Hey. Bit of a weird one. So I entered the US on a CR1 visa in November 2015. Unfortunately, the relationship ended (we ultimately divorced) and I came back to the UK in April 2016. I tried to get an ESTA for a subsequent visit to the US in April 2017 but it was declined. I went with the intention of using my visa but was given a two-hour grilling at Philadelphia (point of entry) and told that because I did not have some form of ID card you get after a number of months in the US, they should not let me in but would do so on this occasion. They added they would put a note on my file saying I should not be allowed entry on my visa again. Long story short, I need to return to the US next month. Again, I tried for an ESTA figuring that my visa would have expired as it was only valid for two years. Again, it declined. The US Embassy say it did so because I am still listed as a lawful permanent resident. They say to get an ESTA I would need to fill out an I-407 abandonment form. Given I would love the option to return to live and work in the US at some point in the future I am loathe to do this, however, if I am going to get denied entry on my next visit, as they warned at Philly, then I may as well go ahead. Any thoughts? Thanks for reading!!
