    In the mean time they can apply for visit visas and if approved they can keep visiting the US time to time.

    Any idea what year are they currently processing?

    First, I called USCIS and got a reference number to open a service request. I was told to wait for an email instructions, but from what I've read on VJ forums, many were denied without USCIS even seeing any proof. (I have never received the email instructions, by the way. Just an update weeks later that the request was submitted and will look into it.)

    Then, I immediately contacted my local congressman's office by phone. VJ forum posts were very helpful (look for your local congress page > help with a federal agency for further information). They were very responsive and super helpful and were happy to contact USCIS on my behalf. 

    Afterwards, I've sent them a cover letter (template also found here on VJ), signed & scanned privacy release form, and a compilation of USCIS receipts and proofs in one PDF (I think about 12-13 pages that included numbered proof backing up my claims of my cover letter. Things like my income before moving here with currency conversions, salary average statistics with for my industry here in the US, my calculation range of lost income since arrival during the K1 process, proof of me running a business with achievements and credentials, pending client contract offers, and other relevant details. Oh, I also included the fact that DMV won't issue a DL without an EAD in my state with screenshots, and why this is relevant for my business - I've even used screenshots of the geographic area where I live).

     

    It took a month but it was very well worth it. So, in total, my EAD approval took 124 days.

    Thanks for the info. I called this morning and requested to expedite EAD hoping to hear good news soon :)

    How do you request expedite through Congress? Did you just call USCIS and requested ? Any docs you submitted?

    I called USCIS yesterday, requesting for an expedite. I didn't even send in any documents or anything, I just explained my situation over the phone and boom! Today it suddenly got approved. See my timeline below: 

     

    11/14 Mailed AOS Package (I-485, I-130, I-765 & I-131)

    11/19 NOA received for each application 

    12/04 Biometrics appt scheduled

    12/11 Request for initial evidence for I-485

    12/28 Biometrics appt completed + evidence received

    12/31 Status changed to actively reviewing for I-485 & I-765

    05/17 Card is being produced (I-765)

    05/20 Card is produced (I-765)

    05/23 Received my SSN in the mail

    05/26 Received my EAD in the mail

    06/13 Called USCIS to expedite I-131

    06/14 I-131 Approved

     

     

    Can you please tell me the best way to talk to the rep? I could not bypass the automatic machine last time I called. Thanks.

    thats my guess. ive been thinking about it for months. same with people who filed in 2020 and early 2021 and no news until now. not just EAD but AOS too. its crazy. i read somewhere on reddit  there's uscis worker ( obviously they'are not gonna reveal what is their job) responded that they did actually just grab whatever pile that they can get. of course noone can vouch if its really what happened or not

    bottom line : come to US, got married in 90 days ( her fiance visa is void, it doesnt matter when it is expired ) ,  immediately file for AOS. once you got the receipt letter for AOS, she's good as long as her AOS is pending, do not get out from US without advance parole

    Your issue is also very common. You are correct, Part 5 #3 should be "0", as you do not have a spouse NOT included in the petition.

     

     

    Thanks. btw did you send the documents by mail or uploaded on the USCIS site? 

    And also is copy of marriage certificate enough our marriage ?
