  2. QUOTE (krisahmiah @ Jan 2 2008, 04:41 PM) Hello,Good day to all.

My question is this my 1-94 expired last Nov 14,2007.

    And married last Nov.10,2007.

My question is this, what is my status now?

Can I file my AOS this month?

I am worried ifI will encounter problems in the immigration because my 1-94 already expired

I need your advice in this matter.Thank you

    Hello,

First what type of Visa you got when you entered the USA? If you got K1 visa which is fiance visa, you have to marry your citizen husband to be with in 90 days of your entry and it is recommended for you to file your AOS as soon as possible after the official wedding. Your status is still non immigrant, there will be no problem in regards to expired I-94 as long as you got married with in 90 days from your arrival. Even if you are married your status still not LPR or CPR because your AOS is not yet done.

I myself arrived on May 8, 2007 and got married July 14, 2007 , then filed my AOS July 26, 2007 and my I-94 expired on Aug 8, 2007.

While my AOS is in process of course I can't fly outside the USA. My status now I believed is still not legal permanent resident but I don't have problem in regards to immigration because they got my biometric and case in file active. I can fly in different state also using my expired I-94.

Hope this will help you. File your AOS asap. Good Luck

Still Waiting for my Green Card and EAD

  3. Hello my fellow VJERS,

Hi everybody! I need some advice from you guys regarding K-2 VISA requirements, rules, guidelines and procedure. This is our situation, my husband ( U.S Citizen ) and I ( Adjustment of Status in process ) have plan to bring my daughter from the Philippines here with us. Assuming her visa is approved, got in the USA and be able to changed her status to permanent residence or green card holder, is she can fly back and forth to the Philippines? do we need to request for permit for her to study in the Philippines holding green card as our dependent then come back in the USA every end of school year? Basically we want her to stay with us here during summer every year but we wanted her to continue study in the Phillipines. Please if you had the same experience that we have right now, I will be happy to hear from you. Thanks a lot and advance Merry X-mas. :star:

  8. Hi,

I-134 or the Affidavit of Support must be send to your fiance before the Interview date at the USE. this is at the last phase after your fiance got her K-Packet. So you dont have to send it together with the I-129f. I just got my I-134 last week from my husband to be and my interview will be on April 4, 2007 and got finished with my medical too at St. Luke's so dont worry if you just starting to file your I-129f your still have loong way to go before they will ask about the I-134. Well I think that NVC and the other Center have the same procedure.

Hope this may help and enllighten you.

    Chona and William
