    Oh and I just checked my case status on uscis.gov and the last updated date shows as 07/13/2015...so I guess that is my "in line for interview" date? That is the only other update date I have, besides the date previously displayed which was the day after biometrics....

  5. Kimbear, those jammies are so cute! Glad your husband's coworkers through him such a fun shower.

    Marilyn, the pictures with Emily and your DH are so cute.

    Minya, I am due with twin boys Dec. 19. I hope they come of their own accord and have good weights like yours. I have been eating right and exercising and resting whenever I can. Thankfully I haven't been put on bedrest.

    Lilac, congratulations...hope you have an easy rest of pregnancy and a smooth delivery. :) Glad you're doing what you can to stay active and healthy throughout your pregnancy. I tried to do as well, before the bedrest...and while I was confined to horizontality (and literally, I was only allowed up to pee) I did gain more than while I was 'active', I didn't do too bad...only

    It is my understanding that bed rest due to incompetent cervix issues are discovered when the monitoring begins to increase due to special circumstance of having a twin pregnancy. Mine was discovered at the time I began ultrasounds every two weeks. Up to that point I was only having them once a month. It was a relief that I was orderd to rest, as I wouldn't have done it on my own, andt by about 30 weeks or so I was the size of a freight train and so thankful that I didn't have to change out of my pj's if I didn't feel like it. :)

  6. Can a non-canadian new mom chime in here? ;) I've been MIA for quite a while, as we took a break from immigration and life just got hectic. I popped in to see what's been happening on VJ and to see how the people that I remember from my days on here are....and Marylin. just wanted to say I was so happy to see that you're a mommy, and your daughter is absolutely adorable! If I remember well you and your husband were trying but having some difficulty, so I'mreally happy for you. dancin5hr.gif

    I had 'unexplained infertility' issues, and we tried for 4 years, and we did IUI as a last shot before going to IVF. My doctor at the time said that he was not optimistic of success because I did not do so well (in terms of egg production) on the injectible medication. We were knocked out of our 'boots' when I tested pregnancy positive two weeks after the IUI, and then shocked sh__less when my first ultrasound showed two heartbeats! :) I went on to have a rather uneventfuld (for twins) pregnancy...we had a little scare at 26 weeks when they discovered that my cervix drastically shortened to 8 mm (apparently normal is 4 cm) so after a week in the hospital I was sent home on severe bedrest. So my 8 mm cervix and I stayed in bed and rode out the rest of the pregnancy to deliver 2 healthy boys who arrived of their own volition at exactly 37 weeks of gestation on June 10th, weighing in at 7 lbs 3 ozs and 6 lbs 3 ozs respectively. They're doing great and at 4 months have become quite the chunky monkeys hovering around 18 lbs each and relegating me to a constantly achy back. Now if I could just get them to sleep somewhat through the night (like longer than 3-4 hour stretches) I would be in heaven! ;)

    I'd like to share a photo or two of my sons, but its been so long sinve I've been on VJ, I've forgotten how. I have photos in Dropbox, anyone know how I can embed those images directly in a post?

  7. When does the 2 year protection order expire? It sounds like it was put in place before your conditional GC interview, which means that it would expire before you would file for removal of conditions. A two year order of protection sounds rather extreme for a simple case of "he pushed me one night when he was drunk"....especially if both parties are willing to work on the marriage, but I'm not familiar with the laws of your state.

  8. This is confusing...who e-mailed the consulate to withdraw the application, the USC or the foreign fiance(e)? Was there any reply affirming that the withdraw request has been granted or some sort of communication from the consulate or DHS? Its a little confusing how the foreign fiancee can request that an approved petition be withdrawn, resulting in a DHS revocation, since the underlying I-129F petition was completed by the USC and approved by USCIS, not DHS. The beneficiary can not attend the interview, or request a cancellation of the interview...but not the withdrawal of the I-129F...that is not within their power.

    My mother-in-law signed the I-864 and her husband signed an I-864A

    And my joint sponsor signed the I-864 he is who meets the requirements.

    Then what JimVa... stated in his post is correct (last post on page 1 of this thread) you muddied the I-864 waters with too many of them submitted....and it seems pissed off the IO because you did not have a piece of documentation on hand that the IO asked for at the time of interview. Unfortunate as it is, you have no choice but to wait for the RFE letter from USCIS. It isn't a denial. If you respond to the RFE and a second interview is ordered, please make sure to have all your documentation on hand and ready to be presented. I would, if at all possible sort out the multiple affidavits that they have on file for your petition. Those are binding contracts with the US government...and if not needed wouldn't want them lingering in the file.

  10. Wait...is the stepdad the joint sponsor? Your posts are a bit confusing. It sounds like you're unclear about how the I-864 process works. You are the intending immigrant....your husband, regardless of financial ability or not is your primary sponsor (he fills out an I-864 no matter that he is unemployed and has no income), THEN if the primary sponsor's income is non-existent or insufficient, a joint sponsor also fills out one I-864. In your case, two I-864 (with the appropriate documentation) would have been needed....one from your husband and one from the joint sponsor, the family friend. How many I-864's did you provide?

  11. I completed G-325, I-485, I-130 and all the supporting documents. Here's the thing, my sister is a joint sponsor and she supposed to mail me the I-864 with all the required documents this week. But unfortunately she has not recieved her Tax returns etc which she requested from IRS. So she told me it'll take 2 more weeks and thats most important document needed for I-864. Should I wait before I file everything?

    Are you applying for AOS based on marriage to a USC? THe I-864, with its documentary proof requirements is part of the AOS application (the I-485). Not having complete documents to accompany the I-864 would render the I-485 incomplete and risk an RFE. I would wait until all documents are in place before sending the application off.

