If I prepare my husbands I-130A ( he’s in Mexico) Do I fill out Part 6 as the preparer? Or write N/A?
-
Hello, I am having difficulty with some parts of the I-130. Please assist?
Question 53. Was the beneficiary EVER in immigration proceedings? Yes/No
54. If YES, select type of proceedings:
__Removal __Exclusion/Deportation
__Rescission __other Judicial proceedings
My husband never appeared before a judge but was taken by border patrols and released to Tijuana
Also, My lawyer from years ago when I first filed petition for my husband( we did not continue the process and withdrew) the lawyer put “ Removal” to the old I-130 version but answered “Unsure” to immigration proceedings question.
Im not sure if answering NO to 53 then Removal on 54 would make senseor will confuse immigration officers?

Exactly. The deportation is evidence of when he left the US.
That’s great news for us. And Thank you for the quick response.

If he has evidence of when he left the USA, then by the time he gets to the interview his 10 years will be up. The ban began when he left.
In 2008, A month after he was deforted to Mexico, I hired a lawyer and filed petition for my husband. We did not finish the process and left Mexico to live Philippines in 2011. We came back to Mexico in 2014 as his and my passport stamps will show.
Will my first petition count as evidence he was not in the US since then?

Hello,
I am currently working on my
husband’s I-130. He has not set foot in the US since 2008. Does the 10 year Ban still apply? Will I still have to prove Extreme Hardship or will it be like a normal process?

38. Have you obtained a Certificate of Naturalization or certificate of Citizenship?
- I used to have a Certificate of Citizenship but I lost it. If I answer Yes I need to provide the Certificate Number on Question 39a. Is it lying if I just answer No?
I have a US passport which I was told was enough to prove my Citizenship.

A person who derives US Citizenship from parents would not have a Naturalization Certificate.
I meant Certificate of Citizenship, because I am a US citizen but was not born in the US.

Hi,
I am currently working on petitioning my husband. On the I-130 form, about citizenship, I answered I acquired my citizenship from my parents. It was asking for my certificate number and the problem is I lost my certificate.
From the website, it costs around $600 and takes about 6 months to obtain a new naturalization certificate. I am tempted to just put on the I-130 form that I don’t have a certificate since my sister was a able to petition her husband without one.
Any thoughts?
