  1. Ramifications of Divorce

I certainly never thought I would be asking this question after 2 years of struggle to get my wife here, but now she wants a divorce. She has her green card as does her 18yr old son.NO,it is not because she got what she wanted,we just can't get along, different cultures, different languages ,many things are at play.In any case,is she in any danger of legal proceedings to remove her or in any way affect her status? If so,we can just separate and not divorce. I do not want her to be deported.Any ramifications that anyone knows about? thanks.

  2. blueidbill,

There are several different types of travel document that can be applied for using form I-131. What travel document is it that you have in mind?

    Yodrak

How long does it take to get a travel document and what date should I put in in reference to "intended date of travel"Is it much easier to re-enter with this document rather than a foreign passport with green card? Thanks.

I think it woul dbe a re-entry permit. My wife is convinced she be less hassled if she is coming back in with some sort of United States documnet rather than a green card and a passport from Turkey.True? NO? I really dont want to spend $170 if it is unecessary.thanks

  3. I really can't remember who said this, but the feeling seemed to be that you received less hassle at re-entry points with a travel passport(is this an "AP' THAT PEOPLE ARE QUOTING?WHAT IS AN "AP")

Never heard of anything called a "travel passport" before. Just forget about it. Passport and Green Card will get you into the USA no problem.

    officially called a "travel document" or "re-entry permit",form I-131.

  4. I had heard that it is easier to re-enter the country with a travel passport rather than a foreign(in this case Turkish) passport and a green card. No?

Who exactly told you this? Entering with a Passport and a Green Card will work fine, regardless of where the passport is from.

  5. jUST WANTED TO LET EVERYONE HERE KNOW THERE IS HOPE.MY WIFE AND SON ARE FINALLY APPROVED AFTER WAITING for AOS APPOINTMENT HERE IN Los Angeles FOR 5 months we had our interview and we are approved. The interview lasted 1 1/2 hours, which is contrary to what people had told us that it would be a few minutes.Never mind.I took all of my paperwork and I am glad i did ,I needed some copies that they "didnt have" even though we have sent it to them many times! When we went to the doctor for medical exams I had the presence of mind to ask for two sealed copies, one to mail to them and one to keep, this is what they asked for, even though I had already mailed it to them and they should have had it.also passport copies even though we had submitted that one multiple times! How does the government get by with so much dis-organization?.Keep copies of EVERYTHING!!! We had to go through a 601 waiver application from Turkey which took 1 year and 9 months and now 6 months here and it is finally over! Keep the faith, pray daily and believe,it will happen,Praise God.

  6. we are going to be moving while the aos is in progress. I am trying to avoid any confusion with address changes,Can I use a po box as a mailing address? do they frown on using someone elses" address ,say my parents to avoid changing addresses too often? I have not filed yet, but I will file after we move so we can get the interviews closer to our new home rather than our old one.any suggestions? thank you

  7. Actually, K-1, K-2, K-3, and K-4 are considered non-immigrant visas - silly, I know, since the intent is definitely there to immigrate. They are designed to allow entry to the country for a temporary period of time only and depend upon the AOS - the Adjustment of Status application - to change status from temporary non-immigrant to permanent immigrant status. The A number is the one you want - it stands for Alien number.

excuise my ignorance, but what is "noa2"?

NOA2 is the approval notice. A very important piece of paper. :)

Is this the I-797,"notice of action" where it says we have been approved for our I-129F?

  9. ON the I-485 form pg 2,part A it asks for a "non-immigrant #" which I assume we do not have one as my wife and son entered on immigrant visas (K3 /K4) and as such are immigrants, not non-immigrants.Is this correct? leave blank or say n/a?thanks

if it is a non-immigrant visa, what is the number? the "control" number in the upper right hand corner of the visa pasted in their passport? the "wac #" from the Uscis case #??

  10. The consulate in Ankara sent me an internet weblink with instructions (what will be in the packet)

and I was confused about something in it.

It states that my husband will need to bring a receipt to the interview:

RECEIPT: The fee for a K-3/K-4 visa is $100.00 per person. The fee must be deposited at any branch of FORTIS before the interview. The closest FORTIS to the Consular Section is located at Paris Caddesi, No: 34/B Kavaklidere, Ankara. Please do not send the $100 FORTIS receipt this office before your interview. You will be required to submit this receipt to this office at the time of your interview.

Does anyone know how this works? How do you deposit money for payment? Will there be a deposit slip in the packet

or a letter with bank account information?

    This is confusing to me.

    Thanks,

    Dayna

we went through Ankara and they accept cash and credit cards. I paid by a credit card.Much easier.

  11. My wife and son arrived just 3 weeks ago on a k3 visa. Now I am learning all about AOS and EAD> From this info here on this site it looks as if she needs a medical prior to sending in the I485 packet? On other posts I have seen where folks have a response sent to them for a scheduled medical exam after the application I think. I am a little confused. Can someone set me straight? I am most concerned about getting her temporary work authorization so she can get a job legally right now. I know we have to do the AOS also. IS it also $325 fro her 18 yr old son here on a K4?

    summary:

1.needs a medical prior to sending in the I485 packet?

2.medical scheduled after the application is received?

    3.getting her temporary work authorization

I-693, Medical Examination of Aliens Seeking Adjustment of Status. (If you already have this from your overseas Visa Interview submit a copy that medical check form; No fee is required in this case. If you are a K-1 fiancé(e) or K-2 dependent who had a medical examination within the past year as required for the nonimmigrant fiancé(e) visa, you only need to submit a vaccination supplement (I-693A), not the entire medical report. You may include the vaccination supplement with your adjustment of status application.)

thank you to any who may reply.

  12. I am really confused about the green card process. My wife and son recently were approved on a 601, marriage visa and they are here, praise God. I thought the green card would come in the mail but some people are telling me I have to apply.which is right ? what do i apply for and how? I was a little unprepared for this next step as we have been going through the 601 process for 1 year and 9 months.thank you very much. I am still confused.thanks.

  13. Green card should arrive in the mail with in a few weeks after arriving, the green card is employment authorization. If the POE stamped the passport with an I-551 stamp, your passport is a temporary green-card.

Wait a few weeks and go to your local SSA office and get a SS number, they will need to see the green card or I-551 stamp in passport to issue SSN card.

thanks.at the "poe"their passport was stamped with an I-94. No employment specified.

  14. My wife and son just arrived after a I-601 approval from Turkey. (took 1 year 9 months btw) I have been reading all I can and I am still confused as to what to do next. How do I get her an employment verification? green card? can she work? what exactly do we do now? From what I gather so far, the gov will send her a "welcome package " in the mail which describes what to do, but she is anxious to get started. Are there any simple explanations as to these basic questions? Thank you so much. Bill
