note that unlike an immediate relative category, overstay is not forgiven for F4. Also note that if a change or extension of status is denied - as seems extremely likely in this situation given that the immigrant intent will be clear - there are some serious implications, partly due to the long time taken to adjudicate i539. If/when it’s denied, if the person is still in the country beyond the date of the original i94 then (1) overstay dates back to that date (2) the existing B visa is immediately voided. That means not only does sibling have to leave immediately but chances of getting another B visa are just about zero. Better to be able to continue to visit while waiting properly for petition.

Hello,
I have filed for a an I-130 for my sibling who is currently in the US with a B2 visa. She is not eligible to file for Adjustment of Status yet due to the backed up priority dates.
What would be her best option to get a work permit?
Can she file for I-539 (Extend non-immigrant status) and if she gets approved can she apply for I-765 (Employment Authorization)?

Hey guys,
I have been placed under ADMINISTRATIVE PROCESSING since my interview (21st September) for a tourist visa. I am a Tunisian citizen living in France, I am working here and I live on my own ( I have got ties with this country ).
my travel history I guess was the reason they placed me under AP. I have been to Iran, Jordan, Qatar (as a tourist ).
I’d like to kindly ask you if anyone here was placed under AP in US embassy in Paris, and if they granted you the visa , how long were you waiting for ?
I started to lose hope in spending CHRISTMAA and New Year’s Eve in the US.. as it’s been almost two months since I applied.

I'm a resident in France and applied for a tourist visa. After the initial interview, I have received a request to fill out form DS 5535 in which I have provided more information about my travel history, work history, social media..
A week after, I have received a call to go to a follow-up interview. I was asked to provide more details about my travel destinations. I have an extensive travel history for leisure/tourism. Countries I have visited include: Germany, Italy, Malta, Hungary, Austria, Iran, Serbia, Qatar and Syria (prior to 2010).
My case is currently under Administrative Processing.
Did anyone go through a similar process? If so, how long did it take to get a decision?
