Question - Did you get an interview date prior to your EAD?
In my case - I am still waiting for my EAD yet I just got an interview date for
February!?
If you look at my timeline it has clearly been more than 90 days - however, calling our guys
they claim it has only been 70 days.
Will I still get my EAD card?
Any insight from anyone reading this?

guys, especially you guys that went through the k1 process
We received our green card in a little less then 6 months and thats given that we had a REF and took a month to respond.
so if you subtract the month, we received green card in hand in about 5 months no interview required.
is this normal for everyone that brought their spouces from another country
or are we just extremely lucky?

im not good with the timeline thing but my wife arrived with a k1 visa in april we married in july and about the end of december we received
notice of approval. greencard in hand dec 28 or 29th i didnt get back until the 2nd of january from vacation.
i thought we had to go through an interview before we received the greencard. Im not complaining just surprised!

Hello all, Happy Holidays...
The USCIS website says that my wife's AP document was sent december 7th but we still have not received it. Her EAD was sent on december 17th and we received it already. We called the customer service number and they said if it was sent less than 30 days ago to just wait for it. but that seems like an awful long time for something to get here if it normally takes just 2 days.
Any suggestions on our next course of action? just wait it out or should we be concerned that it was lost in the mail or something? With it being such an important document, I'm a lil worried about identity theft if it fell into the wrong hands..

ok I got the yellow paper today asking for more tax information and Proof of US status for my joint sponsor and below it states
"The Service will process your form I-765, Application for Employment Authorization (if submitted) within 90 days of the reciept of your missing initial evidence. This is pursuant to title 8, Code of Federal Regulations, Section 103.2(Bb)(10)(ii)."
what does that exactly mean?
that after the get the new info, THEN they start processing my EAD?
Yes, it means they don't start processing until they have the initial evidence.

Check out this thread for more CSC transfer information.
But yes, usually a CSC transfer indicates an interview free approval. However, it isn't unheard of for USCIS to transfer you back to MSC and then onto your local office for interview, nor does it indicate that a quick approval is in the pipeline should you remain at CSC.
It can still take anywhere between 2 weeks after transfer to 2 years plus for a GC. Hopefully, you'll be at the shorter end of that spectrum!
Can I ask a few naive questions of you more experienced folks?
My fiance (and her 3-year old son) came into the USA on her K1 visa a month ago and we were married 2 weeks ago.
What exactly do I need to file now that we're married? Do I need to file an I-130 AND an I-485?
Also, how do we go about getting her a SS#?

That's not strange at all... It could happen to any cases. If CSC thinks your case requires an interview, they'll forward it back to your local office and then they'll set an interview appointment. Consider it as a blessing in disguise because as you know, a lot of cases are still in the limbo... no movement, no progress...

I flew from Boston to Florida using my EAD back in 2005, so unless it has changed you should be ok...

I travel with my valid Canadian passport! (It still has my maiden name till I get my AOS approval).
No one ever asked about my status. Just keep your EAD and related documents with you, if it comes up.
Traveling state to state brings up - name issues - your valid document vs. your ticket what trully matters.
Do not complicate the issue, before they think you got something to hide and ruin your trip just for trying to
walk the straight and narrow path!

I got the card production email a week or so ago, and today got this:
Application Type: I765 , APPLICATION FOR EMPLOYMENT AUTHORIZATION
Current Status: Approval notice sent.
I thought the production of the card would mean it was approved? I'm sure this is a dumb question and I apologize in advance!
I think you got the same person who approved mine . Biometrics done Dec 13 and 2 hours later got an email card production ordered and today got an email saying approved and in mail.
I woudn't mind to get any of the emails or mail.

This is how it went, we waited from 10am our appointment time till about 11.15 when the lady called our name. After the initial swearing and she wanted to see some goverment issue IDs and we gave her our DL which she check both our address.
she wanted to see my wife original birth cert, our marriage cert, my birth cert. then she asked for evidence to support our application and i gave her all our evidence neatly arranged and the photocopies ( she was happy i came with photocopies and the way the documents were arranged). she looked through the evidence carefully and all she said was that we have all she need and that were approved. she talked al ittle about my church and asked if my wife attend thesame church. She asked for current letter from employer and last three months paystub, i gave her both but she said mine is not important and she kept the originals of my wife and also copies of last year tax return.
she asked the questions on the I 485 form, then she took my I-94 and I asked her about my EAD & AP , she told me i can keep them both and when i get my green card in about 2 weeks i can make it void.
we were out in about 5-10 minutes. on our way out she asked who our joint sponsor was, and my wife replied that's was her dad. no other questions, she didn't ask to see our photos either, we had went with two photo albums with about 300 picstures.
All i can say she was really nice and was smiling all through, she was happy at how neat and organize we are and she told us we came with enoough evidence and good thing she didn't haave to make copies.
Congratulations on your approval! It is a blessing to run into people like the lady
you dealt with. We should not be fooled and think that "we" are getting away with something.
The lady chose to be a professional. Some give you hell despite the amount of evidence you got.
And very few of them can't recall procedures that they should follow in approving or denying you your
case.
Imagine if you did not have all the evidence you had or let's say if your case wasn't legitimate? I would not imagine her smiling! I know I am long winded - however, what I am saying is -
1) congratulations on your case
2) Case workers do review cases and know what to ask in trying to unearth any pitfalls in our cases.
The questions they ask may sound innocent but they all have meanings.

