Hello Again fellow Vj members,
I know i already posted this question but got no definite answer yet. My question is on the form I -751 Part 5 , it asked:
INformation about your children(list all children)?
My questions are:
1. WHo's children? the children born to our marriage ? or i will include my hubby and my kids in our previous marriages?
My hubby got 2 kids(14 & 23) who do not live with us and is not listed on his Income tax as his dependent though he is giving child support(14 yo).
I have two kids on previous marriage who is under the I -130 of my husband being his step children. and we got a child on our marriage and that son is a US citizen.
2. The form says all children so should I include all 5 children? or just children born to our marriage.
Am really confused so plsss.. i would appreciate your help.

Yes, you need to send the original.
They'll put a stamp with "Expired" on the first page and return it with the new one (at the same time)
I've sent my passport via post numerous times throughout the years and I've had no problems. Use certified mail that requires a return receipt that someone has actually signed & received the package at the embassy.
Yes, she'll be without a passport for approx. 2 months; my wife had a driver's license for identification.
Can my wife get her renew passport with her new marriage name? She has changed to my last name when applied her Green card?

on I 129F and G 325A forms when it ask for A# or Alien Registartion Number
Do i need to put number from my naturalization certificate, given that i am will provide a copy of my passport?
is A# same thing as Alien Registartion Number?

I have included A no. in my I-129F and G325A. My Alien number has shown up in my NOA1/2. I am filling out AOS for my fiancee and I-485 has asked for that Alien No agian. I don't know what to suggest to you I guess is if you have it then include it in there. Good luck

if she doesnt want to work she will not need EAD.
I thought once she has a green card she can apply for work without EAD. Is it correct?

1) Form I-129f - Step 8b for the myself? Is it the Alien Registration number?
2) Form G-325a - File number which starts with "A" on the top of the form?
3) Form G-325a - Alien Registration Number at the bottom?
Are 2 and 3 the same thing (Alien Registration number)?

I don't know how others did their. I have included my A number on both forms I129F and my G325A. When I recieved mine NOA1/2 the A no. is listed on both forms. I left it blank on my Fiancee's G325A. My fiancee received her visa on Apr 6,07.

If my fiancee does not plan to work immidiately, Does she still require EAD after she received her green card? I am just trying to eliminate a step if it is not require.

i saw the snake wine when i was there with the cobra in it and wonder can i bring it on the plane ?
Yes, you can. I have brought 2 bottles home from VN and both snakes were made out of rubber. Maybe, you may have better luck with yours.

OK I have set in th IV bill and am waiting for the DS-230 with instructions to arrive. I have certified copies of my wife birth certificate, house registration, a copies of her passport, and other documents. Do I need to bring them to VN so she has them for her interview or do I send them in with the DS-230? What do I need to send in for the DS-230? What would she need for the interview?
When she receives Package 3 just follow the instructions in pkg 3&pkg 4. For you(petitioner), you should have atleast the following document:
1/ Your past 3 years income taxes with W-2 forms or tax transcripts from the IRS.
2/ Marriage certificate
3/ Dirvoce decreed (certified copy) if applicable.
4/ Leter head from your employer.
5/ I-134
6/ lots of relationship evidence between you and her.
For Her.
1/ A valid passport(original and copy)
2/ House Hold registry book(original and photo copy)
3/ Police certificate
4/ Divorce Decree If Applicable
5/ Certified copies of Birth certificates you and her(in english and in vietnamese).
6/ ID CMND (Chung minh Nhan Dan) (Original and copy)
7/ DS-230, DS-156, DS-156K.
8/ Vaccination req
9/ medical exam

Thanks everyone, It was a rough road for us. I had a previous I-129F withdrawal last year and my fiancee had an abandoned previous I-129F. But we fought thru it all and made it. My fiancee picked her visa yesterday. Thanks for many assist. from VJ web site.

Sorry, for not updating my timelines. I was busy trying to finish my project at work so I can fly to VN to be with my fiancee. Her inetrview was scheduled at 10:00am Apr 5 and she has received a pink. She will be picking up her Visa at 4:00pm tomorrow.

OK, we are now 0 for 2 regarding cooperating spouses. Linh will go to the police in her ex's town to try and get some ducumentation about his address. I composed a letter with all I know to be true regarding my ex. I would hope that will be enough. What can you do to prove someone's address when that person will not cooperate?

I went to my county assesor and I was able to retrieve and print out my ex's resident address. This listing also has her name and when she bought the house. I will have my fiancee to include it in with her supporting evidence during her interview just incase CO asks for it. I hope your ex has her own house then you can obtain proof for her address this way. I hope this helps.

No, we don't have kids from prior marriages. So there is no correspondence between us.
Here's the newest wrinkle, my ex's attorney says to not provide anything confirming her address. So now I have no way to prove her current address. Her address is on our divorce decree. One suggestion I received was to send a registered letter with return receipt. If she accepts, I have proof, if she refuses it I have proof that she refused it at that address. That may be the course of action.
Surprising that her attorney would instruct her to do something that could only bring about suspicion. My ex is not a USC, but all the entry to the US and AOS was legit and above board.
Sorry to hear your strange situation. I am divorced too and I do not know where my ex is and I don't care that is why we divorced.

