  1. I am having problem filling the part 5, Sponsor's Household Size, of I-864. I had put one under the option G since my father-in-law was gonna combine his income with my husband but today my father-in-law got fired from his job. Now my future mother-in-law agree on combining the income with my husband but now I dunno what i should put in the Option G since she has a kid herself and should I include my father-in-law in the Option G too?

A Canadian citizen who crosses the border as a 'normal' visitor is not issued an I-94 enter/exit visa unless he or she is using some sort of other US issued visa/permit such as a B-1 visa that is issued by the Consulate to apply for entry. Just showing up at the border for admission and being allowed to cross the border as a Canadian does not require a visa. This is a special agreement enjoyed by Canadians and Americans entering each other's countries. It is NOT a visa-waiver program. So, if you entered the US as a temporary visitor not intending to stay, fell in love with an American and got married and decided to stay after all, you will not have an I-94 - nor will you be able to obtain one by filing an I-102 because that is to replace a lost I-94 - and as there was never one issued, it cannot be replaced. As a Canadian applying for an AOS you will not be denied due to the lack of an I-94 since Canadians, as general visitors, are not issued I-94s. You just need to do as other Canadians who have been through the process suggest - write: n/a Canadian citizen - no I-94 issued - and you will be fine.

    I entered USA as K-1 Visa from Canada not visitor so is it the same?

  3. So from what I am reading does that mean I can file AOS without I-94 as long I just put N/A-Canadian Citizen? Because I wasn't issue an I-94 form when I entered LA from Vancouver, BC and now almost everything I need to apply need a I-94 number. I tried applying for I-102 which cost me $320 but I got a letter from USCIS saying they are not able to issue the I-94 because the entry stamp on my passport shows that i was admitted into US by the Bureau of Customs and Border Portection and I should direct this inquiry to CBP thru their website. And when I went to CBP website it shows that I need to file I-102 so right now I am stuck I have no idea how do i go about applying AOS. Thank you so much in advance for any reply.

    to my understanding , there is realy no timelimite to when you have to file AOS , as long you you can prove you got married within 90 days of entry with K1 ( if you are K1 , sorry dont know what a I 102 is , but with k1 I know they issue a I 94 when they process the K1 and stable it inside the passport )

    as to the SS# you can aply 2 weeks after entry or after the marriage thats up to you , its not needed to apply for AOS, EAD or AP good luck

    Thank You. I-102 is application for replacement/initial form I-94 since I didn't receive it at POE so I had to apply to get one.

I am just wondering the form I-94 that was mentioned was it a paper showing the date I entered and expiration date? because I didnt' receive any paper from POE I only have a stamp on my passport from Department of Homeland Security it say class K-1 until Dec 13, 2008. Is there any way to get the form I-94 since i am in USA now? or I can just show them my passport when I apply for SSN?

    If i only wire below 10,000 each transaction but the total amount that i transfer over time are still over 10,000 isn't it or they only care about each transaction?

    and also when i am at POE i know they would ask if i am bringing monetary over 10,000 do i say no or yes as it doesn't count as i am bringing it with me since i already wired it to my fiance's account??

    also my fiance told me that the bank would flag it if the bank amount is over 10,000 since we are deciding to put it in CDs is that true?

    Please see my previous post. Also, you only declare the amount over 10k if it is on your person at POE. Anything wired separately is not declared. During a wire transfer, the financial institutions involved in the transfer will verify that you and, residually, themselves are not involved in fraudulent activity. There is no need to be concerned with any transaction over 10k unless it is associated with criminal activity.

    It went ok.. I got my visa today ^^ now it's time to stress about how can i bring my saving to USA without being taxed :/

    Congratulations on the visa! When did you end up getting the visa? The same day or the day after? Did you ask them about the Xpress envelope?

    I went and picked it up next day at 2:00 because I had my interview at 1 and it finished around 3. fyi I had to line up with other ppl that is picking up visa as the security said so i wait till 2:30.

    After the interview another officer did ask me do i want to pick it up or .. well i just say I will pick it up I didn't let her finish :/ so i am not sure if they mail it out too >< sry

  9. Not sure on the taxing thing. One shouldnt get taxed on it, as canada/USA do have tax treaties. I was told by Cdn and USA bank managers that any amount over $10,000 sets off alarms, checking for fraudulent $$ transactions, etc! When I transferred over large portions of $$$ with Customhouse, I ensured I kept the amount below $10,000. I would just make multiple transactions. Of course that money is now in retirement style accounts, so it is or will eventually be taxed. In these cases, when transferring large amounts of $$$$, might be best to consult with an accountant who deals with these sort of issues. One could ask that question on here http://forums.serbinski.com/ they deal with these and other tax situations!! One could even hire their services! I do recall 1 member who used them, and that person ran into problems with either the USa or cdn tax people, and they stated Serbinski didnt back them up, needless to say they were not happy with their services!! But the forum is free.

