    It does matter,  the lawyer said it can be amended (lowered) to under 30 grams due to certain factors of our case ( which we could still get approved with one simple possession of 30 grams or under), uscis just needs the amount he had,So I’m asking if ammend  Means the same as expunged in Jamaica, just trying to make sure we get the right thing done

  2. We filed for a k1 visa and are doing a waiver because of a weed charge but we were unaware that the amount was over 30 grams. A lawyer told us the best thing is to get it ammended by a criminal justice lawyer in Jamaica. The criminal justice lawyer told him she would expunge clear the history but the uscis already saw that he was charged for it but are requesting the amount. Does ammended and expunge mean the same thing? Any advice

    I dont know but he didn't tell them at first because he had stopped around that time but they found it in his system, so I don't think they do a drug test but they do tests that could detect it, if that makes sense. Again he is in Jamaica so may be more common and I know if u have a ban u will go for random tests his first one was just a few days after he called the panel physician and gave his letter to them,they will watch you during the random tests.

  4. So if he got the letter from the embassy end of september and took it to the panel physican, had his first test in october but failed than  he should wait till he passed the next test for example november than november of next year continue the process?

     

    Would going to a drug rehibilitation be a positive thing for the embassy even though he isnt a drug addict?

  5. Fiance was charged with possession of ganja and smoking ganja (weed) in February of 2011 he was 20 at the time. He paid a fine his court documents do not note the amount he was charged with,just the fine amount. He said it was one spliff. His medical did not come clean but he was not smoking but he was around it . We just got a refusal we don't know the reason yet but think it has to do with the weed. What should we do,is their any hope for us to be approved if we refile. He did admit at the interview he smoked in the past. Please no judgement on us. Thank u

  6. Hello, we had our interview in Kingston Jamaica on July 8, we received a 221g white slip to send in court documents and waiting for medical. We were in AP for 2 months we received a visa application refusal on September 9. I called and emailed the embassy they would not give me any information about the reason for refusal.i contacted uscsis they told me a refusal and denial are different and I should get a letter explaining why he was refused in 60 days. My question is are visa refusals and denials different and what are our options?
