My wife received her passport back with the visa stamp and several loose pages of info for ssn and paying the green card fee.  There was a page stating do not open sealed envelope, however there was no envelope.  Can anyone confirm if the Bangkok embassy is using e-packet to send electronically to the USA?

I started my visa on April 2019, married in November 2018.   I am now at the stage of Documentarily Qualified but with no embassy appointment yet.  However with the current state of things if my wife doesn’t enter the US before November 2020, would she get a IR visa instead of a CR since we will have been married more than 2 years?  Is there anything I would need to do beyond waiting till November to ensure she came in with an IR visa?

     

    I am trying to find a bright side to this delay.

I am working on my first year taxes with my NRA wife.  My understanding is I can fill out the W7 and get an ITIN and then file my taxes and from this do MFJ and treat my wife as RA.  I am at the point in turbo tax where it is trying to do the Foreign earned income exclusion.  It is asking me if my spouse is RA or NRA.  If I choose NRA, I won't get the FEIE.  If I choose RA then I can get it, essentially negating her income and increasing my refund a small amount.  

     

    Being confused I asked turbo tax what to do.  She is NRA, but she is electing to be treated as RA.  Turbo tax CPA told me I can use RA here.  All is good.  But then this caution came along with the IANAL, saying that my CR1 Visa could be impacted if I choose to treat her as RA when she is NRA.  Any one have experience here?

     

    I figure my best option could be to do MFS, wait for the visa to come through (which I haven't started yet, but will in March) and then amend my return in 2020.  

  4. My first post, sorry if this has been covered.   I am getting married shortly and a visa service in Thailand is helping us fill in the CR-1 paperwork.  I am being told we must wait until we can prove the relationship is 9 months old before submitting the package.   We will be getting married about 6 months in on my second visit two Thailand  Is this true, we need to wait for the 9 month mark before filing?  Thanks.
