    During your AOS (form i485) your spouse and mother in law didn't fill out separate i485s, they filled out separate i864s because affidavit of support was required.

     

    For i751, affidavit of support isn't required, so no sponsorship required. Remember you are the petitioner for your i751.

    I'm preparing to file my i-751 in July and had a question. When I filed the K1 visa and the adjustment of status, my spouse and my mother-in-law filled out the forms jointly as the co-sponsors (my spouse was going to school and didn't have a stable income so we decided to depend on our mother-in-law). With i-751, would I need my mother-in-law to fill out a separate i-751 form as a co-sponsor? Both my spouse and I have jobs now, and we are not worried about the federal poverty level, so we would not need to depend on mother-in-law's financial capacity. However, I wasn't sure since I submitted the previous forms with her as the join co-sponsor, this would cause inconsistency.

    USCIS will assign the service center handling your i751 case based on your address and whether or not they assign your application for an interview. Most i751 applications don't go to the local USCIS field office; they are processed by regional service centers or the National Benefits center. USCIS field offices will conduct an ROC interviews so if it gets assigned to one there is a good chance you will get a ROC interview.

  4. Hi folks,

    I know that I have to send the package to Phoenix, Arizona. But when I checked for the processing time at https://egov.uscis.gov/processing-times/ the time is different for each field office.

    That made me to wonder, how would I know which field office would get my package? Is it random or is it based on my residential address? I'm secretly praying for the field office with the shortest processing time haha

    Also, wasn't sure if I should trust visajourney's processing time or USCIS' processing time. They vary greatly from each other.

    I entered US via K1 visa and have filed AOS back in November 2018. Right now I have EAS/AP and waiting for AOS interview. I’m just wondering if my sponsor, who is my wife, can receive SNAP food stamp without making me a public charge. We do have my mother in law as a joint sponsor since my wife isn’t making enough money while going to school. 

     

    I am aware that food stamp has recently become one of the means-tested benefits for public charge so I cannot access it but my wife who is a US citizen can. However, when I looked at the SNAP application, it asks about all household members, household income and the immigration status for each member. If I am counted as a recipient of SNAP since I’m a household member and a main income provider, would I then become a public charge even though it was my US citizen wife who applied for SNAP?

     

    I heard so many different things so I just wanted to get more information from others who may have any prior experience. Thank you in advance!

    AOS AP can be used at any time, not just for emergencies. For Part 3, what I did was to input an unreasonable date considering USCIS processing timeline. For example, you can fill Part 3 like this:

    1. 11/28/2018

    2. 16

    3.a. No

    4.a. No

    5. (Just select this box and you are done with Part 3)

    The form explicitly states that only DACA AP applicants need to fill Part 4, and just go straight to Part 7. Nonetheless, there is no negative impact in filling Part 4. You can put a generic statement like "Visit my family" or "Visit (insert tourist attraction)". And at least put Canada (you can add countries if you wish).

    Remember to select "More than one trip" for #1 in Part 7.

     

    Thanks for the answer! Just one more part that's confusing me. The instruction says:

     

    Advance Parole Document for Individuals Who Are Currently in the United States
    If you are in the United States, you must attach:
    (1) A copy of any document issued to you by USCIS showing your present status, if any, in the United States; and
    (2) An explanation or other evidence showing the circumstances that warrant issuance of an Advance Parole
    Document; or
    (3) If you are an applicant for adjustment of status, a copy of a USCIS receipt as evidence that you filed the
    adjustment application; or
    (4) If you are traveling to Canada to apply for an immigrant visa, a copy of the U.S. consular appointment letter;

     

    I'm guessing I'm under #3? In this case, is the 'receipt' the AOS payment receipt? And would I still need to attach an explanation?

  7. Hi everyone. I got married with k1 visa last week and now filling my AOS packages right now, and I am a bit stuck with I131. Any advice would be greatly appreciated!

     

    1. In part 2 application type, would I be 1.d. “I am applying for an advance parole document to allow me to return to US after temporary foreign travel”? I don’t see any other type that would be applicable to me.

     

    2. In part 3 and 4, what if I don’t have any intended travel date and information right now? I guess I’m a bit confused because I thought AP was a document that allows me to travel when emergency situations arise. This part doesn’t make any sense to me since I can’t plan for emergency situations. Would I send i131 along with i485, or send i131 when I actually face an emergency? If latter is the case, would I get the AP in time for my travel?

    I'll be entering USA from Canada with the sealed envelope in early October (yay!) so I'm busy compiling all the necessary AOS documents. I just had a question about the I-693. I'm aware that if I file I-485 within 1 year of the oversea medical exam then I don't need to have another medical examination. However, I'm just a bit confused about this part: 

     

    Even if a new medical examination is not required, you must still show proof that you complied with the vaccination requirements. If the vaccination record (DS 3025) was not properly completed and included as part of the original overseas medical examination report, you will have to have the Part 9. Vaccination Record completed by a designated civil surgeon. In this case, you must submit Parts 1., 2., 3., 4., 6., and 9. of Form I-693.

     

    What kind of proof of vaccination requirement are they looking for? Would this be a letter from my family doctor saying that I received the required vaccinations? How would I be able to know if my vaccination record was properly completed in my medical examination report? Lastly, if my vaccination record was completed and nothing was wrong with it, would I still need to make an appointment with the civil surgeon and send the completed I-693?

  9. Hi all, I just had a quick question about traveling before using K-1 Visa.

     

    I'm currently preparing for my interview in May at Montreal, Canada. If I do receive the visa, I'm hoping to go on an early honeymoon to Japan with my fiance before I use my visa. However, most of the cheaper airline tickets have layovers in US cities like Chicago. Would I be able to land on US soil just for layover without 'using' my K-1 visa or is this not possible? I'm not sure if I'm making myself understandable here...
