  1. We filed for my wife's N-400 back in late January, thinking we'd be done by the end of may, as we really wanted to goto Turkey in June. Of course, while everyone else that filed in January got their citizenship in a few months, NY was way behind. While we were in Turkey, we received the interview appointment and my wife couldn't get back in time for it. We had to postpone it until mid-october and though we sent in the request for a rescheduling, they either didn't get it, or messed something up because on her original interview date, her online case status changed to "You didn't show up for your interview, explain yourself..." We got on the phone with USCIS and explained the situation and they put in another request for a the interview date to be rescheduled for mid october.

    In early september we got a new appointment letter, for October 26th at 7:30am. The original interview was supposed to happen in 1 Federal Plaza in NYC, but this rescheduled one was in Garden City. The appointment letter seemed like a photocopy and wasn't on the original USCIS paper stock.

    We showed up at the Garden City location at exactly 7:30, passed through security, checked in. The person checking in asked why we didn't bring the original appointment letter and brought a copy instead. I explained that that's what we got. She confirmed with a colleague whether they send such copies and learned that they in fact do. There was no one in front of us at the time we checked in, and only about 15 people sitting in the waiting area. I was told to have a seat, and my wife was told to go upstairs where they hold the interviews. In exactly an hour, she came back downstairs and had passed the test.

    They asked her the following questions.

    What is the law of the land?

    What ocean is on the west coast?

    What is the name of the National Anthem?

    Why are there 13 stripes on the flag?

    How many senators are there?

    and one more I can't remember at the moment.

    The interviewing officer apparently made a fuss about not having brought our rental lease agreement, but eventually said nevermind. Wife was told to expect an oath date in the mail soon and said it would most likely be on Nov 23rd. We got a case status update text few hours later saying that she'd been approved and to expect an oath date in a few days.

    So for those wondering if it's ok to postpone an interview date, we had absolutely no problems. The IO never even asked my wife about it.

    One more month and we're done with USCIS, few more weeks after that with the state dept. for the passport and then it's OVER. It'll be just about 5 years and 4 months for our visa journey when it's all set and done (few thousand dollars, and many many many photocopies and ARGHHHHH moments)

    Just wanted to let you all know I had my Oath Ceramony in Manhatten NY today, it was a beautiful ceramony, so now my journey that began six and a half years ago is now pretty much over and I could not have done it without you guys, all thats left to do now is Passport application on Monday and N-600 sent away for both my kids who are 11 this coming November and 18 this coming August, Any advice on the N-600 ?

    Can someone update me please...Thank You.

    About the N-600, just remember that you don't necessarily need to file it. Your kids can file for a passport based on the citizenship of both parents, and their passport is a perfectly legitimate proof of citizenship if they ever need it.

  4. I called the national passport line at 1-877-487-2778, since it's been almost 4 weeks since our application, and the online status website still didn't have a record of it. The rep first asked for the SS#, but couldn't find it using that alone, then asked me all other details (name/birthdate/address) and finally found the record. Confirmed the SS# as being correct, so I'm guessing something screwy on their end which reflected on their status page as well.

    Anyway, rep told me they mailed it on the 8th, and mailed the birth certificate yesterday. Got home today to find the passport, should get the birth certificate in a couple of days. I just did passport book and did not do expedited service. 3.5 weeks in all, not too shabby.

  6. Yup, you'd think things go a little faster here as NY is one of the main immigration hubs, but alas. Though we applied toward the end of January, there hasn't been any action for us since FP, except receipt of the yellow letter saying they might need State Issued Drivers License/ID card (received Mar 30th)

    Online status hasn't been touched since Feb 8th (FP was Feb 23rd) , which is odd but from what I've read here, the N-400 online status isn't to be trusted.

    There isn't a lot of history here on VJ Immigration Timelines to say how long an average NY naturalization application takes, but we're hoping for a late May-early June interview and an oath ceremony about 4 weeks after that.

  7. We've applied for my wife's naturalization back in January and were hoping to be done with the process around May, and take an extended vacation overseas right after. At the speed at which things are going, it's unlikely that we'll have an interview date before our planned trip.

    Has anyone had any experience in postponing an interview date, or perhaps an oath ceremony date? Are they (uscis) as flexible with such postponements as they are with say biometrics appointments?