The blue slip requests more evidence of the following:
proof of former spouse current address - petitioner
proof of former spouse current address - applicant
additional correspondence between Linh and I
I got the info I needed from my ex. She is being very helpful. We have lots of correspondence from prior to our Dam Hoi, so that is easy. The one problem may be Linh former spouse in VN. She knows where he is living, but cannot get ahold of him to get a photocopy of his housebook or anything else.
Has anyone else run into this problem? What other options do we have to show proof of address of someone that can't be contacted? She has gone to the home, but no one is there. She doesn't have any phone numbers, yet. Still trying that one.

I am just curious. Do you and your fiancee have children from previous marriage. The reason I am asking is if you both have children from previous marriage. Then there will be some contacts with the EX-W/EX-H(Child support or visit rights). And maybe why CO was asking about EX-W/H current addresses. Maybe??????

1, National ID number, If your country has a mandatory ID card for all citizens, the number will be on that card, They do in mainland China, I am not sure about Hong Kong though.
2, you put what ever your job status on the form it makes no difference.
3, No 22 Write 'when visa is granted'
4, No 28 MYSELF
5, No 32, Yes and WITH WORK AUTHORIZATION, EMPLOYER UNKNOWN
6, No 34, NONE unless a relative like son or daughter is traveling with you.
Also the DS-156 is recommended to do the online electronic one and print it out 2 times, the online form generates a unique bar code, that contains all the Data that you entered into the form, the consular officer can scan the code and get the information correctly entered into the system. Many consulates are now requiring the online version even though they sent a paper one in the packet.

I am just curious how can someone fudge something on the 1040 when W-2 has stated how much someone makes in a year and how much taxes he/she has paid. I am assumed that the HCMC US cares about how much you make in year and do you meet the income requirement.
I can produce a 1040 right now showing that I make 1000000 a year, sign it and send it off to my fiancee. Just get the ol quickbooks together and roll with it.
Now the transcript is a direct reflection of the checks and balances of the IRS. It comes from the IRS. If you fudge on the 1040 and submit that to the IRS, good luck with that on your chest when they come pounding on your door to take your new stainless steel grill away. They verify all the data you submit with what the W-2s and from what the employer has reported. Hence, the checks and balances the computers do automatically to catch this stuff.
I am not disagreed with you. The requirement is W2 and income tax for the past year. If you make 30K/yr and your W2 stated that you made 30/yr but your 1040 has indicated that your have made 50K. It will definately raise a red flag. As you have stated check and balance.

just got the intent to deny cause of having a previous k1 visa approved.
they want a waiver from me.
just how complicated a letter do they want, and what further
evidence can i provide that i already had sent in with the petition.
i can give them copies of letters and phone bills in the last 4 months of
waiting.
any hints as to what to write would be helpful.

I wrote a request for waiver to USCIS. I stated the problem of why I withdrew my previous petition and decribed how I met my current fiancee and included copies of my previous NOA1, NOA2, and my withdrew petition notification from USCIS. I also included our pictures and airlines tickets/boarding pass of the 3 trips that I have visited my current fiancee. Anyway, USCIS have approved my petition. Good luck!

HCMC embassy is so slow for me. is anyone else having issues with the embassy over there? Would it help if i got help from my congressman or senator? HCMC got my packet 3 on 10.10.06 and still as of today (01.05.07) no interview date yet. When i call over there to ask them a question they say to me "We are busy, it will take long time, ok good bye" and disconnect before i can even ask a question.
Have you tryed to email the HCMC? They have replyed to every email that I have sent.

My Fiancee received package 3. She told me on the phone that there are DS-2001, DS-230-I, DSL-1083K, and DS-2000 forms. Does she require to fill them all out and send them back to the US Consulate in Vietnam?

How are updates made to a DS-230 or other papers. My fiance missed including her phone number on item # 13 when she turned in her DS-230. Moreover, her family is strongly considering selling their place in Q3 and moving out of town to Thu Duc.
I dont know exactly when this will occur but I have a sinking feeling it will be while waiting for Packet 4.
Does anyone have any experience with this kind of change ? Thanks Andrew :
My fiancee has moved and I called HCM Consulate and they told me to have my fiancee type up a letter with the new address and turn it in at the Consulate. Good luck

I have looked at a sample Ds-156 form from this web page recommended. On Question 36 " Has anyone ever filed immigrat. Visa on your behalf?" The recommended form the sample form is No. I would think the answer would be Yes since I am her fiance and I have filed on her behalf. I have answered yes and Whom I wrote: My fiance. Anyone has any recommendation on this question please let me know. Thanks

DS-230 question 32 is "Have you ever been refused admission to the United States at a port-of-entry?"
Do you mean form DS-156?
If you intend to work put yes and put "WITH WORK AUTHORIZATION, EMPLOYER UNKNOWN"
Also use the online DS-156 it generates a special bar code that containes everything entered into the form that the consular officer at the embassy or consulate can scan, and everything on the form will then be entered into their system. It prevents data entry errors.

My friend's wife has just received her 10GC. They both had child together and they included their daughter in Question 5 and listed her as USC. I am hoping this help.
