  1. I just received the documentarily qualified email 3 days ago and now waiting for the interview email. I was wondering if it's possible to expedite the case for an interview at this point? I know I'm not required to be present with my parent at the time of the interview, but I'd rather do so since the embassy is pretty far and in a different state. I'm flying back in a little over 5 weeks, and I'm afraid the interview date will fall after I'm gone. Are all cases eligible to be expedited?

  2. I filed Form I-130 and I-864 for my mother with her name spelled exactly like it is on my US birth certificate. I just paid the IV fee and I still haven't started on the DS-260, but I'm starting to find discrepancies across most of her documents.

     

    1. The first name spelling on her current foreign passport does not match the one on my birth certificate: it's spelled with an extra letter "y" (XXXXyXX on passport and XXXXXX on birth certificate).

    2. The last name or "surname" field is left blank on her passport but she has a last name on my birth certificate.

    3. There is no middle name field on her passport and instead it's "husband name" but it does match her middle name on my birth certificate, although the passport has a space in that name and there isn't one on my birth certificate.

    4. The DOB on her passport is not the same as the DOB on her old California DL from when she was here (which is the one I used to file the I-130 and I-864).

    5. Her first name on her California DL and Social Security Card is the same as the one on my birth certificate, but her middle name on my birth certificate is now her last name on DL+SSC and the middle name is entirely different.

     

    All the forms I've filed so far are according to her name spelling on my birth certificate. I know I have to get her to fix her first name spelling on her current passport and also the DOB. Is the last name/surname being blank on her passport going to be a problem? Or should I get her to add it on her passport regardless? What about the mismatch on her old DL + SSC? I imagine there's nothing I can do about those at this point.

     

    Any suggestions/advice will be greatly appreciated, and apologies if the post is difficult to follow.

    Thank you for your response. I did file for an extension for 2018 taxes already. I'm just trying to determine if I should just submit the I-864 now with the 2017 tax return or wait until I'm able to file 2018 taxes and then submit.

     

    In your experience, if I submit it the form with 2017 tax return and it ends up being insufficient/not recent, will they give me a chance to fix my mistake/provide them with 2018 tax return or can they just deny the petition altogether?

  4. My petition for my mom got approved last month and I just started filling out the Form I-864. I'm at the Federal Income Tax section of the form and I'm not sure how to fill out a few things. I'm still waiting on the 1099 from my employer for year 2018 so I still haven't filed my taxes yet. I did file taxes for year 2017. If I were to submit the form today, would the 2017 tax return be sufficient or would it be considered too old?

     

    The form asks whether or not I filed taxes for each of the three most recent tax years and also the income amounts for those years. As far as I understand, I'm only required to send in the most recent tax return. Can my application be denied if I didn't file taxes for 2015 and 2016? I did have some income but I wasn't able to file.

     

    Also, I do work for a company and have a job title but I'm not on a W-2. I receive 1099s like I mentioned earlier. Do I have to specify Self-Employed (Part 6 Item 4) or can I just put my occupation and employer name (Part 6 Items 1 & 2)?

     

    Any suggestions/advice will be greatly appreciated!

  5. I'm preparing the I-130 for my mother. As far as I understand, I have to send the I-130, the payment, and my birth certificate showing both of our names. Are there any other documents that I'm required to send? Is it recommended to send the I-864 with I-130 or to wait until they ask for it? I'm seeing conflicting info on this.

     

    Any advice/suggestions will be greatly appreciated!

  6. I'm filling out the I-130 for my mom and I have a few questions. I'm a US citizen (born here) and she's in Pakistan. As far as I can tell, I'm only required to send in the I-130, $535 payment, and my birth certificate showing both of our names. Is that correct? Can I also send the I-864 right now or is it recommended to wait until they ask for it when the time comes?

     

    Also, my mom had a SSN from when she was here 25+ years so I know it's probably a good idea to include the SSN on the I-130. However, some of the info like the DOB she has on her old New York state ID from back then does not match the DOB she has on her current passport (the birth year is the same, but not the date or month). How big of an issue is that? I can probably have her fix it on her current passport so it matches with the info here since they might still have access to the records from back then. When the time comes for an interview at an embassy/consulate, is she required to bring anything other than her current passport?
