  1. Hi all,

seeking for some help here. we starting the AOS process and my wife didn't get any Vaccine done during Medical exam, so we will have to do it here in the U.S. we know she probabaly has some of the shots taken already in the past, but has no way to prove it(can't find the record).

wondering if anyone had similar experience and what are the options? shall we take all of them again? would there be side effects of doing it twice?

I searched in the forum and someone said a blood test can validate of one has already had the vaccines, do we have to do the blood test by the Civil Surgeons listed on line, or it can be any lab facilities. have you done the similar? please share

also, did anyone have the expense covered by their insurance company?

    Thanks in advance

  2. Hi,

I am in process of completing I-134 and want to seek advise on Question #10,

    * I have Submitted a visa petition(s) to U.S Citizenship and Immigration Services(USCIS) on behalf of the following person(s)

I reviewed the sample on visajouney and I am a bit confused. is the question asking for the name of the person you apllying now? or the name of the person you previously applied?

    Thanks for your help

  3. Ok, I called and went to the congressman's office today as well. I walked out with a feeling that they not gonna help that much. the guy didn't ask anything about my case, and soon as he heard it's under administrative review/processing, he said there is not really much we can do, but I will try to reach out to them. he said he had encountered couple of cases like that, and I asked him how did it go. He said the only case he dealt with, it took the person 2,3 months to get cleared out. I don't feel that he will try hard for my case.

Turboguy, please keep me updated with your process, I would love to know how your congressman were able to offer.

    good luck

Yes, I went there Friday. I was very pleased with the meeting. He asked me every question you could imagine and then said he could not understand any reason it should be in A/R. He said he could not promise anything except that he would work very hard to get as much information as he could and to work hard to try his best to get it out of A/R and moving.
  4. alright, updates from me, they told me that It is now going through Administrative processing , I asked them that last time I was told it's under administrative review. she replied:" it is the same thing" ......... she said it's out our nvc's control and she doesn't even know which agency is involved in this. 55555555555555555 damn

Thanks for explaining it to me. I was mostly just curious since so far it does not apply to me. I do apprecaite the information.
  5. Turboguy, we should contact congressman ASAP. someone from past experience have told me that it can be helpful to a extent that we can find out where the case is. NVC will have no idea now and it's FBI who are checking on all these things. the congressman can get response to FBI, although it will not speed up the AR process, but it will make sure that the case is not lost and make sure that someone will be working on it. I am going to pay a personal visit to the congressman office next week. it shouldn't hurt us to do so, so let's proceed with that and wait for the luck.

NY Girl, an administrative review as near as I can tell is when something signals them that they need to look at an application closer. It may be the name is the same as someone who has created a problem or something to do with a prior problem such as wanting to check on a previous visa. I don't think anyone knows all the answers. It seems like it can come at any stage, whenever they find somethng that they think might be a red flag. Mine & Bins came at NVC. Omoba's came after the interview.

After you get your NOA-2 the regional center sends it to NVC. There it is assigned a case number based on the Embassy you will be using and the date it was processed. They then forward all the files for each embassy directly to the Embassy. The Embassy then of course arranges the interviews.

Sorry but after consulting with a few immigration lawyers, I found that the congressman can't influence the administrative processing much at all since it's an out of country issue. Pretty much the consulate has the final say and they seem to take however long they want to with AP process.

Sadly enough, there's no real way that you can speed up AP process especially with CP (AOS is different but I think that it can be more influenced). Found that out the hard way.

Is that also true is the application has never left the country. I can see if the ap is at the foreign embassy but in my case and Bins case we were early in the procedure and ours went from the regional center where it was approved to NVC where they put it in A/R and sent it to Washington? Just curious if you have any thoughts.

That is correct. If your A/P moves to the NVC within the States, then the congressman approach may help although this isn't too surefire. The toughest thing is trying to track down where the application is. For example, the diversity lottery case I'm working with is at the embassy itself so no US legal method can be useful here. It's a wait and see. However, if it got sent to Washington then it would be a better shot.

Of course, the worst thing is when you call up and get a 222(F) which is bad! They can be rather private on a ton of things! :(

  6. here is what I got from them.....

    Good Morning,

Your inquiry has been received at the NVC. The non-immigrant visa petition you mentioned in your letter has already been entered into our computer system and assigned the case number listed above.

As part of the aftermath of the events of September 11, 2001, there are additional security check requirements for visa applicants. While it is not possible to predict when the clearances for this case will be finished by all involved Washington agencies, please be assured that as soon as the results are received, the case file will be forwarded to the appropriate US Embassy or Consulate General.

    Regards,

    National Visa Center

If we are not out of A/R in the next month I am moving there myself. I can't say I have much desire to live in the middle of Sibera but I also don't feel like being away from her either. I can live there and come back once a month for a week or 10 days to renew my visa and run my business. The whole A/R thing is stupid. Neither one of us has anything they should need to review and I am sure you don't either.
  7. that's sure ture , you can't really plan on anything since you don't when it's coming. I am going back to China and live with her if it's not approved within half year. we will have kids there and everything, then I hope they will believe it's not a fraud or anything that they are investigating. hopefully, I am preparing for the worst of the worst, but aren't nobody breaking up this relationship..... keep going guys, hope we will be out soon...... I wish the NVC people read the posting here sometimes and understanding the suffering souls in this forum..

