  1. Yes! WOM has nothing to do with your actual case. 
    Its just requesting the court system to render a final decision. To do that AG reaches out to get details and updates from the consulates. The decision is not favorable or biased against you. It’s just means to get the case processing to a final decision be it may whatever. In my case it was already approved and sitting until the AG reached out to inquire for the lawsuit. If you are stuck chances are you aren’t reaching to the right individuals or agencies to look into this matter. With a lawsuit it really gets the ball rolling. Best decision I took in my life after researching, following this forum in stealth and spending nights worrying. Go with a lawyer on a monthly plan if cost is an issue and such an option is available to you. Good luck all! 
     

  2. Hi, I had my interview at the Montreal consulate in October 2018 for CR1. I was told I was approved passport kept and given a welcome to US paper, but after leaving the consulate same day I was sent an email for form DS 5335. I was put into administrative processing. After checking with a friend of mine who worked for Uscis he advised me that if you are born in certain countries ex. Pakistan, male between the ages of 18-65 there is a high chance of being placed in administrative processing. Even though I’m a Canadian and only have a Canadian passport. He advised back then that I should file a writ but I was hopeful that it would be resolved. March 2020 we filed a writ but due covid-19 happened and the Montreal embassy was closed. Finally when the embassy opened in August I was able to get to get the case moving. 
    Finally after all the nightmare I was able to come to the US in November 2020 on an IR-1.

    My suggestion is that if you are in administrative processing for over 1 year please file a writ. I used kuck Baxter law firm. They are on the high end but for some money maybe an issue. For me too it was the same but I figured it’s a small price to have peace of mind and I don’t regret it. I paid 5000 USD total. 

  3. You can call NVC virtually anytime. 

    603 334 0700 option 7 and speak with rep.

    Give them your I-130 file number. Ex. Starting with Src or wherever the location your I-130 got approved.

    Average time for Uscis to Nvc is 2 weeks to a month average time being 3 weeks.

    NVC takes average 3 weeks to 6 weeks to assign number for Aos payment and IV fee.

    One week average to unlock the DS260.

    Then another 60 days or less if no errors for your to get embassy date.
