for my fiancee and myself and all the fellow VJ members. CONGRATULATIONS to all that have received their K1 visa's; and I will be praying for those who are still waiting.

  11. I was put on AR last April 17 becuase of my BC but the good thing was they let me pay the deblos although they did not inform me that I was approve or not. My fiance always called to check our case and they always gave us a response that we must wait for 4-6 weeks and it is almost in a 4th week of waiting so my fiance called the embassy this morning again to checked our case AGAIN. The woman he spoke to said that they did receive the paper work back on May the 4th, but that now the consular who gave the interview must review the paper work. She said that can be 2 weeks to 2 months, depending on how much work the consular officer has to do. BUT, she said that there are four boxes ahead of our and it is possible for a consular to finish one box a day. So technically it could be 4 or 5 days before it is reviewed.

    I would like to know who had been in this situations.

    Stay positive and by all means call the Department of State in Washington DC.

    Everything that happens at the embassy level is updated to the DOS computer data base.

    I call them every day first thing in the morning. 202-663-1541 Press 0 to talk to a Visa specialist.

    From my point of view... NO NEWS IS GOOD NEWS...meaning if they have not called you and ask for more info ect... let them do their job, but call DOS instead of the embassy. Ask the DOS what date your petition was last updated...that way you will know that they are actively working on your case.

  12. Hello, My Fiance and I are together in Moscow for the month, and she is waiting for her packet 3 to be mailed to her in her city (not Moscow) at this point. Based on timelines we predict it will happen in the next couple of weeks.

    Since we are right here in Moscow for a while, it dawned on me that perhaps we can pick it up at the US embassy instead of waiting for it to be sent to her. They have a pretty snazy express line for US citizens here which I have taken advantage of before. I guess I am thinking it is worth a try, and if not then no harm done. But I know this whole process is a little touchy. Has anyone here considered doing this, or done this in the past? Any information is greatly appreciated.

    BTW, does the packet 3 usually contain the interview date?

  13. How will everyone deal with your fiance or fiancee and their home sickness problem while trying to get adjusted to the United States.

    Keep her busy and buy lots of cheap long distance phone cards! I also wouldn't hurt if she had others she could talk to from her same country that she could converse with in her native language.

    BTW I'm also Kent State Alumni! Poli Sci.

    I went to The Ohio State University, my son played football at Kent State for Doug Martin for a couple of years. When your kid is on athletic scholarship it's easy to continue to cheer for the Golden Flashes.

  14. What is the reason the package is being transferred to the NVC if it's being approved already? I had this question on my mind early in the morning.

    The NVC does the initial background check on your SO, if he or she has been married before and didnt tell you or if they have some kind of criminal record of any kind will delay your petition from leaving NVC. This FBI background check should only take a couple of hours if there are no problems.... Then off to Embassies.

    The Service Centers do background checks on the US citizens and NVC on the fiance or fiancee.

    Then the embassy wants police clearances from all places lived since 16 years of age.

    I wonder why they don't run this background check when they process it at the Service Center... I guess I will never know :huh:

    Check with the NVC after 9:00pm today, I'm assuming yours did'nt get ther yet.

    After they have found your petition... don't forget to ask for your NVC #.

    So you get the NVC number from them by calling or do you have to wait to receive something in the mail? Just curious.

    The NVC will assign your case a NVC number when data entry is done on your petition.

    After your petition/package has left the NVC.... 3 to 5 business days later call the embassy using your

    NVC number to see if they have received it.

  18. Tracy keep in mind that your NOA1 came during the week of THANKSGIVING. USCIS was probably shut down that Thursday and Friday and they probably did not feel like working the following week.

    You are grouped in with the December filers, Just my guess, so your NOA2 should come in the next couple of weeks if not sooner.

    That would be a great thing if it were the case.... but that would also mean that every November filer in the same week and behind her would still be waiting for approvals....

    She has to be in the with the December filers, where else would her file be?
