  1. Hello,

My approved I-130 is still at CSC and the customer service reps say it cout be up to a 90 day delay even though the paper approval copy (dated Feb 12, 2007) states petition forwarded to NVC. I got the I-129F approval on March 22, 2007 and it says forwarded to NVC also. My understanding is that the I-129F should be sent immediatly to the NVC, am I wrong or is there a delay between approval and the service center actually sending the approved petition, anyone know??

  2. Woohoo, finally I-129F approval! After received an RFE for missing passport pics, and getting a denial since my lawyer only sent in my spouses pics, the appeal package getting lost in the CSC mail room, the second appeal package led to an appeal!! The appeal process took 7 days. Finally the CSC process is over...now onto NVC and hopefully medical/inteview shortly after!!

  3. I have to agree. Have the lawyer pay for the appeal fee b/c it was his mistake not yours. I hear the appeal process can be time consuming and costly so a lot of other couples decided to re-do the petition instead of appealing.

Do you have any complications with you case? If not I recommend you fire your attorney and do it yourself.

Also congrats on your I130 approval!!

    Hello,

I have no problems with my case as far as I know. Supposedly CSC can choose to reopen the case and approve it because only thing missing was the passport pic. Calling them is useles as I have found out before so I am back to waiting....

  4. Hello,

This I-129F petition has turned from frustrating to nightmarish. On Jan 31, 2007 I recevied an RFE becaue my immigration attorney did not inlcude passport pictures of myself and my spouse as part of the petition. He send away the RFE, 2 weeks later I recieved an I-130 petition approval and an I-129F denial. The denial was due to the fact that the attorney only sent in my spouse's passport pic not mine. The denial came with an appeal option that the attorney submitted (with the missing pic and appeal fee's). I am like totally frustrated and angered at this situation. Has anyone been through the apeal process??? Any advice or timelines would help, thank you.

My advice: Fire the lawyer. Anyone with a High School Diploma can figure out the paperwork if they read it twice, slowly. He's already incompetent and this is the EASY paperwork. Do it yourself or get a new lawyer.

Here's some other thumbnail advice. My family is full of lawyers and judges. ANYTHING that you can get a lawyer to do for less than $3,000 is easy enough for you to do it yourself. Trust me, your lawyer has NEVER looked at your paperwork. All of it has been done and done wrong, by a clerk.

On a daily basis foreigners with limited English skills and questionable quality of schooling are able to successfully fill out these forms all by themselves. You can too.

    Hello,

I agree, I used a lawyer to avoid issues like this and the sad part is that I gave him all the info, he requested nothing further from me. Mistakes happen I understand but the waiting is terrible.

    /Rad

Wow! This is strange. I think the lawyer should be responsible for paying those fees.

    Hello,

He apologized a thousand times and now its back to waiting. That is the hardest part...

  6. I've experienced it :)

I continued working on both, but my I129F wasn't approved until 6 weeks later and is still lagging way behind, so as of today I think we're abandoning any efforts on it.

Congrats on the approval, definitely read up on the NVC Timesavers thread in the NVC forum, as well as the NVC flowchart in the guides.

Finally, it's possible that both petitions were approved at the same time and you just haven't received the second notice... does your I130 NOA2 say your petition will be forwarded to the NVC or retained by USCIS? If it says it's been forwarded, then it should be.

    Good luck & Congratulations!!

    Hello,

The approval notice states that the original petition has been sent to the Department of State National Visa center. Thanks for your wishes and the advice to read about the NVC Timesavers. I am on it now...!

  7. I was suprised to find in the mail today the I30 Approval! The notice date was Feb. 12, 2007, the last touch on the case online was Feb. 13, 2007 and the online status then and now is "case recieved and pending". What is the process now if I-129F is pending and the I-130 is approved?? anyone else in the same situation?

  8. Hello,

Today I received an email update from USCIS saying that my RFE was received and the case has resumed processing. About 30 minutes later I received another email stating that the case has been transferred to CSC. The case was transferred to CSC back on December 1st. Does anyone know what is going on or is this just a glitch within the CSC IT department?

  9. I received an RFE for my spousal I-129F petition. Turns out my lawyer sent in passport pictures of myself and my spouse with the I-130 petition but not the I-129F petition. So the RFE was requesting passport pictures. Like others have posted, put in all information required and information not required like pictures and proof of relationship. This will avoid delays.

    /Rad

Wow, that's a pretty simple thing to mess up. How could he forget something that important? I hope you asked for a discount!

I was seriously freaking out after waiting several months to receive an RFE. I got a lawyer initially to make things easier and so that nothing is missed for the filings...oh well..

    What does the letter say?

    Hello!

please see other post on this

    what are they asking for?

    Hello!

    Hi,

I didnt get the letter yet. It was updated when I checked my case today online at the USCIS site. I called the CSC office and they had no information only that it would take 7-10 days for me to get the official letter.

  12. Hello,

I have a I-129F spousal petition pending at CSC. After waiting for almost 3 months I checked the online status and received an RFE notice. I used a lawyer to help me with the filing and he assured me that the case looks pretty solid. I am really worried about what the RFE could be about. Does anyone have any experiece to share on RFEs? Any suggestions would be most appreciated, thank you.

    /Rad

  13. I just got an email from CIS with last update date of my K-3 case 01/20/2007 (Saturday?) .

The I129F PETITION FOR FIANCE(E) that was transferred to our CALIFORNIA SERVICE CENTER location is now pending there. You will be notified by mail when a decision is made, or if the office needs something from you.

Any body has any idea after this how much time do you think it will take for approval or else otherwise?

    Thanks,

    Data Sheet

    Hello,

I filed my wifes I-129F form and I got receipt Nov. 24, 2006. I started checking the online status and saw that the case was transfered to CSC for "faster processing". CSC recieved the case Dec. 9, 2006 and there was an update each day, or touch, during the time the case was being sent to CSC. Since it was received there has been no update. I hope there is an answer soon but the cases seem to get sent from one black hole to another.

Does this means CIS has sent me a letter? I have not get any mail from them not even the case number. I check the status line because someone here told me that it was on back of the cashed check. Does anyone who has check their case online said the same as my case or I maybe missing a letter from CIS..

    Thank you........

    Hello,

I am currently in the K3 process which includes I129F filing after receiving receipt of the permanent residence or I130 form. In my case it took a full week to receive receipt forms from USCIS when my online status has changed.

  15. Hi everyone!

I have a question concerning the filing N-400 Fee ,The Naturalization guide indicates that the cost of the Application is $330 and that the $ 70 biometrics fee might be asked later. So do i have to write a check for $330 only and then wait till they ask to send the $70 dollars biometric fee?... Or should i just write the $ 400 on check which gonna cover the application cost and the biometrics fee. ..... Or should i write 2 separate checks $330 -applicaiton and $70-bometrics fee ?...

The total fee cost gonna be $ 390? or $400? Why does the guide idicates $390? It cant be $390 it should be $400 as $330 plus $ 70 gonna be $400. I am confused..

Do i also need to include the New Affidavits from friends and family members again?

Do i need to include the new pictures of my husband and i together again too?

    Thanks.

    Best wishes.

    Hello,

I applied for my citizenship in May 2006 and had the ceremony in October 2006. With the N-400 form I included payment for the full amount and never had any issues. If you dont include the biometric payment its going to add delays to your citizenship process if not denial for insufficient funds.
