    You need an EAD or some other document extending your legal stay until you receive a green card.

    Correct, filing I-102 only replaces a lost card, it does not extend it. K-1s should marry and file for AOS and EAD. Don't file for EAD before AOS, that will only get you an EAD card that expires the same time as your I-94.

    Texas will accept EAD or Green-Card to apply for license.

    Thank you. I am mailing the AOS tomorrow and then I will work on the EAD. The question is still how to get an extention on the I-94? There has to be something that we can do.

    Ok, maybe I am missing something but when we tried to get a new Social Security Card and Texas ID both stated that we needed an I-94 that was not going to expire in September.

    My question is how do we get a new I-94 (filling out a I-102 but we do not meet requirements)? This is driving me nuts right now. I am not sure if filling out the AOS will do this because it really does not state that they will send us a new one or not. Do we need to go down to the local USCIS office and get a new one?

    Any help or website would really give me peace of mind. Thanks

  3. Ok, maybe I am missing something but when we tried to get a new Social Security Card and Texas ID both stated that we needed an I-94 that was not going to expire in September. :(

  4. So I sent the petitions for the K-1 visa, there was in issue. The USCIS sent my forms back and it said the application or petition cannot be accepted because the proper fee of $170.00 U.S. is not attached. Now my issue is the money order I sent was of $171.00 can I deposit this in my bank account and just write the USCIS a check? and the other is should I fill out the I-129F Petition since it has this red mark on it? I'm kind of pissed why did they make such a big deal about $1 extra :wacko:

    Use a personal check. I know that I did that and it was nice to know when they cashed it.

  5. I sent most of the originals to the service center, but it says to send the originals to my fiance now as well... I have originals of the newest information, but the other things such as the 325, and the bio info. are copies.. not sure what to do, and i need to send this asap.. grr,, thanks ,, Brian

    I agree with TimDaisy. Send what you have and make sure that your fiance has a copy of everything that you sent in.

As for your fiance she will need to do a intent to marry and the G325 (make sure that this is the 4 pager and do not copy the first page because the bottoms are different). Her phone records and pictures are proof of a relationship and are good.

    Do you know if she has the option of taking her interview in Thai? She can speak English but she thinks she would be more comfortable speaking Thai. She talked to someone who went through the interview and they told her she had the option to use either or.

    When my fiancee went for an interview last October there were both Thai and US staffs presented at the interview. You should not worry much for the interview. Be sure to follow the guideline in VJ.

    She just told me that she talked to one lady on a Thai forum that had problems with this. When she asked to do the interview in Thai, the interpreters Thai was not very good so there were many misunderstandings. They also questioned why she would want to do the interview in Thai if her fiance was American and spoke english. I guess this went around and around. She didn't tell me if the visa was granted.

    I think it is probably just best she do it in english. Can I sit in at the interview to help prevent any misunderstandings or is that not allowed?

    Yes, you can be at the interview. They can ask you question too. Understanding English helps. The interview can be in either Thai or English but if she can show that she speaks some English it will go a long way. I know that I am trying to get my fiance to speak some English but she is worried about making a fool out of herself and answering something wrong because she did not understand what what asked of her.

  7. UK - California K1 Application, NOA1 received 2/2/07. No further contact.

    Well, it is coming up to 30 days now since NOA1.

    I hope I pre-empted an RFE by submitting the correctly signed G325A for me with a covering letter marked with my receipt number and contact details.

    HOWEVER - We have the wedding all arranged for the 28th July 2007 (booked it, packed it etc), and I really dont think now that it will all come through in time - it seems to me generally to take 90 days to the day for interviews etc which would put us inside of August.

    SO - does anybody know if there is an effective way of contacting the consulate. Is it worth telling them this - I have evidence of all of the arrangements? Is there a chance of pulling forward the interview assuming all other things run smoothly?

    Otherwise, would I have to leave the USA after the wedding and sit through another 6 months of isolation awaiting a spouses Visa?

    I know that from my NOA1 to NOa2 it took almost 100 days. So from a Feb date you are looking at the begining of May to get NOA2. Then it can take a month between the NVC to the Embassy. Which is putting you at the beginning of June. Time to assemble package 3 1 week and then maybe another 2 months for an interview at the Embassy. Which now puts you well in to August. I would try to change the dates. As for speeding up the process there really isn't any way to do this. Sorry.

    Not sure what advice to give you but I am not sure how to speed up the process to make your date.

  8. Helllo everyone...

    This is my first post and I have a few questions I hope someone can help me with.

    I am planning on bringning my Thai fiance here in the near future. The K-1 visa forms and guides look very helpful. Are these forms all that I need as far as forms go? I was looking at another site (not sure if I can post that here so I won't) but they give a step by step process as well which includes samples of cover letters to include, sample letters which can be used that state we plan to marry within 90 days etc. Would it be a good idea to add these types of letters as well?

    Is there anything in the beginning that my fiance would need to give me to add to the application? She'll give me cell phone records of her calling me, pictures of us together etc. Are there any other things that may be beneficial?

