  1. I have seen other people mentioning domicile, which I find confusing. The reason why I find it to be confusing is how in certain states it is not easy to remove domicile completely. Certain states think that you're still a resident and domiciled as long as you are registered to vote there, have a banking account in the state, receive mail there, attend family functions there, and so forth.  If you are considered domiciled for tax purposes, why would you not be for a visa for your fiancé or spouse?

    Domicile depends on the state. For PA, for instance, you maintain domicile there if you show proof that you are intending on moving back to the state and that the other place you are currently living (foreign country included) will not be your permanent home.  For reference: rev-611.pdf

    This is only Pennsylvania and I am sure other states handle domicile differently.
