Hey Everybody,
I'm came to the US with a K-1 (long process) and it seems the bureaucray is endless
..Now it's time for AOS.
I'm getting married next Sat. and we're hoping to apply for AOS in a few weeks. I've read the instructions and the whole process it's kind of confusing.
Regarding the I-765 form (Employment Authorzation) , question # 16, where they ask to place the letter and number of the eligibility category that we're suppose to get from the instructions, what's the right option? For K-1 they stated (a)(6) and © (9), which one is correct?

Sorry about the dumb standard answer of the USCIS, but I agree with a few others here. Their standard response is to give a large time-frame cushion just in case. I gave them an address change over the phone on November 2, was told it could take awhile to process, and by November 12 had a letter in my mail confirming the new address. It is possible the name change will be done just as fast. Just be sure to carefully check any written correspondence from them when it comes, and inform them immediately of any incorrect info.
That's really sucks! But as the others, I don't think will take that long. Those dumb guys seem not understand how important is to handle with somebody's else life and dreams.
Everything will be fine! It will take more time, but soon you guys will be together!!!

I'm sorry for you guys. But I've heard from many people , after you got the RFE send what why ask you right back and won't take that long until they give you the approval!
Cheer up! I know it's hard to handle with all the wait and then find out you have to wait even longer, but everything will be fine!

I called NVC today, and they told me they forwarded our petition already..yuppp...but the guy didn't want to tell me when they mailed it to Brazil
But I checked DHL website and found out, they mailed "something" to Brazil on March 8th..haha..Well, I'm guessing my petition is on it way to the consulate!!!!!!!
NVC never emailed back, so I suggest you guys call them around 07:30/ 08:00am Eastern time, because after that its almost impossible to get a hold of them.
I'm really excited! I have to hurry up and get the pack 3 ready, and send it to the consulate as soon as they get our petition!!

Your NOA2 is one day ahead of mine so maybe that means they will arrive at the NVC around the same time! When do you plan on calling the NVC to see if they have received your petition? I was thinking of calling around Thursday (which would be one week and one day after my NOA2). Good Luck!
I've started emailing NVC the day after we got approved (I found out that we were "touched" 02/28/2007). For days, I didn't receive anything from them. I also tried calling them but due to time difference, I didn't get to talk to a live person. I tried again last night (that's day time in US) and after being put on hold for 10-15mins (listening to voice recording), I found out that they don't have a record of our case yet. This morning, my daily email paid off and they finally replied. They said they just got our case and working on it and we will just inform us if they got a case number assigned to us. That is sooooooooooooooooooooo wonderful!
I'll give it another week and hopefully, they finally have it forwarded here in Manila...

I think I'm a December filer. I sent everything on Nov 27th but got my NOA1 on Dec 5th, so I think that I'm one of you guys
Anyways, I am going to write on here anyway. I don't have anything really important to say. Just some ramblings that I was thinking and wanted to share
Today, my fiance told me that he really wanted to set a date for our wedding. And I was like, no, no, no, let's wait for your interview date before we set a wedding date. But he said no, we need a wedding date. (hehe, and I'm the girl
) So we decided to pick 2 dates. One in May and one in June, just in case we don't make the May date
. It was pretty exciting just to pick a date, and it got me thinking. I spend so much time trying to plan out the "visa journey" that I think I forget sometimes that I'm actually engaged and that I'm actually getting married. I mean it is constantly in my head, but more so in a "i wonder if our case is at NVC or I wonder when he'll get his interview" and all of that. But I guess I'm thinking too much about the details without basking in the fact that I'm marrying the love of my life in a couple of months.
Yay! So, I just had to stop all of my planning for some time today and just realize how happy I am that I'm getting married!

I feel exactly the same way!! My fiance is taking care of the wedding planning, because I´m really focus on the visa steps, approvals..Its hard to handle the visa thing, and also plan a wedding. I´m glad I can count on my fiance for that and really hope to enjoy more the fact we´ll get married. its just hard when your future is not totally in your hands. Just hope to get my visa and start a life of happiness with my sweetheart!!

I know the all of the VJ have sent the letter, but my lawyers keeps saying the letter can be sent later on
Dumb lawyers!
I have heard more delays and troubles from them... most of us just read the directions and did it on our own - which works out wonderfully, usually faster and MUCH cheaper! (Unless the case is very complicated).
Instructions on the I-129F application form, the backbone of the whole fiance petition and process:
7. What Documents Do You Need to Prove That You Can Legally Marry?
B. Provide original statements from you and your fiancé(e) whom you plan to marry within 90 days of his or her admission, and copies of any evidence you wish to submit to establish your mutual intent
I WISH I had come accross this site before I sent in the I-129F, then I would not have gotten the RFE.
I just got an email from my lawyer about the letter of intent..She said the I-129-F changed right before we applied, Dec/06 and we´ll probably be fine without the letter. I don´t believe her, and if they changed the form BEFORE we filed the process, was weren´t we told about it..
Do u guys know when the I-129F changed, and they started requiring the letter??I´m so mad at her, because I think she´s still trying to avoid admit she made a mistake..arghhhh

I got my NOA1 in Dec, and as I know we did not include the letter of intent. My fiance hired a lawyer, and we were not aware of the need of this letter. Is it mandatory? I did email the lawyer and asked him about it, and he told me we´ll need one just farther in the process. Now I´m confused. Any help?

The letter of intenet (with your signature) is necessary. Get it ready and send it to your fiance. He will probably receive an RFE soon, asking for it.

Yea. They mentioned a copy of last EAD as well. My port of entry was NY, so I was able to get a temporary authorization. Is that the same thing? Because they ask also if i'm applying for a permission or a renewal of my permission. Should I consider a renewal once I got a temporary authorization in NY? I'm confused