    Finally, I am in the process of looking for a new job. I have a job presently but I may be made at least one, possibly two job offers in the coming weeks. Although nothing is certain, will this complicate the application process if I put down my current place of residence and employer, but during the process I move and my employer changes?

    I've noticed that according to the USCIS California Service Center's latest update (April 18th), they are just now processing I-129F's from October, 2006.

    However, from the anecdotal information on this site, it seems like most couples are approved in approximately 3 months.

    Can anyone help me clarify this discrepancy? I just submitted my completed I-129F in April 2007.

    California is very slow in showing dates that they are processing. I know that when I got my NOV2 that their site said that they were doing I129 for June 06. If you submitted yours in April then you should receive something early to mid July, 90 to 100 days.

  10. question does anyone know if there is a way to verify that the foreign embassy has received your info and is sending out packet 3? the bangkok embassy website specifically says we cannot answer q's related to that and i am (like everyone else) DYING to find out.

    Kang Lang,

    You can email the embassy to find out if they have recieved the package. I did this after we sent our package in and they were very nice about it. What I asked was if they recieved the package from the NVC and if they did then you can expect package 3 to be mailed within a week. Also, if you go to the embassy site you can find out what you need to gather for package 3.

  11. q for everyone, do i the petitioner need to have my birth certificate with me when i go for the interview? (i don't have it, since i haven't needed it in years) got my passport and whatnot.

    Your passport is proof. In filling out the I-129 it states that you can use your passport as proof but will need a copy of the entire passport as proof. You should be fine and you shouldn't need your passport. I know that mine is part of my I-129. I can not make the interview due to work conflicts. I believe that with you being there just enhances the relationship portion of the interview.

  12. If you are asking about getting a SSN it can be done as part of the DS230 part 2. There is a section on the form that you can fill out I believe that it is question 33 and 34. You can contact the Social Sercurity site to find out more.

  13. OK, it has been some time since I posted. but wanted to update everyone. I travelled to Bangkok with my teenage daughter's and two of their friends on March 9th for a week. It was a terrific vacation and they returned to the US on the 18th and I stayed on in Asia for business.

    At the same time, Rin received her packet 3, so it was returned to the embassy on the 13th. We had not received the packet 4 by the end of March and I was planning a return to the US on April 7th, so I contacted the embassy via e-mail to find out the status of Rin's case. Expecting an interview of late May/early June, we were quite surprised to receive the return e-mail from the embassy advising Rin's interview was scheduled for April 17th!!! That left us two weeks to finalize everything (book tickets, packing, extend my visit, etc) so we could return to the USA together.

    We already had the police report, medical exam, and all forms completed, so it was a matter of checking and double-checking everything up until the 17th. The interview went well, just basic questions on how we met, have we met each others children, had I been to her house, etc, and the visa was approved. They did look at my passport to see how often I had been to Thailand (about 100 days since last July!). We returned to the embassy on April 18th to pick up the visa at 3 pm, then straight to the airport for an evening departure (at 7:30 pm) to LA. We are now back in Memphis and it has been an amazing first day!

    I wish all of you godspeed and good luck on your journey! On to AOS!!!

    Congrats on getting the Visa. I know that I wish that I was going to be at the interview but I have to teach a class in CA. So for me my fiancee is going to have to do this alone but I know that all of the paper work is correct and we have more then enough evidence for our relationship.

  14. sorry if this is a lame questions, but I didn't see the filling out of the DS-156 and DS-156K forms on "Step-by-Step Guide on How to File for a K-1 Visa for your Foreign Fiance". Do I need to fill it out and turn it in when I submit the 129F? When do these forms come in the picture? do i need to worry about the yet?

    You will be filling these out in Package 3. this is after your I-129 has been approved and you have a NOA 2 in hand. Look at some of the timeline information in VJ and you can see when Package 3 is going to be. If is also alright to start gathering information for your packages.

    USC fiance is self-employed, has his own company yadda yadda. How many years do we have to show income tax returns (As proof of salary) for?

    I think that you need to have the last two years of your income tax return to show proof of income. Remember that this is a minimum and if you want to show more you can.

    - I'm new to this forum but like the rest of you are struggling with K-1 (I-129f) application!! My fiance (who is American) and I (English) filed independenly in January of this year, but due to 2 internal administration errors at the Service Centre our case was untouched until late March.

    I have been in the US on a B2 visa since Dec 06, but have to leave by July 1st. We, perhaps naively, believed we filed in good time (6 months!) but are not unsure if we will be able to go ahead with our planned Sept 22nd wedding. As I have used up my 'time slot' for 2007 on my B2 visa I will not be able to return to the US until I get the K1 visa from the consulate in London.

    I was wondering if any of you had had any sucess filing without using an attorney/immigration lawyer!? I am now considering seeking legal help to push our case forward - it would be great to get some information or tips from anyone who has used a lawyer to help their case - Any information would be greatfully apreciated!!

    I think that all of us have been doing it independently. The only think that I would look at is to look at the VJ site for what to fill out because if you are filling the documents out by yourself you need to make sure that everything is filled out.

