  1. Thanks all.  I should have put in the original post that I understand how US immigration law includes a presumption that the applicant intends to overstay, and that she will need to provide evidence that she will return.  

     

    Given that, her main "proof" is that she is a student in the middle of getting a degree, and that she intends to return to finish it.  Does that seem like a strong enough tie in her situation? 

     

    Bonus points:  Should she bring documentation from the school to the interview?

  2. Background: My Serbian wife came over on a "fiancee" K1 visa, we're not far from petitioning to remove conditions from her green card.  (USCIS screwed up her file royally, but that's not germain to this topic.)

     

    What we want to do: Bring her niece over for a visit on a Visitor visa (is that B2?).  She is 23 and a full-time student pursuing a science degree in Belgrade, Serbia.  We will be supporting the trip and stay entirely.

     

    My Question:  When I google what we need to provide to the niece websites are listing the same level of documentation that I submitted for the wife's K1, such as letter from bank showing balance over the last year, last three paystubs, letter from employer, etc.  Is this really needed??   On the USCIS site I dont find any confirmation of this.

  3. I've read that the "fiancee" visa is a faster track than the marriage visa.  Maybe look into that option instead.  

     

    Ditto the people who discourage entering on a tourist visa with the intent to marry.

  4. This was "unofficial" advice from the immigration attorney I hired, but she told me that there is an unwritten 'once denied, always denied' way of thinking.  Maybe it varies by consulate, I hope so.

     

    Remember, under US law the consulate must assume that the applicant will overstay the visa.  You have to give enough evidence to show that presumption is wrong.