    We'd hate to go on vacation in the middle of all this, but it might come to it, so just wanted to weigh our options.

    I've read on some recent threads that if you travel out of the country between your application and interview, that you just mention your trip at the time of your interview, and likewise if you travel between your interview and oath ceremony that you mention your recent trip during the ceremony and generally it's not an issue.

    But what about trips that are somewhat long (say 4-5 months, definitely less than 6)? Would they scrutinize that? And what about the residency requirement (being a resident of a state for 3 months before you can file the n-400) would that be applicable and we'd be out of status as far as the residency requirement is concerned? Or is that just at the time of filing?

  9. I want to re-iterate the post about filing taxes.

    When you're a US citizen, whether naturalized, or US born, you MUST pay taxes irregardless of where you live. I am not a lawyer, but I believe not doing so could make you a tax evader. IRS is the last body of government I personally would want to mess with.

    What that means as you can imagine is that you can potentially be double taxes. First in the country of residence and secondly by U.S. The only positive is that you don't pay U.S. taxes on the first $91,000'ish (at least that's what it was a couple of years ago when I checked) You still file, but claim a foreign earned income credit. If you make above that value, you will be taxed.

  11. He won't have a problem getting a visa to come here. He will have to do his military service at some point in the future though, and he has until the age of 38 to do so. When he's here, he will have to goto the turkish consulate and file paperwork every 2 years to request an extension for his military service. He can only get this extension if he can show that he is actually working or attending school here. If he fails to file for this extension in a timely manner, and decides to visit Turkey, he could potentially be taken away and have to serve at that time, or face some sort of trial. They don't take such extreme action until he's flagged as "wanted" by the military and there's a decent grace period if he does fail to file for the extension on a timely manner. (usually they let you get away with a year or two)

    Once he's here and working or studying, he will have the option to serve out his military duty in a very short period of time, if he pays an additional fee. The service is for 3 weeks (give or take a few days) and you will have to pay 8500 euros (I believe thats the current rate, I might be off a little though) You lose out on this benefit if he ever goes back to turkey for more than 6 months in a given year.

    That's usually the easiest, if he were to serve before coming here, it'll be a minimum of 6 or 9 months.

  13. If his bank account is Dollar based, he could withdraw from an ATM here in USD without penalties. At least that was the case when my wife first came here and had a dollar based account with citibank, she was able to withdraw from citibank ATMs without any issues.

    I personally would not carry a large sum like that, the last thing he needs to worry about at POE is fear that he might be searched and end up having to explain why he's carrying so much cash.

    I would also recommend wire transfers. Citibank also has Citi Global Transfer, where you can instantly send money for a pretty small fee from one Citibank account, to another overseas (and vice versa)

  14. I had to visit the Turkish New York Consulate yesterday to get an extension for my army service. (I'm a Turkish born, naturalized USC). I am posting this in case a USC has a husband that might fall into a similar situation.

    There are different ways you can ask for an extension, mine is for the fact that I work here. This is probably the 5th extension I've filed for (you can extend 2 years at a time until you're 38 years of age)

    Though I had all the proper paperwork filled out, and all the necessary documents with me, they wouldn't let me extend since I was a dual citizen, but I hadn't informed the Turkish government about my US citizenship properly. They said that while Turkish citizens acquiring US citizenship had always been required to properly inform the Turkish government, that they never really enforced it. But now they're changing that and for certain things you file at the Consulate, they won't do it without it.

    The paperwork for this is very simple, two identical pages of a document filled out with your basic info, if you're filing in person, you can bring your original US certificate of naturalization, plus two copies, your turkish national id card, plus two copies, and $40. I think you can file via mail too, but check the e-konsolosluk.net site for details. They said the process takes 4-6 months, and I have to wait till I get confirmation in the mail, before I can ask for an extension for my army service. Which is kinda bad, since I was already slightly late in filing for extension this time around (last extension expired in November) and so I will be without proper extension paperwork for 10-12 months.

    Anyway, just letting people know. I don't know what other consulate work would require your dual citizenship to be registered properly, but seems like they're much more strict about it.

