  1. Was it upheld or thrown out in court? A TPO only goes until the court date where it then becomes a restraining order. 

     

    I have not submitted my i-129, but I included a similar one. It asks for any restraining order. My ex filed on against me that was thrown out of court. So, it never became an actual restraining order. 

     

    That being said TPO's and the like are scary. You need nothing but your word to file one against somebody and once you do file one they will always have to report it. Even if it is not upheld. 

  2. I was thinking of using an agency. I was looking at Rapid Visa. Was wondering what peoples thoughts on this are? We have a few flags that I am a little concerned with and she has a child that needs to come too. 

     

    Flags: 

    She was separated for over a year before her divorce. We meet 3 months before the divorce was final. 

     

    Our relationship is not very long. When we file it will be less than a year. My logic is we will have another year to make certain. It takes a long time. So, when we finally marry it will have been almost 2 years. 

     

    We have met in person once. We have plans to do so again before years end. The second meeting will be with family, but the first was not. 

     

    I have a few arrest from my divorce. One restraining order too. The restraining order was thrown out and one of the arrest was also. The second was a felony. I plead to first time offender. They sealed the record. It does not fall under the violent felonies or crimes against children. (Speaking to an expert I was told that the ones thrown out will have no affect) 

     

    Not a flag but important- she has a child. Don't know how difficult that will be with this. 

  3. While I was working on my i-129 packet my kids decided that they wanted to help. So, my son (9) and daughter (7) wrote the cutest letters of recommendation for my fiance and myself. They also drew some pictures to supply some 'documents' too. So, it got me thinking that maybe I should include this in the i-129 package. Thoughts? 

     

    My son wrote in his letter of recommendation 'Dad is great. If [Daughters name] says that he is mean it is only because she is jealous.' lol.  

  4. I am sure this topic has been done, but I cannot find it. I have the following list of documents that must be sent with the i-129 package. Would anyone mind letting me know if I missed anything or have anything extra? 

     

     

    You have to provide proof of a relationship

    1. Copies of email conversation back and forth.

    2. Copies of phone call records.

    3. Screen shots of Skype calls.

    4. Copies of flight tickets to see each other.

    5. Copies of pictures of the two of you together and together with family and pictures of you two in her country with identifiable land marks.

     

    You will need to provide

    1. Photocopy of your latest 1040, w2, 1099 and photocopy of your past other two years 1040.

    2. Letter of employment and stating salary on company letterhead.

    3. Divorce papers(original).

    4. Birth certificate(original).

    5. Hand written statement stating you will support her.

    6. Copies of bank statement.

    7. Proof of your address.

    8.Copy of your passport

    9. Fill out all the provide forms.

    10. Visa photo of yourself to send with forms.

     

    she will need.

    1. Passport

    2. Birth certificate.

    3. Proof of address.

    4. Copies of email conversation back and forth.

    5. Copies of phone call records.

    6. Screen shots of Skype calls.

    7. Medical examination record (US consulate will send instruction how to do medical examination)

    8. Visa photo of her

    9. Visa fee payment

     

  5. Here is the specific law.

     

    Per Georgia law (O.C.G.A. § 42-8-60), “upon a verdict or plea of guilty or nolo contendere, but before an adjudication of guilt, the court may, in the case of a defendant who has not been previously convicted of a felony, without entering a judgment of guilt and with the consent of the defendant, defer further proceeding and place the defendant on probation as a first offender.”

    If the terms of the first offender sentence are successfully completed, and the probationer discharged, those charges would be sealed on the GCIC database when the discharge is applied to the GCIC criminal history; however, such information may be available through other sources, including court docket books, criminal justice agency websites, or through “third party” vendors. GCIC must receive official notification that the subject has successfully completed the FOA requirements. The record is not automatically sealed based on the passage of the probation sentence.

    Yes, but with the first time offender it get sealed too. So, it does not show on any background checks either. I actually work in software with banks which if it showed on reports I would not be allowed to do. I can buy a gun and do anything else as if it never happened.

    Sorta. It is sealed. It is considered a non-conviction unless I get convicted again. So, my pleas was basically I would not get in trouble again and the courts agreed to hold my conviction so long as I do not get in trouble again.

     

    My thought at that time was that I was 37 years old and had never been arrested before. So, what would the odds be of it happening again. So, I saved $2000 in court fees. Hindsight I would have fought it.

  8. I posted this on another forum, but got no answers. Maybe this is the correct place for this question. I am a US citizen.

     

    So, my divorce was ugly to say the least. My ex-wife had be arrested multiple times for varies things. All but one was thrown out of court. The most serious charge the DA refused to take and threw it out. One charge I plead to and got a first time offender (Could not afford to fight them all). The record was sealed and will remain sealed unless I get convicted again.  So, I declared all of them with the relevant documents. How will this affect my k1 visa efforts?
