  1. I am about to sumbit for AoS from my K1 visa, and have a question about Advance Parole (AP). I have an ailing grandparent in my home country who is soon to have surgery, and, given the poor nature of their health, I would like to have the flexibility to return home if need be while my AoS application is processing. My understanding is that AP is a way to do this, but wanted to make sure that I am going about things the right way.

     

    The official instructions states that 'Travel for vacation is not a vallid purpose', however the Visa Journey example simply lists as its reason for applying 'visit my mother and father in Australia', with no mention of family emergency. Is it likely that my application, based on a grandparent who is ailing, will be accepted? I'd love to hear from anyone with experience of this, as the official instructions seem to state quite clearly that what is requested in the VisaJourney example would be rejected.

     

    Also, it is made clear that an AP document does not guaruntee admission when returning. What does this mean in practice? I've read that this is generally only a concern for people who have previous over-stays, or refugees who return to the countries they have fled, and that for a valid K1 holder it is essentially a formality. Does anyone have any further knowledge or experience on this?

    I have a question regarding the above mentioned sections of the I-485. I am unclear on what is meant by 'underlying petition', and whether it is necessary for me to fill in this section of the form. I noticed that both the VisaJourney and SimpleCitizen examples leave it blank, but the Visa Harmony example has the I-129 receipt number and I-129 NOA1 received date here (see attached image)

     

    I am reasonably sure I can leave this blank, but wanted to clarify on here first.

    Why do you say a week or two? Virtually all the other references I can find say that five working days is more likely as a higher end of processing time at London?

  4. Happy to say I attended the interview on Monday and was approved pending their receipt of my medical, which Knightsbridge told me will be with them by 1100 tomorrow! Thanks to everyone for their advice and help.

    I also have another small query which I thought I would just add here to keep things tidy.

    I have chosen to collect my visa from the nearest DX location and have two questions on this. One, do I require any ID to collect the package? I don't have a driving license, so my only form of photographic ID will be in the package I am trying to collect! Will this be an issue?

    Two, I haven't received any tracking number to know when the package is ready to be collected at the DX location. Will this be sent to me when the visa is issued, or is there some other way to track the package?

    Another small question on this:

    In the instructions email I received from the embassy, it says that the following is required for all visa types 'All previous passports, especially those that show any international trips or previously issued visas to the United States'.

    This is a bit of a curveball for me, as I hadn't seen this appear on anyone's lists on this website or elsewhere, and nor does it appear here - https://uk.usembassy.gov/visas/fianc...red-documents/

    Can anyone shed any light on this? I have no idea where my previous passports are, so a bit concerning.

Keep in mind though there have been a couple instances (cannot confirm if it's something new or just a newbie officer) that asks for an I-134 from both the sponsor and the cosponsor, even if the sponsor (the fiancé) makes $0. In general though, London has always been fine with just one I-134. Something to consider.

    Thanks for this note, I have an I-134 from both my fiancee and Mil, who is co-sponsoring. I have indeed heard that London has a relaxed approach to the I-134, in fact their website merely suggests is as a useful way to demonstrate financial security, rather than listing it as a requirement. However, better safe than sorry! :)

    Yes, the I-129F. When the London embassy sent me a letter inviting me to book the visa interview they included a copy of the I-129F with the USCIS approval page on the front, including their 'Approved' stamp.

     

    Have you received this letter from the embassy yet? If not, then I am confident that it will include this copy :)

    First time posting, but I've been using your excellent website for the entirety of my visa process and have found it very helpful.


    Ahead of my K-1 interview at the London embassy on April 23rd, I have been gathering the required documents, and wanted to check that I have not overlooked anything.

    I have on my list right now:

    • Letter from Embassy
    • Passport
    • I-29F (I have the original, and the stamped version returned to me by the embassy)
    • 4 x US standard passport photos
    • Print out of appointment email
    • Receipt of payment for interview
    • DS-160 Confirmation
    • NOA-2
    • Evidence which was submitted with I-29F
    • Additional evidence of ongoing relationship since filing date
    • Dated letter from fiancee re-affirming her desire to marry me
    • Full Birth Certificate
    • ACRO


    I will also have my I-134 with the following evidence from MIL (fiancee is student):

    • Previous W-2
    • Employment letter showing date of employment, salary, permanent contract status
    • Last two pay stubs
    • Copy of passport
    • Bank Statement showing when account opened, total amount deposited for past year, and present balance


    I feel like I have been quite exhaustive, but please let me know if there is anything I have overlooked!
