    I am a LPR and my husband is a USC and we were married before my son turned 18. My husband petitioned for my son last March (I-130)and we received NOA1 with a priority date of March 15, 2011. My son turend 21 in June 2011 (after receipt of the NOA1)and we had no further communication until September 2011. My husband received the DS3032 and paid the affidavit of support fee $88. My son completed the DS3032 and nominated my husband as his agent over here in the US (my son is still at University in the UK). In October my husband received a case number from NVC and the Processing Fee Bill for $404 which he subsequently paid online. We did not hear any more from NVC so my husband called them last week and was told he should have scrolled down the page when he paid the Processing Fee Bill and it would have taken him to the DS-230 (which he had not realised). He was told he could still login and complete the DS-230 and send it with any supporting documents to NVC.

    My main concern here is; my son is now over 21 and the DS-230 has not been filed. Is this going to be a problem regarding ageing out? The I-130 and NOA1 (I797C) are both dated March 2011 prior to his 21st Birthday so does that mean everything should still be ok?

    Please help, I am so worried about this as my son will be devastated if he can't come to the US and will have to wait years for a Visa to become available.

  2. Hello, Everyone

    Just wanted to let people know that we received an RFE for a copy of my BC. I wish USCIS would put this on their forms as documents to be included with the I129F Petition!!! So, for anyone out there just about to file...include the Beneficiary's BC just to be on the safe side. We received our NOA1 on 26th June 2007 and received the hard copy of the RFE on 16th November. So, it took almost five months for them to ask for this...GRRRRRR. Despite calling USCIS when our application was updated online to say we were getting an RFE they wouldn't tell us why this was being sent out...had to wait over a week for the hard copy.

    Also just a quick note about visiting the USA once the Petition has been filed. I had no probelms at all when I arrived a few weeks ago. I had been a bit apprehensive after reading several posts on here...perhaps I was just lucky...who knows!

    The waiting continues.....

    Can anyone give me some information on returning to the UK after AOS and Conditional Permanent Residency has been approved.

    I own a successful Business here in the UK and will continue to work remotely once I (hopefully) move to the US. What I really need to know in advance is whether I will be free to commute to and from the UK once the K1 process is complete. I will most probably need to return to the UK every couple of months for say 10-14 days at a time.

    Any help/advice would be appreciated.

  4. Thanks to all who replied to my last post regarding visiting the US once the I-129F has been filed.

    Next question is...what family name do I use on the I-129F and the G-325A! I'm divorced and on the I-129F it asks for family name which I assume is the name I am currently using (ie., former married name) since Q. 7 asks for maiden name. The G-325A however asks for family name which I assume is my maiden name since it then asks for all other names used (including names by previous marriages). All that being said I'm not sure what family name I should be using...should it be the same on both forms...maiden family name of current family name??? :help:

    Also whilst I am a UK Citizen my country of birth is Scotland...so do I useScotland, UK or just Scotland or just UK? I know when I visit the USA it is the UK that goes on the green immigration form...but for these forms I'm not sure.

    Perhaps I'm being too cautious here but I just want to get things right from the word go!

    Any guidance would be much appreciated.

  5. Can anyone tell me what the external genital exam entails. Don't get me wrong I've had 2 children and have no problems with modesty etc. However, I do think USCIS could've given a bit more detail. I know I'll have to go through a full breast exam (know what to expect there...lol) but the genital exam is a bit of a mystery. I'm not complaing about it but it's nice to know what to expect...so if anyone can help ease my nerves I'd be grateful. :)

    You get a breast exam if you are over 35. The genital exam is, quite simply, the doc briefly looking at your bits (top only, no splayed legs or anything!). Takes about 2 seconds.