  12. Let me get this straight...

    Your husband signed an affidavit of support, but he has no income. His parents support him and claim his as a dependent on their taxes, so his parents also submitted an affidavit of support. Does this mean BOTH of his parents signed an affidavit of support? Did they sign an I-864 or an I-864A?

    But you say his parent's income isn't enough, so you ALSO got a joint sponsor, is this correct?

    I think you made a mess of the affidavit of support requirements. There was no point in his parent's submitting an affidavit of support if they did not have sufficient income to sponsor. Even if they did, one of them would have needed to submit an I-864 and the other would have needed to submit an I-864A. They couldn't both submit an I-864 - an immigrant may have only one joint sponsor - and they couldn't both submit an I-864A in support of your husband's I-864 because HE is THEIR dependent, and not the other way around.

    If your joint sponsor's income was sufficient then the only thing you should have submitted was an I-864 from your husband and an I-864 from your joint sponsor, along with the required supporting evidence.

    This is what I was thinking, too many I-864's submitted...and the beneficiary not having on hand the supporting documentation (the W-2s from the joint sponsor) could certainly result in the outcome described. With USCIS it really doesn't matter that you already sent in the material, or that you provided it previously. You must always be prepared to show them whatever document whenever they ask for it...telling them that you don't have it will elicit grumpiness from them. OP, it sounds like you will be sent an RFE specifically requesting the supporting documentation of the joint-sponsor. Good luck.

  13. The child's claim to US citizenship has already been processed and approved. They have the CRBA and the child has a US passport. It's not at all unusual for a consulate to ask for a DNA test as a requirement before approving a CRBA. It's highly unusual for USCIS to resurrect a citizenship claim that's already been approved and ask for a DNA test unless they have a strong suspicion that the CRBA should not have been approved.

    Whether there will be a Stokes interview is anybody's guess. If the DNA test doesn't confirm paternity then that's the end of the case. The AOS will be denied, the applicant will be banned for material misrepresentation, and the child's US citizenship will be revoked. If the DNA test confirms paternity then they might go ahead and approve the AOS without any further interview, or they might not. I agree with Vanessa - the fact that the first interview was rough indicates they are very suspicious.

    But that 'strong' suspicion may have arisen if the father was not present at the birth and therefore did not sign the birth certificate. I don't know, but is the father's signature on the birth certificate a necessary component of getting a child's CRBA approved? In this case the OP states that her husband completed an affidavit attesting to the child's paternity which is what was used to apply for the CRBA, not that his signature is present on the birth certificate. That may very well be the reason USCIS has become unnecessarily suspicious and asking for the DNA test.

  15. She will need to show STRONG TIES to Ukraine, such as a very good paying job, owning a profitable business or some other reason she would be compelled to return and stupid not to. I have heard that people of retirement age have a somewhat easier time of it, but cannot confirm that.

    I have also heard this and can't quite figure out the reasoning why this is true. A retiree/pensioner, IMO, has less ties to home country than someone who is employed, especially if the reason for their visit is familial, i.e. coming to visit children or grandchildren. I can't see why pensions, while decent for some (though for most are less than what a regular income would be) more of a strong tie, than a job. I guess the thought process is that an older individual would not as easily emigrate and start 'all over' as someone who is younger? Still doesn't make sense to me....

  16. Have you tried to call the consulate, or honorary consulate of Colombia in your city. They may be able to provide you with a name,or put you in touch with a reputable interpreter for such an occasion. As for fees...my sister has done interpreting and the charges are done by the hour of service provided. You should do a little research on the net to get an idea of what the current fees are for interpreting...the rate charged may also depend on the language in question. good luck

If she is living in Spain on an expired visa, she may not be able to avail herself to interviewing (for whatever visa it ends up being, whether a fiancee K-1 or spousal K-3/IR-1) at the US consulate in Spain. She may have to renew her residency in Spain, or return to the home country and interview there. Definitely something that needs to be researched before any us petition is filed as you would have to list on that the country where the eventual visa interview will take place. It can be more problematic to change 'venue' (so to speak) in mid processing. Good luck.

    Minya, yes, i've heard of the beans. Here is my question: Did it leave any scars? Or say, if it was done to excess, could it leave scarring. Was it something specific from your parents' culture, or just their method.

    Sorry for so many questions. i'm working on a story here, just trying to get the details in my mind. (If it is too painful to remember or write about, i will totally understand.)

    Not it did/does not leave any scars....it is really just for a few minutes, like a time-out type of thing. There were other kids who had they same type of punishment when I was growing up, though I don't think it was a cultural thing....unless you count that my parents used beans instead of rice, since that is what they had more of on hand. :) What I described was really just a method to give me a 'pause' and to force me to think of my bad behavior. IMO, much more effective than being spanked. My parents did not use physical forms of punishment like spanking...but that was used on other kids around me. It was just the way parenting was done then. And in fact, it still is in that part of the world...there isn't the same type of social stigma as here, about physical punishment. Of course it is not taken to extremes, but parents there have no qualms about swatting a child on the backside once or twice if they misbehave. Its just the way they parent, and none of the kids grow up with scars, emotional or otherwise...just a good respect for the parents and adults in general. IMO, that is lacking in the youth of today. I should qualify that I'm not a parent, so I don't have tangible experience, just observations.

  19. Its the same as the "time-out" idea...when I was a kid, about 7-9, it was kneeling on beans (a bag of dried beans). It was never for too long...usually like 5-10 minutes, just long enough to contemplate the error of my ways. I don't think that its cruel....just another form of demonstrating to a child that there are consequences to bad behavior...especially bad behavior after it was repeatedly pointed out as such and I still didn't correct it.