  11. I am just wondering did anyone that have interview in Vancouver bring Xpress Mailer?? as on my interview letter they didn't ask me to bring it. My interview appointment is at 1:00 PM is it better for me to bring just in case?

    on top it has royal canadidan mounted poilice then beside it canadian police certificate for visa applicants/foreign travel/froeign work permits

    then my name my dob and my address and he asked me to sign under this box it has in small print this certifies taht a search, based on the above name and date of birth, failed to disclose any such person with a record of criminal convicitions in the national repository for criminmal records in Canada. "SEARC NOT CONFIRMED BY FINGERPRINTS"

    then issued at and the name of the rcmp

I got my police certificate but it's basically a paper and with my name and the RCMP branch i got it but he did tell me i am clean cuz nothing came up on the paper.. but on the guide thread it say that on the police certificate it should have "nothing" on it.. do i really need that or every country is different???

  14. I am just wondering how long does my case stay valid after i receive my package 3 which was received at the beginning of september. I read a post and it say 4 months after NOA2 but I dunno exact date my fiance got it. My fiance had told me not to keep going with this process after a huge fight btwn him and me so he had stop gettig all the documents we need and I had delayed my medial appointment. but his dad told me to try to keep fiancee visa valid and hold it since it might be that he is just being cold feet we dunno. And I really still want this to work btwn me and him so is there anyway to keep the case vaild till that he changed his mind?

  15. I am just wondering how do we make appointment with Dr. Morgan Medical Office or do we just go there on wednesday morning. I tried calling them but it keeps going to answer machine and I left a msg but never get any reply back. And now i won't be able to know what day to ask for day off. (I know this has nothing to do with the charges with Medical Dr. Morgan.)

  16. This is regarding my fiance's employer letter. He works in Chuck E. Cheese and he had his General Manager typed up a letter saying he is working in Chuck E. Cheese but the thing is they don't send out letter that often like corporate to keep business stationery in their branch office. So his General Manager has his business card stapled on the letter. I am just wondering will it work? or that he has to have his General Manager request for letterhead from corporate office.

  17. Just wondering has anyone encounter that NVC has send ur case to the US Embassy in wrong country.

    NVC had send my case to US Embassy in Taiwan instead of Embassy in Vancouver, Canada which my fiance put on the I-129F. My fiance called about two months ago and they said because the one that was inputing had put my birth country instead of the place I am living now. NVC said they had telegram the Embassy in Taiwan to send the case to Vancouver, Canada. I tried emailing the embassy in Taiwan to see if they have done it but I haven't gotten any reply. Therefore, I sent a email to US Embassy in Canada they say they haven't receive it yet. So I am wondering does anyone know how long does it usually take

    Not to alarm you, but this is a significant problem. I suggest you contact NVC pronto and request a supervisor to manage this issue. I am sure it has happened before, but you need someone of authority to "shepherd" your case to the appropriate Embassy. Call them tomorrow.

    My fiance did and they did give the case to a supervisor but then the supervisor told my fiance that they had send a telegram to Embassy in Taiwan requesting to send the case to Embassy in Canada and they also say it is now in Embassy at Taiwan's hand. which is why i am trying to contact the embassy in taiwan..

    For clarity, it is not a telegram, rather a "cable", or "cable traffic". US Diplomatic presence in Taiwan is actually the "American Institute of Taiwan" (AIT), as the US Government tries to recognize Chinese control over Taiwan, although the USG supports the call for independence. Semantics really, back to topic...

    Bottom line, you are doing the right things, so give it some time to resolve. Stay in touch with NVC and hopefully you will be squared away soon.

    As an aside, I worked at the State Department for 16 years, mostly overseas and understand the inner workings somewhat.

    Stay on top of NVC.

  20. It appears that you case did get sent to Taiwan. But I have no idea why. Contact the consulate/embassy, explain the situation and see if you can get the case forwared to Vancover.

    NOA2 notices havent really been sent out on time lately. But your petition has been approved, it looks like the NVC sent the case to the wrong embassy.

    So I call NVC? or embassy in taiwan?
