    Need your help with the below query. Sorry, if I am posting this under the wrong section.

    My spouse entered US in IR1 status and got her IR1 endorsement in her passport as well in July '18 at the port of entry. Around Aug '18 second week we got a notification saying the card is being produced and will be mailed. But instead we have received a fingerprint notice now. Is this normal procedure? I was expecting the card to arrive. Not sure why is there a need to do fingerprint again.

    The fingerprint was already done in our home country in June '18 and again at the port of entry. Has anyone experienced the same.

    We submitted I-130 petition for my wife via DCF in early May and the same has been approved. We are now gathering documents for her interview in Mumbai consulate scheduled for end of the month.

     

    Just a small history on my case…

    My wife and I are married for over 18years and we have spent 11 of those in the US. She had a green card while in the US and has been outside the US for about 7 years now. I have been living with her for over 2 years now and hence filed through DCF.

     

    We were going through the affidavit of support requirements and I think my wife qualifies for I-864W (affidavit of support exemption) based on 40 quarters of SSA coverage earned by ME so far during the course of our marriage.

     

    Here’s what the I864W instructions say…

     

    You have earned or can receive credit for 40 quarters of coverage under the Social Security Act (SSA). If you have 40

    1.      quarters of SSA coverage, you are exempt from the requirement to file Form I-864 or Form I-864EZ. You can acquire

    2.      40 qualifying quarters in the following ways:

    3.      A. Working in the United States for 40 quarters in which you received the minimum income established by the Social

    4.      Security Administration;

    5.      B. By being credited under the Immigration and Nationality Act (INA) section 213A(a)(3)(B) with quarters worked

    6.      by your spouse during the marriage or a parent during the time you were under 18 years of age; or

    7.      C. A combination of the above.

     

    The related INA section states the following…

     

    (B) Qualifying quarters.-For purposes of this section, in determining the number of qualifying quarters of coverage under title II of the Social Security Act an alien shall be credited with- 


    (i) all of the qualifying quarters of coverage as defined under title II of the Social Security Act worked by a parent of such alien while the alien was under age 18, and 


    (ii) all of the qualifying quarters worked by a spouse of such alien during their marriage and the alien remains married to such spouse or such spouse is deceased

     

    I have been employed all through our married years while living in the US and I am pretty sure I have earned over 40 quarters. My SSA statement says I qualify for benefits.

     

    So, based on the above I think item B applies in our case. Am I inferring this correctly?

     

    Also, since I have been out of the US for couple of years now do I still need to provide/carry proof of domicile? This seems to be relevant only for I-864.

     

    Appreciate your help on this.

  4. Thanks pushbrk. I am planning to enter my wife's A-number where asked.

     

    Btw, I forgot to mention in my earlier post that my wife had a L1 filed by her employer some time before our marriage, which was approved and she worked in the US for a year or so on the L1 before she quit that job and switched to H4 after our marriage. Does L1 qualify as a petition? 

     

    If so, does it impact the below question ...

     

    Part 4, Item 10

    Has anyone else ever filed a petition for the beneficiary?

    Resurrecting an old thread since I had a similar question when filing out a I-130 for my wife. My wife got a green card when living in the US many years back through my employment. I had filed I-485 Adjustment of Status for her...she was on an H4 visa then. Does the I-485 count as a petition?

     

    Looking for some help for the below question...

    Part 5, Item 1

    Have you EVER previously filed a petition for this beneficiary or any other alien?”

     

    And for...

    Part 4, Item 10

    Has anyone else ever filed a petition for the beneficiary? I guess I should answer NO since no one ELSE has ever applied a petition for her.

    This is my first post here. I (US citizen) will be filing for IR1 via DCF for my wife very soon. We have been married for many years and were living in the US for a long time as well before my wife decided to move back home for a few years to spend time with family. We both had green cards when in the US through my employment. I continued to stay in the US and became a citizen and moved out of the country to join her a couple of years back. Now we both want to get back to the US.

     

    We have been reading through the Visa Journey forums and it has been immensely helpful. Thanks a lot!

     

    Had a few questions in the I-130 form. It would be really helpful if someone could help with those.

     

    Page 1 -> Part 2-> Item 1

    “Alien Registration number (if any)”

     

    Should I enter my A number from my earlier green card even though I am a citizen now.

     

    Page 5 -> Part 4 (Information about beneficiary) -> Item 10

    “Has anyone else ever filed a petition for the beneficiary?”

     

    My wife was living in the US earlier for several years and we both got our green cards (from H1(me)/H4 (spouse) visas) through my employment. She then moved out of US. What should we answer for this question.

     

    Page 5 -> Part 4 (Information about beneficiary) -> Item 12.a (Other address and contact information)

    "Provide the address in the United States where the beneficiary intends to live, if different from items numbers 11a - 11h. If the address is the same, then type or print SAME in item number 12a"

     

    We are both currently living out of the US and do not have a US address. What address should we provide here.

     

    Page 8 -> Part 5 (Other information) -> Item 1

    I am assuming we should enter our address where we currently live. Is that correct? Should we say N/A for “Date To” since we are still living there?
