what did you decide? we're in the same boat, but also can't leave Australia without permission...which we have applied for.  so stressful and difficult right now

My husband found a job so we flew last week and my visa got endorsed. If things hadn’t worked out that way, I think we would have flown just to get the visa endorsed and then back to France to await better days.

In the US, we don't "register addresses".  Either you enter before the visa expires or you have it re-issued.  If you can arrange travel, option one is "certain".  Option 2 is not certain.  If successful the timing would be difficult to predict.  Tough situation.  Difficult decision.

    Thanks.
Could I enter before the visa expires, while my husband (who’s the US citizen) stays in Germany with our kids? That way my visa would be stamped. I would then turn around and fly back to Germany the next day, where we would await better days to move for good.
Or does my husband have to be in the US or with me when I’m at the PoE?

The card could be mailed at his sister’s. That’s the address we gave in the visa application.

  3. Hi everyone.
I have an IR1 visa issued from the consulate in Germany. Expiration date is in June. We were supposed to leave Germany and enter the US early May but, well, it looks like we won’t. As we’re not sure we’ll even be able to make it prior to the expiration date, we’re trying to think of all our options. We don’t want to move and try to find jobs there until the situation cleared out a bit.

    1) Entering and leaving: as my husband was living in Germany with me, he has to have relocated his residence to the US at the latest at the time I activate my visa, correct? What does it mean concretely, to relocate his residence? Could we both fly to the US together, spend one day there and fly back? Or does he have to get registered at an address before I’m allowed to leave the country?

    2) Reissuing the visa: What if the visa expires before we’re able to fly, do I have to start the whole process? Send the whole application? Or only the medical? What about the interview?

if anyone has any other piece of advice, I’m all ears.

    thanks!

Oh, Thanks for the update! I'm impressed you got through to someone. I talked with one man who very quickly put me through to the voicemail 😂 but good to know why it's moving slowly, hopefully the rest of the process goes a bit faster!

My husband wrote an email to the USCIS Frankfurt address and the reply actually came quite fast.

Would you let me know when you hear anything back? Since you filed a bit earlier than us that would give us an idea when to expect to hear something.

Any news? We just filed 4 weeks ago, but was hoping to receive the NOA2 shortly :/. I have an appointment for my medical on 1st of August, so I will better reschedule. I have read somewhere, that it has to take place no more than 30 days prior the interview.

No news other than what I wrote above: we’ve asked for a status update, they said they’re still processing our case and processing time is currently longer than 90 days.

Hi just wanted to let you know, we have the same situation. Sent the petition mid April and received the check receipt shortly after.. Nothing since then

Thanks, it’s good to know we’re not an exception! In the meantime we contacted them and they said our case is being processed and that processing time is 90 days and currently even a bit more than that due to low staffing.

You will never get a "NOA" of any type since it is not being processed stateside.   Our receipt number started with IOE and was not trackable.

I've always recommend getting an InfoPass appointment and submitting the petition in person.   The USCIS staff reviewed our front loaded petition.

I see that Frankfurt is taking two months for processing.  https://egov.uscis.gov/processing-times/international-operations-office

I would wait another 2 weeks and contact them.

Also in a DCF you need to take everything with you that would have been submitted to the NVC.   Any packets you will get in the mail will probably be missing this key reminder.

Thanks for the advice! This is all so confusing.

You mean I should take the NVC documents with me at the appointment in Frankfurt? Is there a reliable list of these documents somewhere?

  8. Hello!

I'm French, my husband is a US-citizen and we've been living in Germany for 6 years. We sent our documents for I-130 to Frankfurt on 15 May. So far we've only received a Record of Fees but heard nothing else from Frankfurt. Weren't we supposed to receive a NOA1 relatively quickly after filing? Should we be worried that we didn't? As the embassy website says not to contact them until the 90 days are up, we haven't asked them directly yet.

We're planning on moving to the States early 2020 so we're starting to be a bit worried that it might not work out.

  9. Hello all!

My husband (US citizen) and I (French citizen) (we have both been living in Germany for 5 years) are just starting our visa journey. We are considering moving to the US sometime within the next 2 years (probably late 2019 / early 2020).

I have taken note of the process for filing for I-130 directly in Frankfurt and it seems all clear to me. However I am bit struggling with the timeline we should follow considering our plans - especially since the IR1 is only valid for 6 months.

What I am wondering is: how long is the I-130 valid? Does it make sense to file now if we don't plan on moving to the States for another 18 months?

I'd be super grateful for any tips!

    Best,
    C.