Someone told me based on my timeline that my wife is accruing unlawful presence and is out of status. I called the USCIS and they told me as long as we are married within the 90 day period (we were, 10/26) and the paperwork is sent in before her visa expires (2/22/08) all is good. Will someone shed some light on this for me? And if she is out of status what does that mean for us and her AOS??? thanks
It is true that once the I-94 expires (and the marriage occurred within the 90 days) one is out of status until (and if) they file AOS which will bring the status to Pending (which is legal). Are you certain about the Feb.22, 2008 date? That is about 60 days longer than typical (which is 90 days from date-of-entry.)
The I-94 expired Nov. 29. we were married 10/26. Her actual K-1 visa doesnt expire until 2/22. Sorry for the mix up. So are we ok then? What does this out status do to her? Any potential problems??
The K1 was taken at the point of entry (POE) and is no longer in play so no, it is not 'good' until 2/22 - the I-94 stamped in her passport is what matters. (If you are thinking the K1 is valid for 6 months, it is, 6-months from date it was issued to come to the US - once in the US, the 90-day clock (of the I-94) started - you've fulfilled the marriage part - and became out-of-status Nov.29.)
What does it mean? Not too much - just that to the government she has no status - it is best for you guys to file AOS as soon as possible. There are many people who have waited a long time to file and have had no issues - I don't know what the exact issues are with being out-of-status - it's just not an ideal place to be for terribly long.
Thanks for the clarification. I am sending the I-485, G-325A, I-131, I-864 and the I-765. From what I gather this 1010.00 dollars. I noticed on the forms guide the I-765 and the I-131 said "optional". Do I need to send all of the above mentioned forms out or is the the I-765 and I-131 too late now. Sorry if I seem clueless, I am!!!! I have been getting mixed anwsers and I just began this process!!!
Do not forget I-693 - Medical Examination of Aliens Seeking Adjustment of Status or a copy of the medical she had done for her K1 if it hasn't been a years since having it done.
Depending with who is working on your case - they may not draw that conclusion of K1 background - therefore to avoid unecessary RFE - just include a copy of it.
And if she needs an Medica Examination - you rather just take your time and complete everything before sending an incomplete package.

I tried yesterday and today and it still doesn't work. "The server on egov.uscis.gov does not reply". The "regular" www.uscis.gov works though.
Hope they get it up and working again soon. I crave my daily "check case status".
Yup, their online cases checking section is down! It has been like this since this past Thursday!
I thought I had a problem with my password cause that is how it started complaining and ultimately
the site would not load up/reply!
I usually check it at least twice a day! As if the font will change the next time I log in... LOL
I just took it as - being forced to enjoy Christmas and deal with it in a week!

On page # 6
If you are filing a Form I-131based on a pending Form I-485, file Form I-131 with the
Nebraska Service Center or Texas Service Center,depending on where you live.
I sent in my I131 to Texas Service Center and got approved in 30 to 40 days - roughly.

Hey Guys,
I went to their main site to check my case this morning - Saturday - December 8th, 2007, and found this message
"The Case Status Online, Processing Times, Office Locator, and Change of Address Online Systems
will be experiencing a scheduled outage from 9:30 PM EST on Friday, December 7 to 8:00 AM EST on
Monday, December 10 due to scheduled maintenance."
Although I am disappointed that I won't be able to tell if I got a touch this past week, I hope that their maintenance

I can only dare to cross my fingers, but not to hold my breath...
My theory about missing cases online are clerical. Picture calling into a phone company, the representative may be
required to place a certain notation into your account every time you speak to them. Some do and some don't.
In our cases, the nice people who handle our cases, some would go the required way and check or mark or do whatever
they are require to grant an account to be accessed online aaand some don't!
I bet you in their mind this is how it goes - hey I have worked my butt off in reading through 10 - 20 pages of your pleading case!
What else do you want from me!!!
Now then, is when those of us who are at the receiving end would scramble and hit our heads against the wall
(as I have been doing for the least two weeks ) trying to figure out why one case is update but the other is not updated online or accessible online?
I had the same question - and the reply I got here is - oh, well, you are not supposed to take their notations on their
sites about your case seriously - Whaaaaaaaaaaat! That is MY CASE - and if one case is updated and the other is not -
I would like to know why... (See timeline )
This may be too early for some of you... I can only say, pray you get someone who is decent enough to take their time to update
your case online. In summary - I do not think there is a rhyme of reason why there is an inconsistency in the status of cases online.

Ok So an update....
I think I will be able to request a long form copy of my newer birth certificate that shows my maiden name only. If i get a new one issued then there should be no reason to start having to involve my birth name.
maybe this wont be so much of a hassel after all.
I will update tomorrow when I have spoken to the birth certificate office in England to confirm this is possible...

It just means they only updated the status message on your I485.
Don't put a load of stock in your status messages. It even tells you that on uscis.gov.

I have sent in my RFE on Nov 7th - they arrived on Nov 16th. I was informed that they have
received my update info and that my case has been resumed online on Nov 25th.
The unsettling thing here is - the posting is only for AOS - there is no posting on
resuming my EAD...
What does this really mean? I thought EADs are usually worked on either first or
are sent out sooner than AOS?
Has anyone been in this particular situation?

I wasn't aware of it and it cost me four weeks of dead air and some!!!
I got an RFE - and boy you wouldn't want that...
Though my case has been resumed - I have no clue as of what the next
step will be...

You'll most likely get an RFE if you don't include a copy of the NOA2 in your package.
Best to wait the extra week so that you can include it - you can technically file "out of status" so you being late by a couple of weeks isn't a big deal.
I would wait it out. You wouldn't want an RFE! Those little pink and green letters mess your
case flow and waist a lot of your precious time!
Take your time and have a complete package!

To put you at ease, one of my good friends was in the same situation as you are - they attended their interview with a expired passport. The agent just reminded them to renew it - that was all! Their interview came too soon for them to renew! I think you are in better shape having an expired passport then having nothing in your hands! (My personal thoughts!)
In regards to your kids - hey take them, if you are comfortable - but you got to take their birth certificate with you - regardless of their presence!
