is that what you would call my situation? I am not sure, Im just worried cause I dont want to over stay my 1-94 before getting an approval for a green card, we were expecting to get all tax done by now but is taking longer than expected, So I guess my question here is: Do you have to send all of the forms together?  (I-130, I-485) Or can I send the I 130 first? then get all our documents together and send the 485??

So me and my husband (back then boyfriend) decided to get married and went to Vegas around 4 months after I arrived to the U.S on a tourist visa, he is filing his taxes and doing all he has to do so we can file all the forms but apparently some documents he needs he will only be able to get them after the 15th (which is when my I 94 expires) so I was wondering if we should go ahead and send the I-130 form application before the rest of them (just so I can get some sort of extention to over stay my I-94 or at least have an excuse to have over stayed) so we can basically buy time to get all the documents required to fill the  I-485
