  1. Mae, Yay! So happy to hear you finally heard something! Biometrics is of course super easy. Paul was only there for maybe 20 minutes or so. They wouldn't let me in the building, though. I had to wait in the car. (Well actually I walked to a store that was next door and did some window shopping :P ) But anyways, its nice to know that things are moving. :D

    Diana, no, no GC yet... We have our interview at the USCIS office on 20 September. So, hopefully, it will come soon after that. We applied for his AP & EAD too (in case his GC takes a while), and his AP just got approved on 4 September. So, we can finally go on a honeymoon out of the country (except that we don't really have the money for that right now, we spent most of our honeymoon money on our new place, oh well). I really really hope that his EAD gets approved soon or that his GC gets approved the day we have the interview. It will be ever so nice when he can work permanently. But yeah, that's where we stand now.

    Just out of curiosity, Mae & Diana, can you check the status for your AOS applications on the website now that you have your NOAs? We still cannot. We can only check EAD & AP. But, again, oh well.

  2. so we have changed our wedding date and i have a q...for the experts here.

    we are now getting married on 1 October which is 9 days before his visa expires. wondering if we can wait out the 10 days for the certified marriage certificate and send in our aos package or do we have to send in the aos stuff prior to the expiration and wait for the rfe?

    i'm sure this has been probably covered to death but i just didn't come up with anything when i searched for it.

    By the guidelines of the K1 visa you have to get married within the 90 days. You aren't required to submit your application for AOS within the 90 days, but it is of course a good idea to do it as soon as you can so that you can get the green card as soon as possible. But don't stress too much if it is a little bit

    outside of the 90 days. So long as you are married within the 90 days, you will be okay.

    Just saw, that John & Diana responded too, so ditto on what she said :)

    I don't know what state you are in and I don't think this works in all states, but it is something to look into: We were married by a justice of the peace and prior to our wedding day we let him know that we would be going through the process to get my husband's green card and wanted our marriage certificate ASAP, so the justice suggested that at the wedding he would give us the copy of the marriage certifiace to take the county clerk ourselves instead of him mailing it in. That way the county clerk was able to give us a certified copy of our marriage certificate on the spot just 2 days after our wedding. Now, I think this only works for certain states where they use the same document (Texas doesn't have a marriage license and marriage certificate, but only one document and once you get married the clerk puts an official seal on it and you are officially married). This process won't work for states where the marriage certificate is a completely different document, but it is something to look into in case it works for your state too.

  3. Well guys, they finally cashed our check....

    I couldn't figure out which number on the back of the check is our casenumber... :(

    I thought it was something like MSN and 9 numbers we had, but when I tried, it didn't work to login on USCIS...oh well...MAYBE we'll get a NOA1 hehehe

    FYI, I think the prefix is MSC, so you might want to try that.

    But it is possible that it doesn't work even if you have the right number. We got our case number in July and it STILL doesn't work on the website. And when I call the automated line it says invalid. And the first person I talked to @ USCIS, said it was invalid too, but then transferred me to another person who said that he uses a different system and shows the case as pending and doesn't know why it shows invalid on the computer system....but oh well..... we have our interview date so I know they have our case, so I guess I shouldn't worry about it. But anyways, my point is that you might have the correct number and it might just say invalid anyway... :wacko:

    Hopefully, it won't take too long for you guys to get more things going with AOS, too. Maybe you'll be even luckier than us and not need an interview :) We still don't have access to our AOS case online, so everything we have found out has been by snail mail. So maybe things are happening with your cases and you'll just be pleasantly surprised to get the notices in the regular mail :)

  5. Over here in California we drive 75 in a 65 and get passed by semi's sometimes. I'm not sure what part of California you are from, but 8 over, while it is an offense, the officer must be in a bad mood to ticket.

    In the OP's case I would bet the officer knows less about the law than he should and you should go to court and argue your case. Could also say the speeding seems out of place given the situation and keeping up with traffic. How did he clock you? Did you ask about the device and the last time it was calibrated?

    Maybe he is a single cop and was angry a 'foreigner,' snagged a good looking American girl or something?

    I think you have a good case, but it depends on what you guys said when pulled over, whether the officer shows in court, and whether the law you cited is current.

    I must be jaded, but unless you are 15-20 over the speed limit I don't see it as a big deal.

    I wasn't in the car actually. Paul said that the car in front of him braked (he didn't realize it was because there was a police car ahead). He switched lanes and then got pulled over by the officer. He called me when it happened because he needed to know where my insurance card was. I overheard the cop saying something about him being in the state for 2 months and that being plenty of time to get a driver's license. Paul said he explained that he was waiting on the correct documentation to get the driver's license, but to no avail...the cop gave the ticket anyway. I do think (and hope) that the cop just wasn't up to date on the law (which I believe I have current as I pulled it off of the Texas website today).

    Anywho, we'll fight that part of the ticket and pay the speeding part.

