  1. Hello everyone.

    I was hoping someone could help me. I'm a US citizen and living in Canada with my Canadian wife and we're filling out the I-864 forms. I have my parents filling one out also just cause I can't sponsor my wife on my own since I have no US income. But my question is, they are asking for employment and income. I do work up here in Canda so should I put my Canadian income on the forms or leave it blank since I dont have any US income? Also, if I put my Canadian income, do I need to change it to US dollar?

    Just want to make sure you are preparing the correct form... Your profile indicates DCF but your timeline indicates K-3... as DCF (CR(IR)1) visa requires I-864 and K-3 visa requires an I-134.

    well I'm still trying to learn all these forms. When I first started I was wanting to file DCF but then they passed that child law where you couldn't go to the Consulates anymore so I filed the I-130 back in Feb and got that approved and then they wanted me to pay ahead of time for the afadavid of Support and the Sponsorship and then they said I can send in the forms I need. I will have to check out my paperwork to see if I even filed correctly. I hate dealing with the government! lol.

  3. Most people apply for K-3 the US Citizen is living in the US and the foreign citizen remains in the foreign country, the foreign citizen then moves to the US with the K-3 visa, they cannot just move to the USA with out it.

    If your wife were to "move" to the USA before the K-3 is issued, a work permit is not an option because she will be just a visitor that is allowed to be a visitor for only 90 days, then will need to return home or be considered out of status, and that may cause problems for the K-3 visa.

I filed my I-130 in Feb-2007 to Vermont and got a letter saying that they recieved it and then a few weeks ago got a letter saying they transferred it to the California offices. I guess I thought it would be faster for a US citizen applying to get his wife to move with me to the US. It's been 4 months and dont' have a status yet. I'll have to call them.

    The process is not fast, but is quite quick for Canada when compared to other consulates, China takes over 1 year for a K-3.

    What you can do while waiting is gather the police cert from Canada, and Canadian Birth Cert if needed, as well as make sure Canadian passport has not expired or is close to expiring.

    I haven't worked on the I-129F yet either so I can do that. I didn't work on it yet cause I thought they would send me some paperwork that I would need to complete the I-129F. I was afraid to start the police cert from Canada just yet cuase it could be pretty old before they need it submitted and I figured they would want a new one. According to my timeline, they said that if I dont' hear anything about my I-130 by August then give them a call. I guess it's pointless to call ahead for a status check

  5. Hello all. I"m hoping someone can give me some advice. I"m a US citizen and my wife is Canadian. We both live in Toronto and have filed our K3 so we can both move to the US together. I've been told from a friend who has done the samething that the immigration officer in Montreal during her interview that most people apply from within the US. Could we move to the US while our paperwork is in process? I know my wife wouldn't be able to work, so I assume we'd need to file for a work permit. We'd move in with my parents while her paperwork was being reviewed. It's been 4 months now and the other words we've recieved is that they have gotten the paperwork we mailed off to Vermont and then a couple months later they said that they had to send it over to California. I dont' know why they did that, mabye caue Missouri is in their jurisdiction. Could someone give advice about moving early?

It doesn't make much sense to me either why you'd have to fill one out, but I think it's because they assume you'll eventually have your own income, and your foreign spouse should be dependent upon you first before any less-related sponsor you choose. Signing the I-864 requires you and any joint sponsors to support the beneficiary for ten years, unless she gets citizenship or works a certain amt of time.

    this is probably a stupid question here, but what do I put since they want to know income and where I"m employed if I'm currently working in Canada? They won't care about my current income since I won't have the same income when we move.

  7. Hello. I had a question I'm still confused about even after reading the posts. I'm a USC and my wife is Canadian. We getting ready to mail off the I-130 forms today. I was looking ahead at the I-864 Affidavit of Support which I can't sponser my wife cause we're both living in Canada and don't have US income but could use my parent's address as domicile. I was planning on having my parents fill out the I-864, is that possible? Also, I was wondering in Part 1 of I-864, would my parents fill in question 1 A or B. After reading all this, I hope I did enough research and filled out the proper forms to begin with!

    I haven't had to do the I-864 yet either, but here's my understanding of it. You would fill out one saying you were the sponsor and petitioning for the beneficiary. One of your parents would fill out another and check that they are the joint sponsor. Have you seen the example forms? :)

    I believe there could also be the case where you submit three of them - one has to be filled out by you, then one from your mom and one from you dad. If their money is tied up together, you're probably better having only the one with more money/income in their name being the only joint sponsor.

    yes, I printed out the instructions, the I-864 and the example form. I guess it just doesn't make any sense to me why I'd fill one out when I don't have any US income. I've talked to a friend of mine and she said that she filled one out for her Canadian husband and also her sister in law had to fill one out. So my mother would fill out an I-864 and I'll fill one out also.

I'm filling out both G-325As for myself (USC) and my wife (Canadian) and at the bottom they ask "this form is submitted in connection with an application for:" the choices are "Nationalization" and "Other" and "Status as Permanent Resident" I've looked at the example form they have and looks like my wife would check the Status as Permanent Resident, but which do I check?

  10. Hello I'm hoping someone can help me. My friend here in Canada filed the paperwork for her USC and her husband (Canadian) to move to the States and she mentioned that she thought the DS-3032 Agent of Choice form had to be submitted before the I-130 form to estabish an address in the US where all the paperwork will be mailed to. But I cant' find this form on the US immigration website. Do they send the form to you to complete or is she even correct about me having to sent this form? I'm a US citizen in Canada and wanting to move back to the States with my Canadian wife and getting ready to file the I-130 form.

    we are very new to this and reading all your posts and how easy of a time you had is very reassuring. I had a couple questions. My wife (Canadian) and I (US citizen) are wanting to move back to the States and heard that DCF is the easiest route. I was reading this posts and 1) wondering what USC means. 2) I was reading on what to expect after mailing off the I-130 and it said that we'll need to fill out a I-864 form which you'll need to show the past 3 tax returns and that you make 125% over the poverty limit to show you can support your spouse, I was wondering how you suppose to do that if we're both living in Canada and submitting all the forms form Toronto? 3) Is going to the Toronto Consulate really a lot easier then mailing the stuff?

  12. alright. I think I have it figured out (kinda) Sorry for the stupid questions. i guess I was confused when I read about the domicile and filing my taxes. I guess what it means is that yes, I do live in Canada with my wife but my mailing address with with my parents and can use their address for mine. I hope I have it correct. Please let me know if I'm making any sense here.

    thanks for your help. After reading about the DCF, I'm wondering if I (US citizen) would have to be living in the US or have an address there. We both live in Canada right now, I could use my parent's address. Would it be better to have my parents sponsor my wife instead of going the DCF route?

    If you are living in Canada you may meet the requirements for DCF - check out that forum, if you can do that it would probably be ideal - the I130 is basically approved when you submit it at the consulate and then it is transferred directly to Montreal for the remainder of the process.
