  1. It asked for: Give the number of certificate, date, and place it was issued. I'm looking at my Certificate Naturalization are they referring to the INS Registration Number? There's also a numner in RED which I'm not sure what it is? Maybe it the Number of the Paper Certificate itself.

    No your INS ( USCIS ) Registration# was your Alien Registration number. On my naturalization certificate its right a at the top right, under, United States Of America and to the right of the U.S. Seal, above the word Naturalization. Mine is an 8 digit numeric number. Hope that helps.

    So the number on the certificate that they want is in RED 8 digits above the word Naturalization. Not the INS Registration No that starts with an A under the word Naturalization.

    1. If I married her and file Adjustment I-485 before her Visa expires 6/1/07. What happens if it still processing and the Visa Expired?

    She will be in legal status because her AOS is pending.

    2. What happend if I file Adjustment I-485 after her Visa expired?
    She will have a visa overstay, which mean she will be illegal for the time between the J-1 expiring and AOS being filed. During this time she could be deported. However as soon as you file AOS she will be in legal status again and USCIS will forgive the visa overstay when you adjust status, as she is married to a US Citizen.
  3. Question for people on this forum:

    1. My girlfriend is currently in the US on a J1 Au Pair Visa. The Visa expires 6/1/07 and is not subject to 2 years requirement.

    2. We talked about her situation and she doesn't want to extend her J1 for a second year. She will probably stay with the host family until 5/15/07.

    3. I was planning on marrying her.

    Here's my question.

    1. If I married her and file Adjustment I-485 before her Visa expires 6/1/07. What happens if it still processing and the Visa Expired?

    2. What happend if I file Adjustment I-485 after her Visa expired?

  4. I'm new to this site and this process for I-129F. Here's the background:

    1. My girlfriend is here from Brazil on J1 visa for au pair without the 2 yrs requirement of needing to go back to Brazil. Her J1 visa expires 7/15/07.

    2. She doesn't want to extend for another year in the US.

    3. I'm a US citizen.

    4. We are getting serious and talking about marriage. I have known her for 5 months now.

    5. She want to go back to Brazil to finish her University (she has about 6 months left or 1 semester).

    6. Right now we think it's best to have her go back to Brazil, finish her studies, and bring her over on a I-129F. (bad thing is it's a 12 months wait but during that time she can finish her studies).

    7. We also thought about marrying her in the US and file for an adjustment I-485 but not sure if she can leave the country and go back to Brazil to finish her studies?

    Question:

    1. Based on out situation, is it best for us to do #6 or #7?

    2. If we go with #6, when can I start the I-129F petition? Now while she is here on her J1 or once she's back in Brazil?
