If he has a 10 year ban then in the waiver your mother has to prove that it would be a hardship to her for him not to migrate. If you can't prove that then an expedite is not going to help you.     Yes, my mother is a Naturalized US Citizen.  He will also need a waiver IF he does not fulfill the 10 year bar which would be in the year 2020.  It definitely would be a hardship for her if he does not migrate as at this point she cannot even visit him due to safety concerns.  She is constantly having to send him money because he is earning little to no income.  It is taking a toll emotionally, mentally and financially.

     

    As concerns refugee status--- we did not consider this as an option as I thought the alien relative had to be presently in the US.   

     

    The goal is to get the I-130 approved and then seek an attorney to do the rest.  We just were not expecting for Nicaragua to destabilize economically and socially.  Now it has become a dire situation.  😞

Our I-130 Form was received by USCIS on 5/8/18 for my mother's husband who is Nicaraguan.  Unfortunately as of 4/18/18, Nicaragua is in complete political strife and economic crisis.  People are being killed left and right (over 400 people have been murdered) if you do not support the government and the Sandinistas.  My mother's husband has received death threats and has even been robbed.  Additionally, the utility company will shut off water services for people in his community for days at a time.  The living condition is horrendous and heartbreaking.  I want to know if anyone here has requested to expedite their I-130.  If so, how did you do it and who did you contact?  Was it approved?  Was documentation submitted?  I read that you can call USCIS but would it also be okay to e-mail?  We are desperate to get the I-130 approved so that we can move on to the next phase of the immigration process which I know will be a challenge as well.  He has a 10 year bar for the unlawful presence and subsequent deportation in 2010.  We just need to get through one hurdle at a time.  😞  Any help or advice is much appreciated!

This forum really helped me out when I was in the process of filling out the I-130 Petition for Alien Relative and the I-130a Supplemental Information for Spouse Beneficiary for my mom (USC) and her husband (Nicaraguan native) so I wanted to pay it forward.  We sent the completed and signed I-130 Petition on 5/4/18 via UPS 2nd day air.  USCIS received it on 5/8/18 and the Form I-797C, Notice of Action was issued on 5/14/18.  We received the letter today 5/18/18. Below is the letter we sent:

    I separated each section with color copy paper and number tabbed each one so everything was easy to find.  Before sending it, I made a copy of the entire packet so that I had record of everything sent.  This is just the beginning stage for us as I know from research that my mom's husband will need the i-212 Waiver (Application for Permission to Reapply for Admission into the US after Deportation or Removal) and i-601 (Application for Waiver of Grounds of Inadmissability).  I work in the legal field but unfortunately this is not my area of expertise therefore we will most likely have to hire an attorney to take over once the Petition is sent to the National Visa Center.  I will create another forum later explaining the situation and maybe I can get some advice as to how to proceed.  In any case, I hope this helps someone out there.  Many blessings to all of you who are starting or have started this.  We know how hard it is to be away from your loved ones.  :-(