  6. Yep, I had already thought about the fact that it had been the 31st...quotas for sure. In Texas, you can take a defensive driving course to avoid having the offense go on your record, but because he also ticketed him for no Texas license that voids that option. I did call a traffic attorney, and he said that it should be no problem to get the Texas license ticket waived and that we just need the documentation from the DPS showing that an out of country license is valid for a year or until he has the proper documentation needed to get a Texas driver's license. So, he'll just have the speeding ticket at that point. I don't know how it works as far as your record goes if you don't yet have a US driver's license, but I guess we'll see.

    sigh...boys and fast driving :P I'm feeling slightly better about it all now, tho

  7. So yesterday, my husband got his first speeding ticket. I knew it was bound to happen sooner or later as he still tends to drive as if he is on the Autobahn. He was only going 8 miles over the speed limit which isn't tcompletely awful, but hopefully it will encourage him to start slowing down a bit. But....the thing that really FRUSTRATED me is that they gave him a second violation for not having a Texas Driver's license. When we went to change my name on my driver's license we tried to get his driver's license. The lady gave us a list which included resident alien card, EAD card, and F1 and J1 Visas with valid I94 good for a year (and then the normal US citizen documents). He didn't have any of the primary or secondary evidence. We showed her his K1 visa and I 94 in his passport and she checked the list and said that it wasn't on it and we would have to wait until he received his green card or Employment Authorization Card. She indicated that he is allowed to drive my car with his German driver's license until he had the proper documentation to get a Texas license.

    I also found on the Texas Department of Public Safety website:

    Out-of-Country Driver License

    1) How long can I drive with an out-of-country driver license?

    Generally, a person 18 to 75 years of age with a valid out-of-country driver license in their possession may drive a private, non-commercial motor vehicle in the State of Texas for up to one year from date of entry into the United States, if their home country has reciprocity with the U.S. In order to check for reciprocity agreement status, click on Reciprocity In Driver Licensing or you may contact License Issuance at (512) 424-5089 or by e-mail at license.issuance@txdps.state.tx.us. 37 Texas Administrative Code 15.91.

    So...I thought we were okay having him drive with his German driver's license until he got either his EAD or green card, but apparently the police officer disagreed. The ticket for driving without a Texas license is $160 (more than the speeding part), and I'm really frustrated because we tried to do the right thing and get his driver's license, but were unable to. :( And now I'm afraid that when we do get his Texas Driver's license then our insurance rates will skyrocket because of this now double ticket.

    Ugh, if only he would have driven the darn speed limit.

    Just a bit of an update. We received my husband's interview letter yesterday. The interview date will be September 20th. Still can't check status online or over the phone, says invalid receipt number, but it really doesn't matter now that we have our interview date. I'll ask them about it when we go to his biometrics appointment on August 2nd. Anywho....just waiting.... :whistle:

    just want to say we are still alive. We have been busy with our wedding. Today we prepared some papers for the AOS. I will study for the drivers liscence now - I have to take the written and the driver test again :crying:

  10. @Karoline You filed for the AOS already, right? So let me double check, if we have everything: 2 pictures, NOA2, marriage certificate, G-325A, I-485, I-693, I-864 and the I-94. Did you put the I-94 out of his passport and send it, or did you send them a copy of it? Is no passport copy required? The form for the vaccination (I-693, I think), did YOU print that out and took it to the doc, or did the doc have that paper?

    So great to hear from you Diana. I was actually thinking about you earlier today. I miss our little December filers family. :P Yes, our AOS is pending now. We just got our Biometrics Appointment for 08.02.07. It was pretty fast to get that. I can't check our status in the USCIS website, but I guess it is okay since we already have the biometrics I know they are working on our case. Maybe it's better to not be able to check so I don't go cuckoo like waiting for NOA2. :P Although, it is soooooooo much better now that we are together and I don't care too much how long it takes except maybe for the work authorization.

    Anyways, to answer your questions. You listed everything that you need, but for the I-693 you only need I-693A (the vaccination supplement to I693). The full I-693 is the full medical exam, and since you had one done in the last year for the K1 they don't require that you do another. But they do require that your vaccination records are transcribed to the I693A. I printed out the I693A and we brought it to the doctor, but I'm not sure if they used our copy or their own. I just wanted to make sure to have a copy just in case. When I called the civil surgeon's office, I explained that Paul only needed the vaccination supplement and not a full medical, but I had to explain that again at the appointment.

    For the I-94, make a copy of it front and back, send the copy, don't send the original! You do need a copy of your passport photo & information page and a copy of the page with your K1 visa. Paul and I also copied any page with an entry stamp too, but that probably wasn't necessary.

    And finally, just remember that John has to send in proof with the I864. A copy of his most recent tax return including copies of the W2s (he can also send the prior 2 years tax returns and a letter from employer stating salary but the form states that is optional and you only have to send that if you think it will help support your income levels).

    I think that's it and you'll be good to go.

  13. Hello everyone! I'm here now with my future husband! Boy, it was a long way to be here... 28 hours, Jesus! But thank God, I made it here safe and sound and seeing David at the airport made me forget about the long and tiring trip... and oh, the jetlag. He's worth everthing to me! It seems so surreal that I am here with him. I had to pinch myself till I got bruised just to make sure I wasn't dreaming. Anyway, it's going to be a busy month for me with all the adjustments to make, meeting my future in-laws, some new friends, plus the wedding preparations on top of everything.