    As for getting a lawyer to push it faster this is something that they can not do.

  17. USCIS says: 2/28/07. Versions 12/04/06, 7/14/06 and 6/17/06 are also acceptable. so I am assuming this one will be valid for a while as well

    This is correct. I even email the Embassy in Thailand and they said that they would except the 4/30/07 expire dates because they are the latest forms.

    As for filling them out it is alright if some are filled in with Black Ink. As for #11 it is N/A ( K1 visa process for permanent residence )

  18. My fiancee and her daughter's birth certificates have to be translated into English. Does anyone familiar with Bangkok know where that can be done, and does it have to be done at a government office?

    Pu can either do it at the Thailand Government or any translation offices. Just make sure that it is stamp correctly by the translation shop. Like everyone else Wireless has so many different places to do this.

  19. hello there!!!to all my fellow dec filers how many days did it take for u guys to get ur Packet 3. We got our approval march 6 but since then have not received packet 3 yet???how many days would it normally take from the service centers to NVC to (manila)consulate to beneficiary??is it alright if we begin collecting the documents needed for I134 like certificate of employment from my fiance would the date matter if we get it now even if the interview would take months... months... after???thanks to u all!!!

    Yes it is alright if you start collecting all of the documentation that you are going to need. You do not have to wait until you receive the package to get stuff together.

  20. 1. We erroneously included my I134 with our Packet 3 docs. The I134 was made before a recent trip to visit my fiancee in February. It was notarized and dated February 7th. The US embassy BKK responded to an inquiry saying that the I134 would be held in our file until our interview on 5/16/2007. Does anyone know how long this document is good for? It will be over 3 months old on 5/16.

    2. When I purchase my fiancee's plane ticket to the US, does it have to be a roundtrip ticket?

    3. Bumrungrad Hospital told my fiancee that the medical results would be sent to the Embassy, but the instructions in Packet 4 say to bring the results of the medical examination to the interview. Anybody know which is correct, or how this plays out?

    I also sent in the I-134 with the package and yes they do keep it with your fiance package but what I did was to send my fiance a new I-134 (revision date 28 Feb 2007) which she will take with her just in case they ask her for the I-134. Yes, I was not sure what to send because the letter from the embassy does not spell everything out.

    I just purchased a one way for Thitiphon because she is coming here to live with me.

    We mailed our paperwork from the hospital with our Package 3 information because the hospital told Thitiphon to mail this to the embassy. I then emailed the embassy about us mailing them everything and they informed me that it would be placed in Thitiphon's file and would be looked at on the day of the interview.

  21. Ok, so I just noticed that the I-134 form expires on 04-30-07. Does this mean unless your interview is before then that you should wait til the new form comes out to fill it out and send it to your fiance? Just wanted to double check, thank.

    The last 2 I-134 expire on 30 April 2007 but the latest revision dated 28 Feb. 2007 (on the bottom of form) is good. I know that if you go to the USCIS form site it states that "2/28/07. Versions 12/04/06, 7/14/06 and 6/17/06 are also acceptable". So as long as you are using one of these revision then you are fine. I know that I had to redo mine and I sent just the I-134 to my fiance. Hope this helps.

    4.) Included in the I-134 Affidavit of support they request copies of tax returns. Since my fiancee's will be holding this information until the interview and i don't consider her apartment building very secure i have run a black magic marker through my social security number. My name is on the top of all the forms and i just have my SS# blacked out. I did this to prevent identity theft and i want my social security number on as few forms as possible. Do you think the embassy will have any problem with this?

    5.) On form DS-157 question 12 asks to list your last TWO employers not including your current employer. The form asks for name, address, phone, job title, and supervisors name. She worked at a bank, she owned and managed a small game shop that has since gone out of business and i don't know if there is any record of it and before that she worked as a supervisor at an electronics factory. My question is should i list the bank and the game shop only or should i list all three since there may not be any record of the game shop and it has gone out of business.

    As for questions:

    1. Yes, send addition proof of your relationship after your I-129F was submitted. This shows the embassy that you are serious about the relationship. The flight information, copy of passport, pictures, phone records, emails, letters, and other things are proof of an ongoing relationship. Your fiance should also have a copy of your I-129F just in case the embassy asks for it.

    1b. As for the 134 information you should have all of the items that you stated and you might want to include your 1040's which show that you make enough to support your fiance.

    2. In package 3 they only request pictures of your fiance. You do not have to submit pictures of yourself.

    3. I would only show the pages that show that you were together with your fiance. Having blank pages just makes for useless items in your package.

    4. No, because your social sercurity number is in the 129.

    5. It really up to you and your fiance. You must put 2 down so the bank and the game shop should be enough.

    I have heard that it can take one day to one week normally. I have heard of people getting it the same day. Like you I have already purchased my ticket since our interview is the 17th but because of work I will not be able to make the interview and will be coming a week later. Then will be staying there for about 2 weeks and heading back to the US with Thitiphon.