  15. Hi everyone,

    my wife was scheduled for her biometrics on Feb 26th in brooklyn, ny. The day prior to it and on the day of, we got about a foot of snow, and public schools were closed (they are rarely closed for snow related reasons) I called USCIS on the day of to see if that particular office was closed and they said no. Others in New Jersey were but no such closings in NY. The uscis rep directed me to a section of their website showing "real time closing info" and said i should check before leaving the house. Anyway long story short, we checked until my wife left, and there was no indication it'd be closed. She took a risk trying to get there and when she did, it was obviously closed. We were pissed off obviously.

    Called USCIS again and they said, if the office is closed for any reason, that they would automatically reschedule any appointments. It's now been 3 weeks and we still dont' have an appointment letter (the original one was sent to us about 10 days after filing the 751.

    I called USCIS again this week and they said they can't give us any more details, and that I should write to the ASC. Since ASC's don't have phone numbers, is that my only choice?

    I hate to have our case considered abondoned because of a mistake on USCIS' part.

    On the meantime, I got "touches" for our I-485 application this week, no touches on the 751 :)

I know this isn't quite the same, but when my wife had her K3 interview in Ankara, they told her she had to send in her old passport (one she had with her maiden name, that she got cancelled when she got one using new last name.) And also that I needed to send my W-2's for the past few years, even though I had sent in IRS transcripts for the past 3 years in our packet. She left her new passport with them.

    We weren't sure how long it was going to take, but to our surprise, she had her passport with the Visa stamped and delivered back to her via UPS in about 10 days.

    Obviously every situation is different, but just letting you know not to panic too much.

  17. We applied for AOS right before the fee increase and got notice of transfer to CSC back in October.

    It was touched almost everyday for a period of 2 weeks and we were hoping to get approved without an interview.

    Today however we got an email saying:

    "We transferred this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS to our NATIONAL BENEFITS CENTER location for processing because they now have jurisdiction over the case. We sent you a notice of this transfer.

    What the hell? are we back to MSC? what the hell was the reason to transfer to CSC to begin with... AHHHHHHHH!

  18. If you have gotten your case number from NVC, ( It will be something like ANK2007XXXXXX) then you can go for the medical. All you need is that number. As soon as you get that number you can also get a lot of your paperwork done in advance, DS-156 DS-157, DS-230, I-134, and send these in to Ankara about 1-2 weeks after you get that case number from NVC.

    I'd tell your husband to also get his police record as that's a bit tough. And have all those translations done.

    tells you what you need. You will eventually get that from Ankara, but do like we (and others) have done and send this stuff once you get them all ready.

  19. I thought they got rid of this type of approval.

    Basically just about a year ago, they started approving I-130's and I-129f's at the same time and started sending letters like that. What you got was a notice basically saying your I-130 was retained by USCIS (and not forwarded to NVC where it would've lead to simultaneously being in processed for an IR/CR-1).

    So yes, it just means you're now only pursuing the K3 route and will file for AOS once your husband arrives to the states. You can call USCIS telling them they made a mistake like I did, but all you'll get is a letter in the mail 4 months later basically saying nothing of use.

  20. When you get your biometrics appt letter, it'll tell you howto reschedule it. Basically you send a letter to an address on that letter saying you need to reschedule. You also include the original appt letter.

    My wife was out of the country at the time and her appt was for Sep 22. She was coming back Sep 29, so I wrote a letter (pretending to be her) and said I can't make the biometrics appointment and to please schedule for something on or after October 1st and sent the original appointment letter along (I made a copy just in case) and they came back with a new date (oct 2nd) within a week.

    I filed a k-1 petition for my fiance. He receieved the visa, but we broke up. And now we are not together anymore. He hasn't came to the U.S.A yet. But I don't want him to take the advantage of that visa and come here. Therefore, I want to cancel this case as soon as possible. I am not sure wether to call the embassy or the uscis here. Anyone has an Idea of whom I should contact?

    Sorry to hear it didn't work out. With the K-1 visa, he can't really come here and just stay here (well legally) If he doesn't marry you within 90 days of entering the U.S. then he's out of status. Not sure who you contact to stop him from coming to the country but I got a feeling that would be difficult todo. Most (if not all) K-1's have a validity of 6 months, meaning he has to travel to the U.S. within 6 months of the issue date of the visa. If he doesn't come here by then he can't come here at all.

    If you could indeed invalidate his visa, then all they can do is reject him at POE, which is sorta stupid if you ask me.