I have to say it really is a bad situation to be in. It is sort of a feeling like being in a hospital with two broken legs and two broken arms. All you can do is lay there and wait. You have no idea if it will be next week, next month, next year or next decade. Even if they said we are going to have you in A/R for two years then I would think about moving where she is so we could be together. I hope that we all get good news soon.
  8. right here with you :) , will contact congressman after 2 weeks, i just can't wait..... it's rueling all of our plans..

I am just curious how many others find themselves in that big black hole called Administrative Review, how long you have been sitting there and what courses of action you have been taking?

Mine has been there for 6 weeks. I am giving it 4 more and then going to contact my congresman's immigration specialist to see if they can help. I know of no reason for it. It is the second K-1 for both me and my fiancee (not to the same person). I am guessing they are checking to see what happened on her last K-1 which she stayed here for 30 days and returned home well ahead of the 90 day period she was allowed. Other than that we have a clean slate.

  9. This is a computer batch work. what happens is that cases are being approved during the day, but computer system will send out emails at 5PM to all the applicants who's cases are approved during that day.

Just a general observation, but I notice that most people seem to get a their NOA2's towards the end of the business day... (5pm ET)

However, is this just because this is the time people come back from work or is this when USCIS posts the actual change? I know touches are updated there and then... but not neccessarily any change to the case.

I can't remember anyone getting notice during the day... Can anyone correct me?

    I wonder the same thing...

  10. I called couple of times already and also got the NVC case number, but I guess I will have to go through the administrative review, oh god..... I just can't believe this. after reading all the post about AR, I am just deperessed to death, after the long waiting NOA2, now is the administrative review, when will that end?????????????????????? f***

  11. Thanks for the reply. they told me that some department in Washington is checking it as well, I don't know why, but she said it's for the new homeland security regulations for something. my cases was recieved on 2/2/2007. and the person did tell me that it is under ADMINISTRATIVE REVIEW. what exactly does it mean, can you please explain?????? thank you

    MMARLO,

I have been waiting for 6 weeks already and getting very nervous about it. I called them today and they said it's been processed at washington and waiting for a response. they do have a case number for me though, How do you determine if the case has been screwed up. I don't wanna to bother the congressman until it's necessary. :)

    Thanks

I don't understand what you mean when you say "it's been processed at washington". The NVC is in New Hampshire. I don't know what Washington has to do with it. If you were given a new NVC case number that is good; it means the NVC has at least done the initial processing on the petition. So then the question is why it hasn't been sent on to the US Embassy yet. I hope you are not under administrative review. If it is, you could be in for a long wait, and you should get your congressman involved. Did they say when the NVC received your approved petition? I hope it won't be long for you! Good luck.

  12. MMARLO,

I have been waiting for 6 weeks already and getting very nervous about it. I called them today and they said it's been processed at washington and waiting for a response. they do have a case number for me though, How do you determine if the case has been screwed up. Thanks

First, for K-1 visas, do not bother with the automated system. They do not put our status on there, so it will always say that the NVC has no record of your application. You have to talk to an operator to actually find anything out. Most people should find out within a month that their approved petition was received and then forwarded to the US Embassy. If that's the case, get your NVC case number and ask what day it was sent. This will help you find out if the US Embassy has received the file or not. In my case, my fiancee was able to use the case number to pick up her Packet 3 and Packet 4 materials directly from the Embassy.

Second, if it has been more than six weeks and the NVC still hasn't received your approved petition. They'll probably just tell you to contact USCIS, and USCIS will give you the run around. You might eventually get them to put a trace on your petition through your service center, but then they'll tell you that it will be up to 45 days before you hear anything. What you should do after six weeks is contact your congressmen and get them involved. You'll probably find that your case gets a touch and within a couple days is back on track for processing at the NVC. This is what happened to me.

  13. following is pulled off from the guide in visajourney.com. I tried to call them. just like other said, you have to talk to a live person to find out your case. mine has been over 6 weeks, but still no answer. hope you all good luck

"Two weeks after you receive the NOA2 you can contact the NVC to see if they have received your approved I-129F. You can contact them at 603 334-0700. Their homepage is here. Welcome to the US Department of State! Things move much faster now :).

  14. I wouldn't use it at all. Everytime I made a mistake I'd just start fresh on a new form.

Its not an issue of fixing a mistake on a form I can reprint. Its a mistake my fiance made on his g325a, which he already signed. So given what folks are saying, I will probably cross it out and initial it OR wait until he sends a corrected form with his signature.

I will probably wait on the corrected form. it will take couple of days for you to get it. once you sent out, you will not have control of it , so better to make things as perfect as you can. just my opinion.

also, try to have him print out bank forms with singnature from now on , that will help to save time.

  15. Ok Ok, I know it's probably not a big deal, but after months of silence it's definitely a relief to know my case isn't lost. Yip-eeee

Buddy you are close. most likely you should have an approval. check back around 10:00PM EST. their batch seems to kick off at that time and you should expect emails and status changes.

  16. Hi everyone,

I'm nervous but excited! I have my packet ready to roll...I have to say I did I pretty good job (I hope :innocent: )

I should know this, but my mind is at a blank right now. I will be sending to the Vermont Service Center - to eventually be sent to Amman. What's the best route to send via postal service. (Certified, Signature Guaranteed, etc???).

    I really appreciate your help.

    thanks!

I don't have an answer for you because our lawyer sent everything off. However, I just wanted to wish you luck! ;-)

UPS is a good way to go. congrads on your first move and I believe you have started good since you are file to VSC. I hope you will see an NOA2 within a short period of time.
