  1. I brought my wife here on a K1 Fiancée Visa. We applied to remove the conditions on her 2 year green card and received an 18 month extension letter shortly after applying. Then awhile back we received another extension letter extending her green card 2 years from the expiration date. However, now her green card with the 2 year extension is set to expire 09/14/22. We haven't heard any thing from USCIS to date and when we check online it just says case updated to show fingerprints received. Is it normal for USCIS to wait this close to the expiration of the green card before sending the 10 year green card? Is there something we should do to follow up with USCIS at this point to make sure nothing is wrong? Thanks in advance for any advice.

  2. Me and my conditional resident wife had a child here in the US after our marriage. Our son is a United States Citizen. In Part 5 it says to list all of your children so I am assuming we should list him. However, in the instructions I read the following: If you have dependent children who acquired conditional resident status on the same day as you or within 90 days thereafter, then include the names and Alien Registration Numbers (A-Numbers) of these children in Part 5. Do you list all your children or only ones needing to have conditions removed. Thanks.

  3. Do we need to put the immigrant name and A number on supporting evidence of our marriage (ex tax transcripts, birth certificates, bank statements, etc)? I never did this with any of our other petitions in the past, but then I read the following on the USCIS website: If you have any attachments, make sure each attached page has your name and A-Number (if any). You may also number the pages and include the total amount of pages being attached (for example, “page 1 of 11”). I thought you only did this if you needed to add extra pages to explain answers on your form or should the evidence have the name and A number on it as well? Thanks

  4. I am preparing the evidence for our I-751 packet. Some of the evidence won't fit on the page when I print it so I reduced the size for it to fit on the page. Would this be considered altering the document? I'm assuming I'm over analyzing this but I got concerned when reading the following on the petition: Copies of documents submitted are exact photocopies of unaltered documents and I understand that USCIS may require that I submit original documents to USCIS at a later date.

  5. I'm wondering if this is enough evidence to submit with the I-751 to remove the conditions on my wife's green card? 

    1. Birth Certificate for our son born while she was a conditional resident.

    2. Tax transcripts showing joint filing 2018 & 2019

    3. Copy of Master Cards showing names and same account number.

    4. Copy of state ID/Drivers license showing same address.

    5. Letter from work showing wife as beneficiary on company life insurance policy.

    6. Affidavit from my mother vouching for our marriage and stating she is allowing us to live in one of the homes she owns.

    7. Copy of weekly church flyer listing us as new members September 2018.

    8. Copy of church flyer announcing birth of our son dated January 2020.

    9. Copy of plane ticket with both names for vacation we took together.

    10. Photos of us taken at various times throughout the marriage.

     

    We haven't opened up any joint accounts because she is a homemaker and their hasn't been a need for a joint bank account. I don't have her on my company insurance because it is too expensive so I have her and my son covered thru the marketplace. We are living in a home owned by my mother and the bills are in her name I just pay them. Does this evidence sound like enough our is there anything that should be added? Any thoughts or suggestions would be greatly appreciated.

  6. Me and my wife got married on a K1 Visa and after we got married she applied for adjustment of status. She just received her interview notice in the mail and underneath her name it says c/o and has her fathers name listed and underneath that our address. We can't figure out why his name would be there as we did not put any in care of name on our application and her father lives in the Philippines. Is this something we should be concerned about or is it simply a typo on their end or does my name need to be their as the husband as I need to attend the interview with her. Any advice is greatly appreciated.  

  7. I brought my fiancé to the United States on a K1 Visa. Due to some unforeseen events we got married on the 89th day approximately one week ago. We are now in the process of preparing our Adjustment  of Status packet. On form I-485 we are unsure how to answer part 8 question 17 - Have you ever violated the terms or conditions of your nonimmigrant status?  We were under the impression that you must get married within 90 days and apply for adjustment of status shortly thereafter, which we are doing now. However, she is technically out of status because her admit until date has expired. How should we answer this question? Any advice is greatly appreciated.
