  1. My mother petitioned for my father and his interview date at the consulate in Bangladesh was on May 9 of 2020, a week before the country went into lock down. He couldn't attend the interview as he was from the vulnerable age group and the uncertainty of the whole situation when this all started really scared everyone off. He was asked August of 2020 to provide the updated police clearance certificate but he was unable to as the country was in a complete lockdown and it was virtually impossible to get a PCC at that time. So he received a letter two weeks ago stating that his visa application has been cancelled due to no contact from his end. I have emailed and explained the obvious that the country was in lockdown and free movement was not possible. He has acquired the required documents and is ready for the interview. What are the chances that his application will be re-instated? He has waited 4 years now to see my mom already and this is really heartbreaking.

  2. I am petitioning for my husband. My case is at NVC and I have "ceac.state.gov" case and invoice number to log into the website. I became disabled a couple years ago and do not work, so my brother will be a sponsor. My question is do I need to file an i-864? If I do, what do I put for "1e" on i-864? Am I the first/second joint sponsor or am I not a sponsor at all? ceac.state.gov is asking for my i864 and tax return. Also, last time I filed a tax return was in 2017, the year I became disabled. Should I submit that or not submit one at all and explain why I did not submit?

  3. My mother is disabled and on SSI, my dad who was here on a green card, lost his status due to him being out for more than a year. Now my mother is applying for his immigration, and my maternal uncle is a sponsor. So when filing I-864, do I put my mother as the first sponsor and uncle as the second or can there be two different sponsors other than my mom who is the one applying for my dad?

    No, they need US passport-style photos. If the beneficiary is not in the US at the time of filing, then they do not need his passport-style photos at this time. The petitioner must provide the passport-style photos in either case.

    You can submit marriage photos and other photos together as part of evidence of a bona fide marriage (but not in place of the passport-style photos).

    My parents are still married, they never separated or got divorced, how can we still submit papers showing their marriage was terminated?

  5. My dad was out of the U.S for more than 6 years after obtaining green card (had many things to take care of back home) and as a result lost his immigration status. Now we want him here and my mother is going to apply for his immigration (dad is in Bangladesh). My mother worked in the U.S but became disabled last year and gets SSI now. My dad can financially support himself and mother too when he comes here. Is there a possibility that my dads application may be denied because of my mothers disability and SSI status?

    Also, in the instructions for i-130, under required documents, it says

     

    (1) A copy of your marriage certificate;

     

    (2) If either you were or your spouse was previously married, submit copies of documents showing that each of

    the prior marriages was legally terminated; and

     

    (3) You must submit two identical color passport-style photographs of yourself and your spouse (if he or she is

    in the United States) taken within 30 days of filing this petition. The photos must have a white to off-white

    background, be printed on thin paper with a glossy finish, and be unmounted and unretouched.

    The two identical color passport-style photos must be 2 by 2 inches. The photos must be in color with full

    face, frontal view on a white to off-white background. Head height should measure 1 to 1 3/8 inches from top

    of hair to bottom of chin, and eye height is between 1 1/8 to 1 3/8 inches from bottom of photo. Your head

    must be bare unless you are wearing headwear as required by a religious denomination of which you are a

    member. Using a pencil or felt pen, lightly print your name and A-Number (if any) on the back of the photo.

     

    Does my mom need to submit all of these documents? Or just the first one would do? For number 3, Do they mean their photos together? Also, my dad is not in the United States, do we still need to submit his photos? Can we just submit their marriage photos taken in the 80's as a proof? Thanks for your input.

    Are you are aware of the I 864 requirements and can meet them?

    He had some land disputes on going and also family emergencies, he wanted to come after a year and half, but decided to take care all of the disputes and then apply.

    Yes I am a USC, naturalized couple of years ago since I was never out of the country for more than a month for 5 years after getting my GC. Thank you for your input.

  8. Me and my (spouse and two kids) immigrated to the United States from Bangladesh in 2010 with a green card. He had to go back to take care of a few things back home and stayed out of the U.S for over a year. As a result, he lost his permanent residency status. We have been married this entire time and were in contact and went to visit him once. Now he is ready to come back here and reunite with us. Do I petition a new immigration application for him under spouse category (I-130) or is there a quicker but guaranteed way for him to come back here? Thanks in advance
