  1. We have been using my wife’s married name for all the petition and visa 
    process so far. The interview letter is also in the married name.

    My wife planned on doing her medical exam with her maiden name passport this 
    week. We should be receiving her new updated passport (in married name) in the week following the medical and will have this for the interview.

    If the medical exam paperwork is in the maiden name, will we 
    still be allowed to use the updated married name passport for the interview 
    and visa issuance? The goal is to have the visa in married name. 

     

    Based on everything I've found, it appears it should be fine. I understand that visa's are issued in the name of valid passport at interview time, just not sure if the medical being in maiden name will cause any issues.

I was able to DCF in Mexico on a tourist visa, but I had been living there full time for 4 years. Mexico allows visa runs, so to renew my visa I simply had to leave and re-enter the country.

     

    Once I learned about DCF I contacted the USCIS field office in Mexico City and they told me that I likely qualified. It was easy for me to prove that I resided in Mexico as I had built a life over 4 years. I had a lease, bills, passport entry stamps, etc.

    Thanks for the info. I did contact the Manila field office and they gave me some general guidelines like being in the Philippines for 6 months or longer and then the link you sent. I need to travel back to the US soon for a couple weeks so I'll be reaching out to them again to see if that will cause any problems. I read that leaving and coming back may not cause issue as long as its not a move, but I'll seek clarificaiton.

     

    Currently I've been in PH without leaving for longer than 6 months.

  3. I'm also in Manila and was about to file a K1 but I hopefully have stumbled upon a good thing here. I've been in the Philippines for 6+ months on a tourist visa. My fiancé and I both live together and both our on the lease. 

    I read conflicting information on whether I qualify for the DCF. Can anyone point me to the requirements for DCF?

    If I'm eligible I'll go the HK route for marriage and get this thing started.

  4. I'm looking to file the K1 petition soon. Me and my fiancé have 1 newborn child together. Child is entitled to US Citizenship at birth, CRBA and DS11 I'm about to file this week.

     

    Question is, the i129F asks if we have children, of course we will answer yes, however the concern is this will trigger USCIS to send request for K2 for the child. I intend to explain in my packet in detail that the child will already have a passport and does not require a K2, but I"m not sure if it will get overlooked and still cause delays.

    Anyone have experience with this and can comment? I am trying to prevent having to wait until the CRBA/Passport for the child is done before starting the long K1 process.
     

  5. I’ve been trying to get some clarification on this for a while and hoping someone can provide some help. I posted a similar topic but didn’t get the clarification I’m looking for.

    I’ve been overseas for 7 months. My US Residence is my parents address. I’m currently physically located overseas as a tourist visiting my daughter.

     

    Parts on i129F I’m struggling with:

    Part 1, Your Mailing Address
    8.j. - Is your current mailing address the same as your physical address?



    Part 1, Your address history
    9.a. Provide your physical addresses for the last five years, whether inside or outside the United States. Provide your current address first if it is different from your mailing address in Item Numbers 8.a. - 8.i. 

     


    My physical location currently is overseas for the past 7 months but I have a US residence with my parents. My mailing address is also my parents. If I answer NO to question 8.j. then I’ll need to provide my current address in 9.a. which brings me to my concern. If I put my overseas address as Current address, my address will not match that of Part 2, Beneficiary Intends to Live 45.a. The address I’ll populate for 45.a. will be my parents address.

     

    My address overseas is not permanent and I’m considered a tourist in current country. Just trying to clarify what would be best to prevent an RFE.

    As far as your license, I don't think you'll have a problem since your ID documents would be either your passport or birth certificate. 

    I don’t think I ever lost domicile which is why I’m looking for clarification. Everything  (tax, bank accounts, etc) on paper is my parents address. That’s were I’ll live when I return, with my fiancé. Been gone only 6 months. Everything I’ve read about establishing domicile, seems as I never lost it, however with the k1 im not sure if they want to dictate were I can live with my fiancé. 

  7. Beneficiary’s passport expires first part of next year. It takes a while to renew the passport in the beneficiary’s country so we want to go ahead and submit the I-129F form with the current passport. I’m aware that when we end up traveling to the US the passport will need at least 6 months validity and by that time we will have the new passport already.

    My question is if we use the current passport on the application (which expires first of 2019), will this cause complications later? I would think we could submit the application and then go renew the passport within the next month afterwards. I also figured that if we renewed the passport before the application then they would not get to see the old passport which would have all the entry/exit stamps with proof of our travels together. I did find some similar posts but didn’t think it was specifically this situation.

  8. I've been temporarily overseas for about 6 months and have had a couple addresses here already. I don't really consider myself as a resident here, I"m on a tourist visa and only here to visit my daughter. I still work for a US company remotely, pay US taxes and on paper it looks like I'm still in the US. All my mail is going to the US etc.

    However while I've been here I’ve had to sign lease agreements etc. for places to stay.

    Should I include these overseas addresses in my petition? I was thinking I should since they will see my passport entry. Previously I've been in the US my entire life.

  9. I moved from one state to another and before I changed my DL to the new state I went overseas and have been overseas ever since for about 6 months. My new US residence and all my mail, bank statements and everything is my parents address in the new state. This is also the address I’ll use on the I-129F, as well as the address I’ll put down as where we will reside when coming to the US. Of course this is temporary for a couple weeks while I get a place, since I’ve been out of country for a while (still am out of country). But I have to put down an address to get the application started.

     

    Does anyone see a problem with this? I.E. US questioning my out of state license or the residing address?
